Borough of Wallington, NJ Chapter 241 Human-Powered Locomotion Devices

§ 241-1 Operators under 18 required to wear helmets. [1]

No person under the age of 18 years shall ride upon or use in-line skates, roller blades, roller skates, skateboards, zipper scooters or similar human-powered locomotion devices unless that person is wearing a properly fitted and fastened helmet which meets the standards of the American National Standards Institute (ANSI Z90.4 bicycle helmet standard), or the Snell Memorial Foundation's 1990 Standard for Protective Headgear for Use in Bicycling, or a helmet which is designed specifically for use with the particular device being used.

§ 241-2 Prohibited activities.

No person shall operate or cause to be operated any human-powered locomotion device or bicycle upon the sidewalks of the Borough of Wallington in a careless or hazardous fashion or in a manner creating interference with pedestrian traffic.

§ 241-3 Holding on to motor vehicle prohibited.

It shall be unlawful for any person using a human-powered locomotion device to hold onto a motor vehicle while said motor vehicle is in motion.

§ 241-4 Violations and penalties.

Every person convicted of a violation of any provision of this chapter or any supplement thereto shall be liable as follows:

A. First offense: a fine of $25 or five hours' community service, or both;

B. Second offense: a fine of $50 or 10 hours' community service, or both; or

C. Third or more offense: a fine of $100, 20 hours' community service or imprisonment for a term not exceeding 10 days, or any combination of these sanctions.

§ 241-5 Liability of parent or guardian for violation of helmet requirements. [1]

The parent or guardian of the person who violates the provisions of this chapter may be punishable as provided in Chapter 1, Article II, General Penalty, of the Code of the Borough of Wallington.

§ 241-6 Waiver of penalty.

Penalties provided in this chapter for a failure to wear a helmet may be waived if an offender, his or her parent or legal guardian, presents suitable proof that an approved helmet was owned at the time of the violation or has been purchased since the violation occurred.
