There is hereby created a Recreation Board known as the "Jacobus
Recreation Board."

The Board shall be composed of nine voting members, to be appointed
by the Council of the Borough of Jacobus, with the power to provide,
conduct and maintain public recreation areas, facilities and centers,
subject to all of the responsibilities of the recreation enabling
legislation. The Board shall further consist of a representative of
the Dallastown Area School District with no voting privileges and
two junior members who will serve one year, from January through December
of their junior year in high school, with no voting privileges. The
Board members shall serve for terms of three years and until their
successors shall be appointed, except that the members first appointed
shall be so appointed that the term of at least three members shall
expire annually thereafter. Vacancies shall be filled in the same
manner as original appointments and for the unexpired term. Members
shall serve without pay.
The Recreation Board shall appoint from its membership a Chairman
and such other officers as it may deem necessary for the orderly procedure
of its business and may adopt bylaws, rules and regulations covering
its procedure not inconsistent with the provisions of the state laws.
The Recreation Board shall, from time to time, make rules governing
the operation and conduct of the recreational facilities operated
by the Board. The Board shall hold regular meetings at such times
and places as it may designate.
The Recreation Board shall maintain, operate and supervise the
public parks, play fields and all outdoor and indoor recreation areas
and facilities owned or controlled by the Borough of Jacobus.
The Recreation Board may accept any grant, gift, bequest or
donation of services, equipment, real estate, or money from any individual
or group, to be used as specified by the donor or by the terms of
acceptance. The Recreation Board shall have no authority to enter
into any contract or incur any obligation binding upon the Borough
of Jacobus, other than current obligations or contracts to be fully
executed within the then-current fiscal year, and all within the budget
appropriations made by the governing body of the Borough of Jacobus.
The Recreation Board shall have the power to appoint an Executive
Director or Superintendent of Recreation, who will possess the necessary
qualifications and who has demonstrated, by actual work, his ability
to organize and direct a community recreation system and supervise
the activities of such other personnel as may be deemed necessary
in carrying out the program.
Funds appropriated by the Borough Council of the Borough of
Jacobus and budgeted to the Recreation Board shall be disbursed by
the Treasurer of the Borough of Jacobus upon vouchers issued by the
Recreation Board and within the budget appropriations made. Funds
received by the Recreation Board from sources other than budget appropriations
shall be deposited by the Jacobus Recreation Board, to the credit
and for the use of the said Board, and disbursed as the above budget
funds are disbursed, except that funds received by gift, bequest,
or otherwise shall be disbursed in accordance with the terms of such
gift or bequest or the terms of the acceptance thereof.
The Recreation Board shall make full and complete reports to
the Borough Council at such times as may be designated or requested
by the Borough Council. The fiscal year of said Recreation Board shall
conform to that of the Borough of Jacobus.
Such powers as are now or may hereafter be provided by statute
of the Commonwealth of Pennsylvania or by ordinances of the Borough
of Jacobus relating to the development and operation of recreation
systems, public parks and playgrounds are hereby vested in the Recreation
Board, to be exercised by it subject to any and all restrictions contained
in such statutes and ordinances.

It is hereby found to be in the best interest of all municipalities and their citizens to fund and support and to cooperate
with each other with regard to JLS, which recreation facilities are
located in each municipality. To undertake such continued joint cooperation
and existence of JLS, the municipalities shall enter into an agreement
to amend and restate the existing intermunicipal agreement for JLS.
Jacobus Borough hereby approves the amendment and restatement
of the agreement for JLS with Loganville and Springfield. The terms,
conditions, and percentage of financial responsibility of the agreement
are set forth in Exhibit A, attached hereto and incorporated herein
by reference thereto. The appropriate officials of Jacobus Borough are hereby
authorized to execute and deliver the agreement. Said agreement shall
not be effective until all municipalities have properly executed the
agreement. Amendments to the agreement and the bylaws may be made
by resolution adopted by each of the municipalities party to the agreement
from time to time.
The purpose, objectives, and authority delegated to JLS by the
agreement is as set forth in the agreement, a copy of which is attached
as Exhibit A, which the municipalities deem are necessary to continue
JLS and establish the rights, obligations, responsibilities, and internal
workings for all participants thereto in regard to the operation of
JLS.
The municipalities recognize that the agreement is for an indefinite
period of time, lasting as long as JLS continues to exist.
The manner and extent of financing of JLS operations is as set
forth in the agreement, Exhibit A.
The organizational structure shall be as set forth in the bylaws
of JLS to be duly adopted by each municipality and attached hereto
as Exhibit B.
JLS shall not acquire or own any real estate but may own and
manage incidental personal property in the nature of various recreational
equipment.
