Except as otherwise specifically provided in this chapter, the statutory provisions in Chapters 340 to 348 of the Wisconsin Statutes, describing and defining regulations with respect to vehicles and traffic, exclusive of any provisions therein relating to penalties to be imposed and exclusive of any regulations for which the statutory penalty is a fine or term of imprisonment, are hereby adopted and by reference made a part of this chapter as if fully set forth herein. In addition, any rule of the Department of Transportation promulgated under W.S.A. Ch. 110, 347 or 348, except rules pertaining to federal motor carriers safety standards, for which the penalty for violation thereof is a forfeiture, is hereby adopted and by reference made a part of this chapter as if fully set forth herein. Said rules promulgated by the Department under said chapters pertain to motor vehicle equipment standards or size, weight and load limits. Any act required to be performed or prohibited by any statute incorporated herein by reference is required or prohibited by this chapter. Any future amendments, revisions or modifications of the statutes or rules incorporated herein are intended to be made part of this chapter in order to secure uniform statewide regulation of traffic on the highways, streets and alleys of the State of Wisconsin.

(1) 
Duty of the Department of Public Works in coordination with the Chief of Police to erect and install uniform traffic control devices. Whenever traffic regulations created by this chapter, including a State of Wisconsin traffic regulation adopted by reference in § 4.01, require the erection of traffic control devices for enforcement, the Department of Public Works, in coordination with the Chief of Police, shall procure, erect and maintain uniform traffic control devices conforming to the Uniform Traffic Control Device Manual promulgated by the Wisconsin Department of Transportation, giving notice of such traffic regulation to the users of the streets and highways on which such regulations apply. Whenever state law grants discretion to local authorities in erecting or placement of a uniform traffic control device, devices shall be erected in such locations and in such a manner as in the judgment of the Department of Public Works and Chief of Police will carry out the purposes of this chapter and give adequate warning to users of the streets and highways of the City.
(2) 
Official traffic map.
(a) 
Official traffic map established. There is hereby established for the City of Shawano an Official Traffic Map, dated April 7, 1982, upon which is indicated, as of said date, all existing no parking areas, restricted parking areas, stop signs, arterial intersections, yield signs, special speed limits, one-way highways, school crossings and all other restrictions or limitations contained in this chapter and for which the laws of the State of Wisconsin require the erection or use of official traffic control devices to enforce such restrictions or limitations. All such restrictions and limitations set forth on said Official Traffic Map are hereby ratified and affirmed.
(b) 
Additions to map. The Council may from time to time make additions to or deletions from the Official Traffic Map, and the Department of Public Works in coordination with Chief of Police shall keep such Official Traffic Map current. Additions to said Official Traffic Map made after April 7, 1982, shall be made by an authorizing ordinance or resolution.
(c) 
Map to be maintained. A copy of the Official Traffic Map shall be maintained and displayed in the office of the Public Works Department. The Department of Public Works in coordination with the Chief of Police shall make appropriate authorized changes on said map after the appropriate official traffic control device is erected or removed, as the case may be.
(d) 
Violations prohibited. When official traffic control devices giving notice of the restrictions, prohibitions and limitations shown on the Official Traffic Map are erected and maintained in accordance with the provisions of this section, a violation of the restriction, prohibition or limitation shown on the Official Traffic Map shall be a violation of the provisions of this chapter.
(3) 
Prohibited signs and markers in highways. No person other than an officer, authorized by this chapter to erect and maintain official traffic control devices, or his or her designee, shall place within the limits of any street or highway maintained by the City any sign, signal, marker, mark or monument unless permission is first obtained from the Chief of Police or State Highway Commission. Any sign, signal, marker, mark or monument placed or maintained in violation of this subsection shall be subject to removal as provided in Subsection (4) of this section.
(4) 
Removal of unofficial signs, markers, signals and traffic control devices. The Chief of Police may remove any sign, signal, marker or other device which is placed, maintained or displayed in violation of this chapter or state law. Any charge imposed against premises for removal of a prohibited or illegal sign, signal, marker or device shall be reported by the Chief of Police to the Council for review and certification at its next regular meeting following the imposition of the charge. Any charge not paid on or before the next succeeding November 15 shall be placed upon the tax roll for collection as other special municipal taxes.

(1) 
Authority. Section 62.11(5), Wis. Stats., provides, in part, that: ". . .the council shall have the management and control of the city property. . .highways. . .and the public service, and shall have the power to act for the government and good order of the city . . . . The powers hereby conferred shall be in addition to all other grants, and shall be limited only by express language."
(2) 
Procedure to request renaming of street, other than by City. To request the renaming of a City street, by anyone other than the City, a petition signed by at least 50% of all property owners along the street in question shall be submitted to the Plan Commission for recommendation to the Common Council. Petition signatures shall be limited to one per parcel. Renaming shall be accomplished through the adoption of a formal resolution by the Common Council. The written petition shall specifically include the following information:
(a) 
The names, addresses, and signatures of the lot owners and businesses in favor of the proposed name change (and date of signing the petition).
(b) 
A detailed map identifying the street, roadway or highway portion to be affected by the proposed name change.
(c) 
The specific reasons for the requested name change.
(d) 
The person(s) circulating the petition.
(e) 
An administrative processing fee of $25 shall be paid to the City Clerk upon the filing of said petition with the City Clerk.
(3) 
Procedure for renaming streets within a recorded subdivision or certified survey map. For streets within a recorded subdivision or certified survey map, an affidavit of correction shall be recorded with the Register of Deeds as specified pursuant to § 236.295, Wis. Stats.
(4) 
The Common Council may initiate the renaming of a City street in accordance with the procedure set forth in this section, with the exception of the requirement of a written petition of the affected property owners.
(5) 
Miscellaneous provisions. The City Council shall use its discretion and good judgement in considering any proposed name changes. The following criteria shall be considered when changing official street names:
(a) 
The proposed street name has some historical, archaeological, environmental or ethnic significance to a particular area or neighborhood of the City.
(b) 
The proposed street name change would be utilized to honor a significant or outstanding person who has played an important role in the City's history.
(c) 
The proposed street name provides significance in identifying particular commercial or industrial centers.
(d) 
Other such name changes which would be mutually beneficial to the City and its property owners in identifying a particular area or location for emergency purposes.
(6) 
Public hearing. The City Clerk shall, upon receipt of a petition or request, schedule a public hearing with the Plan Commission to request a recommendation from the Plan Commission. The Clerk shall post a notice of the public hearing and publish a Class 1 notice regarding the proposed renaming. The Plan Commission shall make a recommendation on the proposed renaming, with said recommendation to be submitted to Council within 60 days of the public hearing.
(7) 
The official street name change shall become effective upon the adoption of the resolution, and, upon adoption, the Department of Public Works shall be directed to post proper signage and make any necessary changes on the official map as soon as practicable.
(8) 
Fees/costs. All fees or costs associated with the renaming, including the cost of any recording publication necessary, shall be paid by the person(s) submitting the request.
The Council hereby determines that the statutory speed limits on the following streets or portions thereof are unreasonable, unsafe and imprudent and modifies such speed limits as follows:

(3) 
Designation of location of stop and yield signs. In the interest of public safety, the Council, by resolution, has designated the location of stop and yield signs within the City and has ordered the installation of such signs. In addition, the location of such signs is indicated on the Official Traffic Map of the City pursuant to § 4.02 of this chapter.
(4) 
Operators to obey traffic control devices. Every operator of a vehicle approaching an intersection at which an official traffic control device is erected in accordance with this section shall obey the direction of such official traffic control device as required by the Wisconsin Statutes incorporated by reference in § 4.01 of this chapter. Operators of vehicles approaching a stop sign shall stop before entering a highway as required by W.S.A. s. 346.46. Operators approaching intersections at which a yield sign has been installed shall yield the right of way to other vehicles as required by W.S.A. s. 346.18(6).

One-way highways. The following highways or portions thereof maintained by the City are hereby designated one-way highways, and no person shall drive or operate a vehicle on any such one-way highway or portion thereof except in the one direction designated below:

(2)

(a) 
Right turn on red signal prohibited. No operator of any vehicle shall make a right turn on a red signal at the following locations:

(b) 
Other. The operator of a vehicle intending to turn at an intersection shall make such turn at the intersection and shall comply with the applicable sections of the Wisconsin Statutes and shall not deviate from the roadway and drive through a private or public parking lot for the purpose of making a turn, with the intent to avoid the traffic control sign or signal at such intersection.
(3) 
Miscellaneous lane and turn controls. The Chief of Police, with the cooperation of the Director of Public Works, is authorized, when in his or her judgment the safety of the situation requires, to place official traffic control devices within or adjacent to intersections directing that a different course from that specified in W.S.A. s. 346.31 be traveled by vehicles turning at the intersection and to mark lanes for traffic designating separate lanes for slow moving traffic or for traffic moving in a particular direction.

(2) 
Restrictions on use of other streets by heavy traffic. No person shall operate or move a vehicle, except a motor bus, which is not equipped with pneumatic tires or has a combined vehicle load weight exceeding 10,000 pounds on any highway not part of the heavy traffic route designated in Subsection (1) of this section, except for the purpose of obtaining orders for or moving or delivering supplies or commodities to or from a place of business or residence which has an entrance thereon; provided that, in no event shall the weight of vehicle and load on any street not defined or designated as a heavy traffic route under Subsection (1) exceed the limitations pertaining to Class "A" highways or deliveries on Class "B" highways established by the Wisconsin Statutes.
(1) 
Time limitations. It shall be unlawful to stop any railroad train, locomotive or railroad car upon or across any highway or street crossing or to cause obstruction of vehicular traffic on public streets at such crossing by the stopping, leave standing or switching at such crossing longer than five continuous minutes, or for more than seven minutes out of any 12 continuous minutes. No railway train, while in continuous motion, shall obstruct any highway or street crossing for more than 10 minutes.
(2) 
Penalty. Either the owner or any conductor, engineer, switchman, brakeman or other employee or agent in charge of, or otherwise responsible for, such offending railroad locomotive or car who shall violate the provisions of this section shall, upon conviction, pay the City a forfeiture of not less than $100 nor more than $500 for each such violation, and a violation for each five-, twelve- and ten-minute period, respectively, referred to in Subsection (1) above shall constitute a separate offense, plus the costs of prosecution, and, in default of payment, shall be imprisoned not less than five days nor more than 15 days in the county jail.[1]

(1) 
Except as otherwise set forth in the Code of Ordinances, the following parking restrictions shall apply in the City of Shawano:
(a) 
Acorn Street.
1. 
There shall be no parking, standing or stopping on the west side of Acorn Street.
(b) 
Andrews Street.
1. 
There shall be no parking, standing or stopping on the west side of the 100 block of North Andrews Street commencing at the northwest corner of Green Bay Street and Andrews Street, which is the point of beginning, thence north 75 feet.
2. 
There shall be no parking on the west side of South Andrews Street from the south curbline of Green Bay Street southerly a distance of 320 feet.
3. 
Angle parking is permitted on the east side of the 300 block of South Andrews Street, beginning 110 feet south of Center Street and east on Andrews Street to Randall Street.
(c) 
Bartlett Street.

1. 
Angle parking is permitted on the west side of the 300 block of North Bartlett Street.
(d) 
Center Street.

1. 
Ten-minute limited time parking between 7:00 a.m. and 5:00 p.m., except weekends and holidays, on the north side of the 100 Block of East Center Street from South Main Street to Sawyer Street.
2. 
Two-hour limited time parking between 7:00 a.m. and 5:00 p.m., except weekends and holidays, on the south side of the 100 Block of East Center Street from South Main Street to the east 190 feet on the south side.
(e) 
Community Hall.
1. 
Three-hour limited-time parking:
a. 
On the east side of Community Hall, which consists of approximately 40 parking spaces, also known as part of Lot 7.
2. 
Two-hour limited-time parking from 9:00 a.m. to 5:00 p.m. Monday through Saturday and 5:00 p.m. to 9:00 p.m. Friday:
a. 
In the Community Hall parking lot described as N. 41.8 feet of W. 85 feet of Lot 8 Block 31, Sawyer and Andrews Plat, to the City (now known as Lot 7), except that portion which is a three-hour parking area as provided for herein from 9:00 a.m. to 5:00 p.m. Monday through Saturday and 5:00 p.m. to 9:00 p.m. Friday.
(f) 
Division Street.
1. 
There shall be no parking, standing or stopping on the north side of Division Street from Main Street one block west to Washington Street.
2. 
There shall be no parking, standing or stopping on the south side of Division Street from Main Street to Lafayette Street.
3. 
There shall be no parking, standing or stopping on the north side of West Division Street between South Main Street and South Washington Street.
4. 
There shall be no parking, standing or stopping on the north side of West Division Street between South Washington Street and South Franklin Street, except on Sunday mornings.
5. 
Fifteen-minute limited-time parking from 9:00 a.m. to 5:00 p.m., except Sundays and holidays:
a. 
On the north side of Division Street commencing at the west property line of 215 East Division Street, thence east to the east property line of 221 East Division Street from 9:00 a.m. to 5:00 p.m., except Sundays and holidays.
6. 
Two-hour limited-time parking from 9:00 a.m. to 5:00 p.m. Monday through Saturday:
a. 
On both sides of East Division Street from Main Street to Andrews Street, except the area described in this subsection, which restriction shall be controlling for said area from 9:00 a.m. to 5:00 p.m. Monday through Saturday.
(g) 
Elizabeth Street.
1. 
There shall be no parking, standing or stopping on the north side of Elizabeth Street fronting the width of the City-owned property described as Lot 1, Block 30, of the City of Shawano Assessor's Map.
2. 
There shall be no parking, standing or stopping on the north and south side of Elizabeth Street from Main Street to Lincoln Street.
3. 
Limited-time parking from 7:00 a.m. to 5:00 p.m., except on weekends and holidays:
a. 
On the north side of Elizabeth Street from the west curbline on Lincoln Street westerly for a distance of 286 feet from 7:00 a.m. to 5:00 p.m., except on weekends and holidays.
4. 
There shall be no parking, standing or stopping from March 15 to September 1 of each year on the north side of the 400 block of East Elizabeth Street in the area described as follows: commencing at the center line of the intersection of S. Lincoln Street; thence 75 feet along the north curbline of E. Elizabeth Street to the point of beginning, which is the start of no parking on the north side of E. Elizabeth Street; thence continue 69 feet to the end of no parking on E. Elizabeth Street. (End of no parking is four feet east of existing driveway entrance.)

(h) 
Ellis Street.
1. 
There shall be no parking, standing or stopping on Ellis Street between Green Bay Street and Fifth Street.
(h1) 
Engel Drive.
1. 
There shall be no parking, standing or stopping on both sides of Engel Drive from the east curbline of Waukechon Street a distance of 285 feet to the east (to driveway entrance to Hillcrest School).
(i) 
Fairview Way.
1. 
There shall be no parking, standing or stopping on the east side of South Fairview Way from the south curbline of Green Bay Street southerly a distance of 330 feet.
2. 
There shall be no parking, standing or stopping on the west side of South Fairview Way from East Green Bay Street to Center Street.
(j) 
Fifth Street, East.
1. 
There shall be no parking, standing or stopping on the north side of the 100 block of East Fifth Street from Main Street to the east a distance of 232 feet.
2. 
There shall be no parking, standing or stopping on the south side of the 100 block of East Fifth Street starting 124 feet from the east curbline of North Main Street and ending 245 feet from the east curbline of North Main Street.
3. 
There shall be no parking, standing or stopping on the south side of East Fifth Street between Sawyer Street and Lincoln Street.
4. 
Two-hour limited-time parking from 9:00 a.m. to 5:00 p.m. Monday through Saturday:
a. 
On both sides of Fifth Street from Washington Street to Sawyer Street from 9:00 a.m. to 5:00 p.m. Monday through Saturday.[2]

(k) 
Fourth Street.
1. 
There shall be no parking, standing or stopping on the south side of Fourth Street between Washington Street and Franklin Street.
2. 
Limited-time parking from 7:00 a.m. to 5:00 p.m., except Sundays and holidays:
a. 
On the north side of Fourth Street from Main Street west for 150 feet from 7:00 a.m. to 5:00 p.m., except Sundays and holidays.
3. 
Two-hour limited-time parking from 9:00 a.m. to 5:00 p.m. Monday through Saturday.
a. 
On both sides of West Fourth Street from Main Street to Washington Street from 9:00 a.m. to 5:00 p.m. Monday through Saturday.
b. 
On the north side of the 200 block of West Fourth Street from 9:00 a.m. to 5:00 p.m. Monday through Saturday.
(l) 
Franklin Street.
1. 
Angle parking is permitted on the west side of North Franklin Street from Fifth Street to the south a distance of 156 feet.
(m) 
Green Bay Street.
1. 
There shall be no parking, standing or stopping on all sides of Green Bay Street and any intersecting street therewith, a distance of 60 feet back from such intersection thereof. There shall be no parking, standing or stopping on the west side of Waukechon Street from the south curbline of Birch Hill Lane south for a distance of 581 feet (to the north curbline of Dallman Lane).
(hh) 
Woodlawn Drive.
1. 
There shall be no parking, standing or stopping on the east side of Woodlawn Drive commencing at the intersection of East Green Bay Street and Woodlawn Drive thence continuing north 920 feet to the place of beginning, which shall be the start of the no-parking zone, and said no-parking zone shall continue for a distance of 330 feet to the north from the point of beginning to the end of the no-parking zone.
(ii) 
No parking except for authorized vehicles. Except as herein permitted, no person shall park, stop or leave standing any vehicle in the following places unless authorized by an official traffic control sign:
1. 
At any curb marked as a taxi stop or stand.
2. 
At any curb or City parking lot designated as parking for City personnel.
(jj) 
Loading zones.
1. 
Definition. "Loading zones" are hereby defined to be those areas within the City limits, not located on Green Bay Street or Main Street, which are designated to permit temporary parking, stopping or standing for the purpose of loading or unloading trucks, buses or other service or supply vehicles.
2. 
Restrictions. Any vehicle stopped within a properly designated loading zone shall be attended by a licensed operator so that it may be moved in case of an emergency or to avoid obstruction of traffic.
3. 
Zones designated. Those areas designated by the Field Committee after written application, investigation and approval shall be designated as loading zones.
(kk) 
Temporary parking for funerals. Temporary parking for funerals at all City churches shall be allowed, provided that the funeral homes furnish signs indicating that temporary parking shall be allowed. When an area is so signed, all persons parking in said areas for funerals shall be exempt from all other provisions of this section; provided, however, that said temporary parking shall be for a period of not longer than two hours.
(ll) 
Free parking. Notwithstanding any other provision contained herein pertaining to timed parking, all parking within the City on public property on special promotion days set aside by the Chamber of Commerce shall be free parking.
(mm) 
Parking lot regulations.
1. 
The maximum speed limit driving on or through a municipal parking lot shall be 10 miles per hour. All traffic patterns shall be one-way in accordance with designated markings or signs.
2. 
All parking in municipal parking lots shall be strictly in accordance with markings designating individual parking stalls. No vehicle shall be parked in such a manner as to encroach upon or over the lines marking such stalls.
3. 
No person shall throw or deposit any type of debris or waste material on any municipal parking lot.
4. 
Notwithstanding any other provision of this Code, no person shall park in a municipal parking lot between the hours of 3:00 a.m. and 6:00 a.m.
(nn) 
Overnight parking regulations. Notwithstanding whatever may be provided in § 4.08(1) and (8), overnight parking shall be provided between the hours of 3:00 a.m. and 9:00 a.m. in the five parking spaces located on the east side of the Community Hall (Parking Lot No. 7), the 11 parking spaces located in Parking Lot No. 3 located on the east side of the 100 block of South Washington Street, and the first six parking spaces located immediately west of South Andrews Street along the north side of Parking Lot No. 8. The fee for said overnight parking shall be as set by Council resolution, which fee may be prorated on a monthly basis, said permits to be issued to be in effect from the first day to last day of the month. The Department of Public Works shall sign each parking space to designate it as permit parking only from 3:00 a.m. to 9:00 a.m. The administration and collection of revenue generated by said overnight parking shall be carried out by the City Clerk. Upon payment of the fee, the Clerk shall issue an identification sticker or card which the operator must display in the car during said parking hours.

(oo) 
Miscellaneous parking restrictions.
1. 
Parking in driveways. No person shall park or leave standing any motor vehicle in any private driveway without the permission of the owner or lessee of the property upon which such driveway is located, whether or not such driveway is posted to limit or restrict parking.
2. 
Parking heavy vehicles in residential districts. No operator of a motor truck, truck-tractor, trailer or semitrailer or any other vehicle or combination of vehicles, other than motorbuses, weighing more than 10,000 pounds shall park such vehicle on any highway other than a routed state trunk highway in any residential district except for such time as is reasonably necessary to facilitate the loading or unloading of the vehicle.
3. 
Night parking restrictions. When signs have been erected at, or reasonably near, the corporate limits as provided in W.S.A. § 349.13, no person, except physicians on emergency calls, shall park any vehicle on any street or alley between the hours of 2:00 a.m. and 6:00 a.m. of any day, except on Saturdays and Sundays the prohibited hours for parking, as set forth above, shall be between 2:30 a.m. and 6:00 a.m., said restrictions to be in effect between December 1 and March 1.

4. 
Parking trailers, campers or motor homes on City streets. No owner or operator of a trailer, camper or motor home shall park such vehicle on any City street in a residential district for more than 48 hours without permission of the Police Department.
5. 
Parking policies and procedures. The parking policies and procedures recommended by the Field Committee and adopted by the Common Council are hereby incorporated by reference so that all of such policies and procedures are incorporated as part of this Code. Any amendments and/or additions which occur after the adoption of this subsection are also adopted by reference.
(pp) 
Parking during snowstorm emergency.
1. 
Emergency declarations. In times of emergency due to excessive snowfall, or when it is deemed advisable in the interest of public safety, the Chief of Police may, in his or her discretion, either through the Police Department or by signs placed or erected, close off streets, portions of streets, divert or regulate traffic and prohibit parking, stopping or unloading as the occasion may require, and all pedestrians and drivers of vehicles shall conform to these regulations. Appropriate signs shall be erected in accordance with W.S.A. s. 349.13(1), which signs shall inform motorists entering the City that the City has in force a snow emergency ordinance.
2. 
Parking regulations during snow emergencies. Whenever an emergency exists and the Director of Public Works shall have caused announcement thereof to be made by the radio stations whose normal operating range covers the City, no person shall park, or suffer to be parked, any vehicle of any kind or description in an area marked by temporary no-parking signs or between the hours of 10:00 p.m. and 6:00 a.m., inclusive, upon any street in the City, provided that, notwithstanding such emergency restrictions, vehicles may be parked for a period of time not longer than three minutes for actually loading or unloading of passengers, or 30 minutes for actually loading or unloading of property, and provided further that no other regulation restricting parking as to place, time or manner is violated thereby.
3. 
Authorization of erection of no-parking signs. Pursuant to the provisions of W.S.A. s. 66.325, the Director of Public Works is authorized to erect temporary no-parking signs during the existence of an emergency created by a snowstorm or excessive snowfall which impairs or prevents the full use of any highway, street or roadway for transportation.
4. 
Snow tow-away zones. The Director of Public Works is hereby authorized to cause the towing away of vehicles parked in violation of this subsection. The owner of said vehicle shall be charged for such towing and shall be subject to prosecution and penalty as provided in §§ 4.16 and 4.17 of this chapter.
(qq) 
Removal of illegally parked vehicles. Any vehicle parked or left standing upon a highway, street or alley or other public grounds in violation of any of the provisions of this section or § 4.01 of this chapter is declared to be a hazard to traffic and public safety. Such vehicle shall be removed by the operator, upon request of any police officer, to a position where parking, stopping or standing is not prohibited. Any police officer, after issuing a citation for illegal parking, stopping or standing of an unattended vehicle in violation of this chapter, is authorized to remove such vehicle to a position where parking is not prohibited. The officer may order a motor carrier holding a permit to perform vehicle towing services, a licensed motor vehicle salvage dealer or a licensed motor vehicle dealer who performs vehicle towing services to remove and store such vehicle in any storage garage or rental parking grounds or any facility of the person providing the towing services. In addition to other penalties provided by § 4.16(4) of this chapter, the owner or operator of a vehicle so removed shall pay the cost of towing and storage.
(rr) 
Registration record of vehicle as evidence. When any vehicle is found upon a street or highway in violation of any provision of this chapter regulating the stopping, standing or parking of vehicles and identity of the operator cannot be determined, the owner, as shown by the ownership registration of the vehicle supplied by the Wisconsin Department of Transportation or a comparable authority of any other state, shall be subject to the appropriate penalty.
(ss) 
Unlawful removal of parking citations. No person other than the owner or operator thereof shall remove a City parking ticket from a motor vehicle.
(tt) 
Number of parking lots. The municipal parking lots shall be numbered and referred to as follows:
1. 
Parking Lot No. 1: the municipal parking lot located on the 100 block of West Fifth Street described as follows: commencing at the southeast right-of-way corner of West Fifth Street and North Washington Street intersection, which is the point of beginning; thence easterly 116 feet along the south right-of-way line of West Fifth Street; thence south 163 feet along the west line of the City alley; thence westerly 119 feet; thence north 163 feet along the east right-of-way line of North Washington Street to the point of beginning.
2. 
Parking Lot No. 2: the municipal parking lot located on the 100 block of South Washington Street described as follows: commencing at the southeast right-of-way corner of West Green Bay Street and South Washington Street intersection, which is the point of beginning; thence east 90 feet along the south right-of-way line of West Green Bay Street; thence south 210 feet along the west line of the City alley; thence west 98 feet; thence northerly 211 feet along the east right-of-way line of South Washington Street to the point of beginning.
3. 
Parking Lot No. 3: the municipal parking lot located on the 100 block of South Washington Street described as follows: commencing at the southeast right-of-way corner of West Green Bay Street and South Washington Street intersection; thence southerly 237 feet along the east right-of-way line of South Washington Street to the point of beginning; thence east 102 feet; thence south 168 feet along the west line of the City alley; thence west 105 feet; thence northerly 169 feet along the east right-of-way line of South Washington Street to the point of beginning.

(1) 
Abandonment of vehicles prohibited. No person shall abandon any vehicle unattended within the City for such time and under such circumstances as to cause the vehicle to reasonably appear to be abandoned.
(2) 
Definition. As used in this section, "vehicle" means a motor vehicle, trailer, semitrailer or mobile home as defined in § 4.01 of this chapter, whether or not such vehicle is registered under W.S.A. Ch. 341.
(3) 
Presumption of abandonment. Any vehicle left unattended for more than 24 hours on any public street or grounds, or on private property where parking is prohibited, limited or restricted, without the permission of the owner or lessee, is deemed abandoned and constitutes a public nuisance; provided that the vehicle shall not be deemed abandoned under this section if left unattended on private property out of public view by permission of the owner or lessee.
(4) 
Exceptions. This section shall not apply to a vehicle in an enclosed building, a vehicle in an appropriate storage place or depository maintained in a lawful place and manner authorized by the City or a vehicle parked in a paid lot or parking space where the required fee has been paid and meter activated.
(5) 
Removal and impoundment or sale. Any vehicle found abandoned in violation of this chapter shall be impounded by the Police Department until lawfully claimed or disposed of as provided in this section. If the Chief of Police or his or her duly authorized representative determines that towing costs and storage charges for 10 days, as provided in Subsection (6) below, would exceed the value of the vehicle, the vehicle may be junked or sold prior to the expiration of the impoundment period upon determination by the Chief that the vehicle is not wanted for evidence or any other reason; provided that vehicles in excess of 19 model years of age shall be sold or disposed of only by auction sale or sealed bid in accordance with Subsection (8) below.
(6) 
Minimum impoundment period. The minimum period of impoundment or storage of a vehicle found in violation of this section shall be 10 days.
(6a) 
Storage of abandoned motor vehicles.

(a) 
Within 10 days after the impoundment of a motor vehicle, or within 10 days after the commencement of the storage of a motor vehicle, the Department shall give written notice to the owner, secured parties of record and known lienholders, if any, within the time required by law, advising of:
1. 
The complete description of the vehicle and the date and place the vehicle was found or taken into possession.
2. 
The approximate amount owed for the cost of towing and storage.
3. 
The location of the storage of the vehicle.
4. 
The time and place that the sale of the vehicle will be held.
5. 
The right of the owner, secured parties and lienholders to contest the right to sell such vehicle by the Department.
(b) 
The notice required by this section shall be deemed to be given when sent by certified mail, postage prepaid, to the last known address of the owner, secured party of record and known lienholder shown on any public filing evidencing such ownership, security interest or lien, or, if none, to any such address ascertained by reasonable effort. The Department shall be allowed to charge a storage fee as set by Council resolution for the storage of such vehicle at the Police Department or at any other location chosen by said Department.

(7) 
Notice to owner. The police officer removing or causing the removal of any vehicle found in violation of this section shall immediately notify the Chief of Police of the abandonment and location of the impounded vehicle and shall, within 10 days thereafter, notify the owner and lienholders of record, by certified mail, of the impoundment and of their right to reclaim the vehicle. The notice shall set forth the information contained in W.S.A. s. 342.40(3) and shall state that the failure of the owner or lienholders to exercise their right to reclaim the vehicle shall be deemed a waiver of all right, title and interest in the vehicle and a consent to sale of the vehicle.
(8) 
Sale. Each retained vehicle not reclaimed by the owner or lienholder may be disposed of by sealed bid or auction sale as provided in W.S.A. s. 342.40(3).
(9) 
Sale to bar claims against vehicle. The sale of a motor vehicle under the provisions of this section shall forever bar all prior claims thereto and interest therein except as hereinafter provided.
(10) 
Purchaser to remove vehicle. The purchaser of any vehicle on sealed bid or auction sale under Subsection (8) above shall have 10 days to remove the vehicle from the storage area upon payment of a storage fee as set by Council resolution for each day the vehicle has remained in storage after the second business day subsequent to the sale date. Ten days after the sale, the purchaser shall forfeit all interest in the vehicle and the vehicle shall be deemed to be abandoned and may be again sold.

(11) 
Request for list. Any listing of vehicles to be sold pursuant to this section shall be made available by the Clerk-Treasurer to any interested person or organization who makes a written request therefor for a fee as set by Council resolution.

(12) 
Notice to Department. Within five days after sale or disposition of a vehicle under this section, the Police Chief shall advise the Wisconsin Department of Transportation of such sale or disposition on a form supplied by the Department.

(13) 
Owner may file. At any time within two years after the sale of a motor vehicle as provided herein, any person claiming ownership of such motor vehicle or a financial interest therein may present a claim to the Council setting forth such facts as are necessary to establish such ownership or interest and that the failure of the claimant to reclaim the vehicle prior to sale was not the result of the neglect or fault of claimant. If the Council is satisfied as to the justice of such claim, it may allow the same, but in no case shall the amount allowed exceed the sum paid into the City Treasury as the result of the sale of such motor vehicle, nor the amount of interest of the claimant therein.
(14) 
Exemption.
(a) 
Any owner or person operating a registered vehicle which shall become disabled or inoperative for any reason and who shall be unable to cause removal of such vehicle from any alley, street, highway or public place not otherwise regulated as a restricted parking, stopping or standing zone shall, within 12 hours of such occurrence, notify the Police Department of the location of the vehicle and shall transfer and deliver clear title for said vehicle to the City together with a fee as set by Council resolution and shall be exempt from the provisions of this section.

(b) 
When so requested by the owner or person in charge of a vehicle, the Chief of Police shall be authorized to order such vehicle removed and junked directly from the scene of disablement by the Department of Public Works or contractor engaged by the City for towing of disabled vehicles. The provisions of Subsection (11) shall apply to any vehicle removed under this subsection.
(15) 
Use of citation. Notwithstanding whatever may be provided for above, the operator may be given a thirty-day warning to remove the abandoned vehicle(s), and upon failure to do so, the owner of such vehicle or the property upon which said vehicle is located may be given a citation for a violation of this subsection. Said citation shall provide for a forfeiture of not less than $100 nor more than $1,000 and shall be imposed upon conviction, plus the cost of prosecution. Each day a violation exists or continues shall be a separate offense.

(1) 
Operators to file. The operator of any vehicle involved in an accident resulting in injury to, or death of, any person, or property damage to an apparent total extent of $500 or more by any one person, shall, immediately by the quickest means of communication, give notice of such accident to the Police Department as required by W.S.A. s. 346.70(1).

School bus operators may use flashing red warning lights in residential and business districts when pupils or other authorized passengers are to be loaded or unloaded at locations at which there are not traffic signals and such persons must cross the street or highway before being loaded or after being unloaded.

Pursuant to the provisions of W.S.A. s. 118.105, the following regulations shall apply to the grounds of the Shawano School District located within the City:
(1) 
Parking. All parking on grounds of the Shawano School District from 7:30 a.m. to 4:30 p.m. shall be by permit only and shall be restricted to areas designated for parking by the School Board. When signs are erected by the School Board giving notice of such restrictions, no person shall park a motor vehicle in an area other than one for which he or she shall have been issued a permit nor without displaying a valid permit. All authorized visitors shall park only in areas designated and signed for visitor parking.
(2) 
Speed limits. No person shall at any time operate a motor vehicle upon the Shawano School District grounds at a speed in excess of 10 miles per hour.
(3) 
Vehicles prohibited at specified times. No person shall at any time operate a motor vehicle, other than a school bus, in or upon any drive designated for buses only by sign during the hours of 7:30 a.m. to 9:00 a.m. and during the hours of 3:00 p.m. to 4:30 p.m. on any weekday during the months school is in session.
(1) 
Unlicensed operators prohibited. No person who does not hold a valid operator's license shall operate a vehicle in any public parking lot or in any private parking lot held out for the use of parking for the general public.
(2) 
Traffic regulations applicable. All provisions of § 4.01 of this chapter and of the Wisconsin Statutes and laws incorporated herein by reference shall be applicable on any public parking lot and on any private parking lot held out for use of the general public for parking or vehicular travel.

(1) 
Intent. It is deemed advisable that vehicular and pedestrian traffic on airport premises owned and operated by the Shawano Airport should be regulated to ensure the safety of aircraft, aircraft passengers and the general public.
(2) 
Definitions. As used in this section, the following terms shall have the meanings indicated:
EMERGENCY EQUIPMENT
Crash, fire and rescue, or police motor vehicles, and such other equipment as the Airport Manager may designate as necessary to safeguard airport runways, taxiways, ramps, buildings and other property.
PEDESTRIAN
Any person afoot.
SERVICE, MAINTENANCE AND CONSTRUCTION EQUIPMENT
Approved equipment normally operated by the Airport Manager, the Fixed Base Operator and/or the Federal Aviation Administration on landing areas, runways, taxiways and peripheral roads for the servicing, maintenance and construction of airport facilities and services or for the servicing of aircraft. This definition shall include equipment owned and operated by a contractor performing work on the airport under a contractual agreement with the Shawano Airport.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn, excepting aircraft.
(3) 
Operation of vehicles on runways, taxiways and ramps. No vehicle shall enter, be driven upon or operated upon any airport runway, taxiway, ramp, tie-down area or any area posted by signs prohibiting the entrance thereon. The provisions of this section shall not apply to emergency equipment or service, maintenance and construction equipment when engaged in performing normal duties. Aircraft owners may be granted authorization by the Airport Manager or his or her designated representative to operate a vehicle to reach their own aircraft in a tie-down area. Aircraft owners desiring to operate a vehicle for this purpose shall request such authorization in advance. Any authorization granted shall apply to a specific need request. Blanket-type authorizations shall not be granted. Unless specifically authorized, aircraft owners shall not pass over any runway, taxiway or ramp and shall proceed through said tie-down area at a speed not to exceed 10 miles per hour. They shall not at any time park a vehicle on any area used for the movement of aircraft.
(4) 
Speed of vehicles. No vehicle shall be driven upon any road within the perimeter of the airport or upon other airport areas in excess of the speed limit posted, nor shall the driver of any vehicle fail to adhere to any sign posted to regulate vehicle traffic on or about the Shawano Airport.
(5) 
Pedestrian traffic on airport. No pedestrian shall be allowed beyond the administration area or upon the apron or aircraft tie-down area unless for the purpose of embarking in or disembarking from an aircraft, or unless authorized by the Airport Manager. Pedestrian traffic is prohibited on taxiways, runways and outlying areas of the airport except for those employees of the City, county, state or federal governments, or contractors engaged in airport construction or maintenance work.
(6) 
Vehicle parking. All vehicles parked on the airport shall be parked in designated areas and in accordance with posted signs or other markings. The Airport Manager may move, or order the removal of, any vehicle improperly parked at the vehicle owner's expense. Fines or forfeitures may be levied in accordance with § 4.16 of this chapter.
(7) 
Enforcement. It shall be the duty of the Sheriff of Shawano County to enforce the provisions of this section.

(1) 
State laws adopted. Except as otherwise specifically provided, the provisions of Chapters NR 45 (State Parks and State Forests), NR 50 (Administration of Outdoor Recreation Grants and State Aids), and the provisions of W.S.A. s. 27.01, are hereby adopted by reference, exclusive of any provisions therein relating to penalties to be imposed and exclusive of any regulations for which a statutory penalty is a fine or term of imprisonment are hereby adopted and by reference made a part of this section as if fully set forth herein. Any future amendments, revisions, modifications or renumbering of said statutes or rules incorporated herein are intended to be made a part of this section.
(2) 
Regulations. The regulations set forth in Shawano County Ordinance No. 04-07, exclusive of any provisions therein relating to penalties to be imposed, are hereby adopted by reference as if fully set forth herein.
(3) 
City of Shawano all-terrain/utility terrain vehicle use.
(a) 
Purpose. The purpose of this section is to establish all-terrain and utility terrain vehicle routes in the City of Shawano and to regulate the operation of all-terrain and utility terrain vehicles in the City of Shawano.
(b) 
Definitions. For this section, the following definitions shall be used. Words used in the present tense include the future; the singular number includes the plural number; and the plural number includes the singular number. The words "shall," "will," and "must" are always mandatory. The words "may" and "should" are discretionary terms. The masculine shall include the feminine. Terms not defined in this section shall be interpreted based on common usage.
ALL-TERRAIN VEHICLE (ATV)
A commercially designed and manufactured motor driven device that has a weight, without fluids, of 900 pounds or less, has a width of 50 inches or less, is equipped with a seat designed to be straddled by the operator, and travels on 3 or more tires.
CITY
The City of Shawano, the City Council, Common Council, or any other City of Shawano official(s) or agent authorized by the City Council to act on behalf of the City of Shawano.
UTILITY TERRAIN VEHICLE (UTV)
Any of the following:
1. 
A commercially designed and manufactured motor driven device that does not meet federal motor vehicle safety standards in effect on July 1, 2012, that is not a golf cart-low-speed vehicle, dune buggy mini-truck, or tracked vehicle, that is designed to be used primarily off a highway, and that has, and was originally manufactured with, all the following:
a. 
A weight, without fluids, of 2,000 pounds or less.
b. 
Four or more tires.
c. 
A steering wheel.
d. 
A taillight(s).
e. 
A brake light(s).
f. 
Two headlights.
g. 
A width of not more than 65 inches.
h. 
A system of seat belts, or a similar system, for restraining each occupant of the device in the event of an accident.
i. 
A system of structural members designed to reduce the likelihood that an occupant would be crushed as the result of a rollover of the device.
2. 
A commercially designed and manufactured motor driven device to which all of the following applies:
a. 
It has a weight, without fluids, of more than 900 pounds but not more than 2,000 pounds.
b. 
It has a width of 50 inches or less.
c. 
It is equipped with a seat designed to be straddled by the operator.
d. 
It travels on three or more tires.
(c) 
Designation of all-terrain and utility terrain vehicle routes. Pursuant to s. 23.33(4)(d)4., Wis. Stats., except as otherwise provided in s. 23.33(4), Wis. Stats., persons may operate an all-terrain or utility terrain vehicle on any road, freeway, or highway in the City, except:
E. Green Bay St. from Main St. East to City limits.
N. Main St. from Third St. to Green Bay St.
S. Main St. from Green Bay St. South to City limits.
1. 
The route(s) does not include public properties, cemeteries, City-owned parks, school district property, etc., except for those with designated parking areas where motorized vehicles normally park. Permission of any other public entity or private landowner is the obligation of any ATV/UTV user. Any use in a park must be on paved areas regularly used by motor vehicles. Use on the Shawano Municipal Airport property is restricted to use allowed by federal law and no use may be had of ATV/UTVs on the runway except as part of aviation operations.
2. 
The routes do not include private roads or driveways nor any private property in the City. The City or Chief of Police shall retain the right to close any City street to ATV/UTV operation for special events or street construction/repair without notice.
(d) 
Preferred routes. A preferred route shall be marked by the City, as set forth in a map as attached to this section.[1]

(e) 
Signage. Routes shall be marked with uniform all-terrain and utility terrain vehicle route signs in accordance with s. NR 64.12 (7), Wisconsin Administrative Code. Further, no person may do any of the following regarding signs marking City ATV/UTV routes unless authorized to do so.
1. 
Intentionally remove, damage, deface, move, or obstruct any uniform all-terrain and utility vehicle route or trail sign or standard or intentionally interfere with the effective operation of any uniform ATV/UTV route or trail sign or standards if the sign or standard is legally placed by the state, any municipality, or any authorized individual.
2. 
Possess any uniform ATV/UTV route or trail sign or standard of the type established by the City for the warning, instruction, or information of the public, unless he or she obtained the uniform ATV/UTV route or trail sign or standard in a lawful manner. Possession of a uniform all-terrain and utility terrain vehicle route or trail sign or standard creates a rebuttable presumption of illegal possession.
(f) 
Maintenance of all-terrain and utility terrain vehicle routes.
1. 
Designation of segments of the City road system as ATV/UTV routes does not impose upon the City a greater duty of care or responsibility for maintenance of those segments than for any other segment of City road.
2. 
Operators of ATV/UTVs on City roads assume all the usual and normal risks of ATV/UTV operation.
3. 
The City accepts no liability for the operation of ATVs/UTVs on any City streets under the provisions of this section.
(g) 
Operation of all-terrain and utility vehicles.
1. 
Operation shall be subject to all provisions of s. 23.33, Wis. Stats., which is adopted as a part of this section by reference, pursuant to s. 23.33(11), Wis. Stats.
2. 
Operators must abide by all traffic laws set forth under Chapter 346 of the Wisconsin Statutes, notwithstanding the provisions of § 346.02(11) and any additional restrictions of this section.
3. 
The speed limit for ATVs and UTVs shall be established at not greater than 35 miles per hour or the speed limit for automobiles, whichever is lower, on all segments of City roads designated as ATV/UTV routes. The speed limit for ATVs and UTVs shall not be greater than 20 miles per hour on all nonpreferred routes as referenced in Subsection (3)(d) above.
4. 
ATVs/UTVs may be operated on paved surfaces only, unless yielding the right of way.
5. 
All ATV/UTV operators shall ride single file.
6. 
No ATV/UTV may be operated on any designated route(s) without fully functional headlights (turned on), taillights, and brake lights.
7. 
An ATV/UTV may not be operated within the city limits, other than for snow removal, between the hours of midnight and 6:00 a.m.
8. 
All ATV/UTV operators shall ride on the right-hand side of the paved portion of the highway, unless making a left turn. Operation on the gravel shoulders, grassy in-slope, ditches, or other highway right-of-way is prohibited, unless yielding right of way.
9. 
No ATV/UTV may be operated on any designated ATV/UTV route if the ATV/UTV does not meet all applicable federal noise and air pollution standards.
10. 
No person under the age of 18 may operate an ATV/UTV on any designated route unless wearing approved protective head gear.
11. 
No person may operate an ATV/UTV with a passenger if the vehicle is not intended or designed for carrying a passenger.
(h) 
Disturbing of the peace, and nuisance activities.
1. 
Cruising prohibited. No person shall, while operating an ATV or UTV, engage in the practice of cruising on any authorized road. Cruising is defined as running all or part of the length of a roadway multiple times per day, back and forth.
2. 
Exhaust system/muffler modifications prohibited. No person shall operate on a City route any ATV/UTV unless such ATV/UTV is equipped with an adequate muffler in constant operation and properly maintained to prevent any excessive or unusual noise or annoying smoke.
3. 
Radios or the electric sound amplification devices: No person may operate or park, stop or leave standing an ATV/UTV vehicle while using a radio or other electric sound amplification device emitting sound from the vehicle that is audible under normal conditions from 75 feet or more, unless the electric sound amplification device is being used to request assistance or warn against an unsafe condition.
4. 
Use of trailers or sleds prohibited. No person shall operate an ATV/UTV upon any street within the City with any person, trailer or sled attached or trailing said vehicle, unless it is designed for such activities. Anyone operating such conveyance in an unsafe or reckless manner shall be deemed in violation of this section.
5. 
For purposes of §§ 4.11 (Display of power) and 8.03(3) (Disorderly conduct with a motor vehicle) of the City of Shawano ordinances, an ATV or UTV as defined in Subsection (3)(b) above, is a motor vehicle, and those ordinances specifically apply to the operation of ATVs and UTVs.
(4) 
Enforcement.
(a) 
This section may be enforced by any law enforcement officer authorized to enforce the laws of the state of Wisconsin. A copy of this section shall be sent by the City Clerk to the Shawano Police Department, the Shawano County Sheriff's Department, and the Department of Natural Resources, and any other law enforcement agency serving the City of Shawano's jurisdiction.
(b) 
As a substitute for or in addition to forfeiture actions, the City Attorney may, on behalf of the City, seek enforcement of any and all parts of this section by court actions seeking injunction orders or restraining orders and/or pursuing nuisance actions against the violator.
(5) 
Penalties. The penalties under s. 23.33(13)(a), Wis. Stats., are adopted by reference. Any person who shall violate this section shall pay a forfeiture plus costs established in § 20.04 of the Shawano Municipal Code.
(6) 
Severability. Should any portion of this section be declared unconstitutional or invalid by a court of competent jurisdiction, the remainder of this section shall not be affected.

(2) 
Applicability of rules of the road to snowmobiles. The operator of a snowmobile upon a roadway shall, in addition to the provisions of W.S.A. Ch. 350, be subject to W.S.A. ss. 346.04, 346.06, 346.11, 346.14(1), 346.18, 346.19, 346.20, 346.21, 346.26, 346.27, 346.33, 346-35, 346.37, 346.39, 346.40, 346.44, 346.46, 346.47, 346.48, 346.50(1)(b), 346.51, 346.52, 346.53, 346.54, 346.55, 346.87, 346.88, 346.89, 346.90, 346.91, 346.92(1), and 346.94(1), (6), (6m) and (9).
(3) 
Snowmobile operation in City restricted.

(a) 
It shall be unlawful to operate any snowmobile or any other motor-driven craft or vehicle principally manufactured for off-highway use on the City streets, alleys, parks, parking lots or on any public lands or private lands or parking lots held open to the public. The operator shall at all times have the consent of the owner before operation of such craft or vehicle on private lands.
(b) 
The only exceptions to the above are as follows:
1. 
A person may operate a snowmobile from a residence or a lodging establishment within the City limits for the shortest distance that is necessary for a person to operate a snowmobile from such location to an established public snowmobile trail that is designated as "open" for snowmobile use that is closest to that residence or lodging establishment. It shall be that person's responsibility to determine the shortest route.
2. 
No person shall operate a snowmobile between the hours of 11:00 p.m. and 7:00 a.m.
3. 
A person shall operate a snowmobile pursuant to the provisions of this subsection and with the limitations stated herein on the portion of the highway that is normally used for motor vehicle travel, and the area of operation shall not include the right-of-way located outside of the traveled portion of the roadway.
4. 
All snowmobile operators shall operate the snowmobile on the right-hand side of the road and must obey all posted speed limit and traffic control signs/signals and shall comply with all provisions of Wisconsin Law. No snowmobile may be operated on any City street nor trail located within the City without being properly registered to operate a snowmobile on a public snowmobile trail. All snowmobiles must be in proper working order and proper operating condition pursuant to Department of Natural Resources (DNR) requirements for an operation of a snowmobile on a public trail system.
5. 
No snowmobile shall be operated in or upon any City parks, cemeteries, or alleyways.
6. 
No snowmobile shall be operated with a noise which is excessive or not allowed by DNR requirements or other state law provisions.
7. 
All operators of snowmobiles must comply with all provisions of Wisconsin law and the Wisconsin Administrative Code, as those provisions apply to snowmobile operation.
8. 
No person shall operate a snowmobile within the City pursuant to the provisions of this subsection from May 1 through November 14 of any year.
9. 
This subsection shall be enforced by any law enforcement officer of the City of Shawano, Shawano County, Wisconsin.
(4) 
Permitting operation by improper persons prohibited. No owner or person having charge or control of a snowmobile shall authorize or permit any person to operate such snowmobile who is not permitted under state law to operate such snowmobile or who is under the influence of an intoxicant or a dangerous or narcotic drug.
(5) 
Operation while under influence prohibited. W.S.A. s. 346.63 shall apply to the operation of a snowmobile any place within the City.
(6) 
Written consent of owner required. The consent required under W.S.A. s. 350.10(1)(f), (k), (L) and (m) and in Subsection (3) shall be written consent dated and limited to the year in which the consent is given. If the property is owned or leased by more than one person, the consent of each must be obtained.

(1) 
Forfeiture penalty. The penalty for violation of any provision of this chapter shall be a forfeiture as hereinafter provided together with the costs of prosecution and the penalty assessment imposed by W.S.A. s. 165.87(2), where applicable, and as provided for in § 20.04(5). Payment of the judgment may be suspended by the sentencing judge for not more than 60 days. Any person who shall fail to pay the amount of the forfeiture, costs of prosecution and penalty imposed for violation of any provision of this chapter may, upon order of the court entering judgment therefor and having jurisdiction of the case, be imprisoned until such forfeiture, costs and assessment are paid, but not exceeding 90 days.
(2) 
Other sanctions. Nothing herein shall preclude or affect the power of the sentencing court to exercise additional authorities granted by the Wisconsin Statutes to suspend or revoke the operating privileges of the defendant or to order the defendant to submit to assessment and rehabilitation or attend traffic safety school in addition to payment of a monetary penalty or in lieu of imprisonment.
(3) 
Forfeitures for uniform traffic offenses. Forfeitures for violations of any traffic regulation set forth in the Wisconsin Statutes adopted by reference in § 4.01 of this chapter shall conform to the forfeiture penalty permitted to be imposed for violations of the comparable state statute, including any variations or increases for subsequent offenses; provided, however, that this subsection shall not permit prosecution under this chapter of any offense for which an imprisonment penalty may be imposed upon the defendant.
(4) 
Forfeitures for parking violations.

(a) 
Forfeitures for uniform statewide parking, stopping and standing offenses. Forfeitures for uniform statewide parking, stopping and standing offenses shall be as provided for in § 20.04(5) of this Code.
(b) 
Overtime parking.

General. The forfeiture for violations of the provisions of § 4.08(1), for limited time parking, of this chapter shall be a penalty of $20. Each hour during which a violation occurs shall be considered a separate offense. If the penalty is not paid within 10 days, the penalty shall be doubled.

2. 
Forfeitures relative to parking violations. The provisions of W.S.A. s. 345.28, relating to the issuance of summons for nonmoving traffic violations and all enforcement procedures set forth in said section, are hereby incorporated by reference. The "local authority" referred to in said section is hereby designated to be the City Police Department.
3. 
Enforcement of unpaid judgment. The provisions of W.S.A. s. 345.47(1)(d), relating to unpaid court judgments for traffic offenses and the enforcement procedures set forth in said section, are hereby incorporated by reference.
(c) 
Penalty for other parking violations. The penalty for all other parking violations not included under Subsection (4)(a) or (b) shall be a forfeiture of $20. If the penalty is not paid within 10 days, the penalty shall be doubled.

(5) 
Other violations. Any person who shall violate any provision of this chapter for which a penalty is not established by Subsection (1) of this section shall be subject to a forfeiture of not less than $10 nor more than $100, plus the cost of prosecution.

(6) 
Penalty for violating W.S.A. ss. 346.77 to 346.804 and 347.489.

(a) 
Any person violating W.S.A. ss. 346.77, 346.79(1), (2) and (3) or 346.80 to 346.804 may be required to forfeit not more than $20. Any juvenile 12 years of age or over may be prosecuted for any violation of this section pursuant to W.S.A. ss. 938.17(2), 938.237, 938.343, 938.344 and 938.37.

(b) 
Any person violating W.S.A. s. 346.78 or 346.79(4) may be required to forfeit not less than $10 nor more than $20 for the first offense and not less than $25 nor more than $50 for the second or subsequent conviction within one year. Any juvenile 12 years of age or over may be prosecuted for any violation of this section pursuant to W.S.A. ss. 938.17(2), 938.237, 938.343, 938.344 and 938.37.

(c) 
Any person violating W.S.A. s. 347.489(1) may be required to forfeit not less than $10 nor more than $200. Any minor 14 years of age or over may be prosecuted for any violation of this section pursuant to W.S.A. ss. 938.17(2), 938.237, 938.343, 938.344 and 938.37.

This chapter shall be enforced in accordance with the applicable provisions of the Wisconsin Statutes and this section.
(1) 
Applicable court procedures. Except as otherwise specifically provided by the laws of the State of Wisconsin or the provisions of this chapter, the traffic regulations in this chapter shall be enforced in the Circuit Court of Shawano County or the Shawano-Bonduel Joint Municipal Court in accordance with the provisions of W.S.A. ss. 66.12,[1] 346.20(2)(a), W.S.A. Ch. 799 and W.S.A. Ch. 800.

(2) 
Citations.
(a) 
Uniform citation and complaint. The Wisconsin Uniform Traffic Citation and Complaint described and defined in the Wisconsin Statutes shall be used for enforcement of all provisions of this chapter except those provisions which describe or define nonmoving traffic violations and violations of W.S.A. ss. 346.71 through 346.73. Violations of W.S.A. ss. 346.71 through 346.73 shall be reported to the District Attorney, and the Wisconsin Uniform Traffic Citation shall not be used in such cases except upon written request of the District Attorney.
(b) 
Parking citations. The City Attorney shall recommend a citation for use in enforcing the nonmoving traffic offenses in this chapter. When approved by the Council, such citation shall be used for enforcement of nonmoving traffic regulations created or adopted by this chapter, including violations of nonmoving traffic regulations defined and described in the Wisconsin Statutes, adopted by reference in § 4.01 of this chapter and all provisions of §§ 4.08 and 4.09 of this chapter. The citation for nonmoving traffic violations shall contain a notice that the person cited may discharge the forfeiture for violation of a nonmoving traffic regulation and penalty thereof by complying with Subsection (3)(b) of this section. Nonmoving traffic citations may be issued by law enforcement officers or by civilian employees of the Police Department.
(c) 
Pursuant to W.S.A. s. 66.119(1)(a), as amended by 1987 Wisconsin Act 389, the Council hereby adopts and authorizes the use of a municipal citation to be issued for violations of ordinances, including ordinances for which a statutory counterpart exists.

(3) 
Deposits and stipulations.
(a) 
Uniform traffic offenses.
1. 
Who may make. Persons arrested or cited for violation of moving traffic offenses created by this chapter shall be permitted to make deposits and stipulations of no contest or released by the arresting officer in accordance with the applicable provisions of the Wisconsin Statutes.
2. 
Delivery or mailing of deposit and stipulation. The deposit and stipulation shall be delivered personally by the person cited or mailed to Police Department headquarters.
3. 
Receipt required. The official or person receiving the deposit shall furnish and deliver or mail an original receipt for such deposit to the alleged violator and shall deliver the deposit and stipulation and a copy of the receipt within three days to the Clerk of Courts.
(b) 
Nonmoving traffic offenses.

Deposits returned to Clerk-Treasurer. Police personnel receiving deposits for nonmoving traffic violations under this subsection shall pay over such deposits to the Chief of Police. At the end of each month, the Chief of Police shall pay over such deposits to the Clerk-Treasurer. Such payment shall be accompanied by an itemized statement for each deposit.
(1) 
Statutes specifically incorporated by reference. Whenever this chapter incorporates by reference specific sections of the Wisconsin Statutes, such references shall mean the Wisconsin Statutes of 1979 as from time to time amended, repealed or modified by the Wisconsin Legislature.
(2) 
General references. General references in this chapter to Wisconsin statutory sections or chapters describing or defining procedures or authority for enactment or enforcement of local traffic regulations shall be deemed to refer to the most recent enactments of the Wisconsin Legislature describing or defining such procedures or authorities.
