A. 
A permit issued pursuant to this chapter shall constitute permission, in writing, to manufacture, maintain, store, handle, install, erect, use or conduct the activity specified on the permit. Nothing herein shall relieve any applicant or licensee from the responsibility of obtaining any other license, permit, certification, permission or authorization required of any other governmental authority or entity. Any permit issued pursuant to this chapter shall not be transferable or assignable. Each permit shall be limited to the purpose and materials set forth on the face thereof, and any change in use or occupancy of the premises shall require a new permit. Every permit shall be null and void upon the expiration date indicated thereon or upon the revocation or suspension of said permit.
B. 
Before any permit may be issued, the Department of Public Safety and/or the Fire Prevention Division shall inspect and approve the receptacles, equipment, vehicles, buildings, materials, premises or storage places to be used. In cases where the approval of any other governmental agency is required, no permit shall be issued until satisfactory evidence of such approval has been submitted by the applicant.
C. 
All applications for a permit required by this chapter, other than an application for a household or commercial burning permit, shall be made to the Fire Prevention Division in such form and detail as the Town of Smithtown may prescribe. Applications for permits shall be accompanied by such plans required by the Fire Prevention Division. An application for a household or commercial burning permit may be made to the Chief of the Fire Department in whose district the burning is to be conducted. A permit shall not be issued for a period longer than one year from the date thereof, unless specifically stated by some other section of this chapter.
D. 
Permits shall at all times be kept on the premises designated thereon and shall at all times be subject to inspection by the Fire Prevention Division and any employee or designated agent of the Town of Smithtown, the Police Department and/or the Fire Department in whose district said premises are located.
E. 
A copy of each permit, together with the application and plans on which it is based, shall be available to the Chief of the Fire Department which protects the area in which the premises are located.
F. 
The Director of the Department of Public Safety or Chief Fire Marshal may revoke any permit or approval issued, and the Chief of the Fire Department may revoke a household or commercial burning permit issued by the Chief, if any violation of this chapter is found upon inspection or in case there has been any false statement or misrepresentation as to a material fact in the application or plans on which the permit or approval was based.
G. 
No building or structure, except one- and two-family dwellings, shall be erected or altered until the plans therefor have been approved, in writing, by the Fire Prevention Division. Such written approval shall not be given where said construction or alteration would be in violation of any of the provisions of this chapter.

Fees shall be charged for each license, permit or certificate required under this chapter.
A. 
The Town Board shall adopt and from time to time amend, by resolution, a schedule of fees charged for fire prevention permits issued under this chapter.
B. 
Fees adopted and/or amended by Town Board resolution shall remain in effect until such time as they are amended by a subsequent Town Board resolution.
C. 
Official copies of the current fire prevention permit fee schedule, along with the Town Board resolution approving same, shall be maintained by the Town Clerk, the Director of the Department of Public Safety and the Chief Fire Marshal.
D. 
Effective date. This section shall become effective immediately upon filing with the New York State Secretary of State.
