A.
Each applicant appointed to fill a merit position or a full-time grant-funded position is automatically placed in a probationary status for six months, unless a longer probationary period has been established. Probationary employees will be assessed on or before the expiration date of the probationary period. The employee's performance during the probationary period will be considered in determining whether the employee will be retained, given an extension of probation or dismissed. An employee who has successfully completed his or her probationary period shall be given merit status and not dismissed from the Town's service except for cause. The employee will be credited with annual and personal leave earned during the first six-month probationary period in Town service.
B.
If the employee has been absent from work during the probationary period, the department head may extend the probationary period unless the department head wishes to dismiss the employee in accordance with other sections of this Division A.
C.
Upon successful completion of an extended probationary period, the employee will be granted a merit increase effective the beginning of the next pay period, if he or she missed a merit increase due to the extension.
D.
Individuals hired to fill full-time, grant-funded positions will also be required to serve a probationary period as described in this section. The employee's performance during the probationary period will be considered in determining whether the employee will be retained subject to the availability of funds, will be given an extension of probation, or dismissed.
A.
Under the following conditions, merit or full-time grant employees shall be required to serve a probationary period in accordance with the probationary period upon initial employment provisions in § 50-25:
(1)
Competitive promotion;
(2)
Noncompetitive promotion from a classification designated as probationary or trainee to the next higher level in the classification series, unless waived by the department head and Mayor based on insubstantial changes in duties and responsibility;
(3)
Demotion, unless waived by the receiving department head and Mayor based upon either the circumstances surrounding the action or an insubstantial change in duties and responsibility level; or
(4)
Voluntary transfer to a different job title, unless waived by the receiving department head and Mayor based upon an insubstantial change in duties and responsibility level.
B.
Upon a reclassification or an involuntary transfer, employees shall not be required to serve an additional probationary period.
C.
Part-time Town employees selected for full-time positions shall generally be required to serve a probationary period. This may be waived by the receiving department head and Mayor when the employee is selected for a position of the same title or when the hours of the position are expanded to full-time.
A.
Employees serving an initial probationary period and temporary, casual, seasonal, part-time and part-time grant employees may be disciplined up to and including immediate dismissal at the discretion of their department head or the Mayor. This determination shall be final and not subject to grievance or review.
B.
The department head or Mayor shall have sole discretion to determine whether a probationary employee dismissed from the service of the Town shall receive any prior notice, but in no event shall any such prior notice exceed two weeks.
[Amended 10-18-2007 by Ord. No. O-07-8]
A.
Except for restrictions upon the use of annual and personal leave, any restrictions on participation in the plans authorized by § 50-61, the inability to use the grievance procedures, and as otherwise expressly limited or excluded by this Personnel Ordinance, a probationary employee shall enjoy all other fringe benefits of an employee in the Town's service.
B.
While in a probationary period upon initial employment, no employee shall be entitled to a salary raise other than an increase resulting from adjustments to the pay plan.
A.
An employee serving a new probationary period upon status change will be assigned a new evaluation date for pay and evaluation purposes and will not be granted a merit increase until successful completion of the probationary period. A merit increase will then be granted using the same procedures as stated under the merit increase provisions of this Division A.[1] The employee will be entitled to request the use of accrued leave during the probationary period once the employee completes six months of service with the Town as a benefit employee.
