Before acting on any subdivision plan, Borough Council may arrange
for a public hearing thereon, after giving such public notice as Borough
Council may deem desirable in each case.
Borough Council may alter any subdivision plan and specify changes
or modifications therein which it deems necessary and may make its
approval subject to such alterations, changes or modifications.
After a subdivision plan has been duly recorded, and the streets,
highways, parks, and other public improvements shown thereon have
been accepted by the Borough, the same shall be considered to be a
part of the Official Plan of the Borough of Jenkintown.
Streets, parks and other public improvements shown on a subdivision
plan to be recorded may be offered for dedication to the Borough by
a formal notation thereof on the plan, or the owner may note on the
plan that such improvements have not been offered for dedication to
the Borough.
Every street, park or other improvement shown on a subdivision
plan that is recorded as provided herein shall be deemed to be a private
street, park or improvement until such time as the same has been offered
for dedication to the Borough and accepted by ordinance, deed or resolution
or until it has been condemned for use as a public street, park or
other improvement.

Any person, partnership or corporation who or which being the
owner or agent of the owner of any lot, tract or parcel of land shall
lay out, construct, open or dedicate any street, sanitary sewer, storm
sewer, water main or other improvements for public use, travel or
other purposes or for the common use of occupants of buildings abutting
thereon, or who sells, transfers or agrees or enters into an agreement
to sell any land in a subdivision or land development whether by reference
to or by other use of a plat of such subdivision or land development
or otherwise, or erect any building thereon, unless and until a final
plat has been prepared in full compliance with the provisions of this
chapter and of the regulations adopted hereunder and has been recorded
as provided herein, shall be guilty of a misdemeanor and, upon conviction
thereof, such person or the members of such partnership or the officers
of such corporation or the agent of any of them responsible for such
violation shall pay a fine not exceeding $600 or be subject to imprisonment
for a period of not to exceed 30 days, or both, per lot or parcel
or per dwelling within each lot or parcel. All fines collected for
such violations shall be paid over to the Borough. The description
by metes and bounds in the instrument of transfer or other document
used in the process of selling or transferring shall not exempt the
seller or transferor from such penalties or from the remedies herein
provided.
