A.
Any person, partnership, corporation or any other type of entity
filing an application for a driveway permit with Upper Burrell Township
shall at the time of filing, pay to Upper Burrell Township a fee as
shall be set forth in a resolution duly adopted by the Board of Supervisors
of Upper Burrell Township.
B.
If the proposed construction and/or location of the driveway/access
road shall be determined to require reconstruction, relocation or
other alteration of drainage ditches, berms or cartways of the Township
road or right-of-way, said reconstruction, relocation or other alteration
being necessary to maintain the integrity of the Township road or
right-of-way, the applicant shall be responsible for the payment of
all costs associated with the reconstruction, relocation or other
alteration of said Township road or right-of-way, including, without
limitation, construction costs, the costs of all materials, engineering
fees and inspection expenses.
C.
All costs as herein before described shall be paid to Upper Burrell
Township prior to the final issuance of a driveway permit.
