A.
This chapter shall be construed in consonance with the ordinance
of this Township's Board of Health regarding a farmers'
market.[1] This chapter is adopted essentially in order to provide
for a committee, known as the Farmers' Market Committee, which
will oversee, supervise, and provide rules for the operation of the
farmers' market, and to provide for a Farmers' Market manager.
B.
A Farmers' Market is an essentially outdoor food establishment,
located on Township-owned lands, for the selling of produce grown
by persons selling it, the selling of produce derivatives (licensed
and permitted where applicable) which the sellers have created, the
selling of baked goods by the creators thereof (originating from state-inspected
and -licensed facilities), and the selling, under reasonable regulations
of the Farmers' Market Committee, of artisan crafts.
A.
Established; title. The Holland Township Farmers' Market Committee
is hereby authorized and established to serve as an advisory committee
to the Board of Health and the Township Committee, and to be responsible
for supervising market operation, recommending to the Board of Health
the issuance of appropriate licenses, and ensuring compliance with
orders of the Hunterdon County Department of Health, Holland Township
Board of Health and the other provisions of this section. Such Committee
shall also formulate rules regarding the Farmers' Market, which
shall be subject to the approval of the Township Committee and Township
Board of Health.
B.
Composition; appointment. The Farmers' Market Committee shall
consist of six members who shall be appointed by the Township Committee.
One each of the members of such Committee shall be also a member of
the Township Board of Health, the Township Parks and Recreation Committee,
and the Township Agricultural Advisory Committee. Two of such members
shall be a member of the Township Committee. One of the members of
the Committee shall be a Township resident who is not a member of
the Board of Health, Parks and Recreation Committee, Agricultural
Advisory Committee, or Township Committee.
C.
Term. The members shall be appointed for one-year terms. The members
first appointed shall be appointed for terms ending on January 1 immediately
following the year of appointment.
D.
Salary. The members of the Farmers' Market Committee shall serve
without compensation (except that if one such member is also the Farmers'
Market manager, such member may receive compensation as such manager).
E.
Meetings. The Farmers' Market Committee shall hold meetings
at least four times per year and shall keep a record of its proceedings.
F.
Additional duties. The Farmers' Market Committee shall prepare and distribute to all vendors a list of rules, formulated and approved as set forth above in Subsection A, to ensure compliance with state health regulations and the orderly operation of the market. These rules shall include, but not be limited to, requirements for mechanical refrigeration units for certain vendors, requirements for antibacterial wipes, and reference to applicable state, county and municipal health regulations. A member of the Farmers' Market Committee shall be on site whenever the market is in operation and the Farmers' Market manager cannot be on site.
G.
No power to incur obligations. The Farmers' Market Committee
shall not have the authority to incur any obligation in the name of
or for the account of the Board of Health or the Township.
A.
The Farmers' Market Committee shall appoint, subject to the
approval of the Township Committee, a Farmers' Market manager.
Such manager may, but need not, be a member of the Farmers' Market
Committee. Such manager shall:
(1)
Attend meetings of the Farmers' Market Committee;
(2)
Be on site during the operation of the Farmers' Market (unless
prevented from doing so by illness or other circumstance, in which
case there shall be a member of the Farmers' Market Committee
on site);
(3)
Supervise the operation of the market, monitor market operation so
as to insure that state laws and state, county, and local regulations
pertaining to the operation of the market are observed, and that rules
promulgated by the Farmers' Market Committee are followed.
B.
The Farmers' Market manager may receive a salary or wage as
approved by the Township Committee. The Farmers' Market manager
shall serve for a one-year term but may be removed as manager by action
of the Township Committee in consultation with the Farmers' Market
Committee.
