Any employee wishing to resign in good standing is required
to inform the Mayor and, if applicable, the employee's department
head in writing at least two weeks prior to the anticipated date.
Any employee who leaves Town employment, unless otherwise specified
in an employment contract, without giving the required notice shall
have the fact entered upon his or her record. The department head
shall immediately report the resignation and known attending circumstances
to the Mayor.
Any employee who is absent from duty without leave for three
consecutive business days without notifying the employee's immediate
supervisor of the reasons for absence shall be considered to have
constructively resigned by abandonment of position. An employee who
requests restoration within two weeks after being considered to have
resigned shall provide the Mayor a written explanation of the absence.
If the explanation is determined to provide a justification, the Mayor
may restore the employee to his original position.
Employees who violate work rules or fail to meet standards shall
be subject to disciplinary action up to and including dismissal in
accordance with the disciplinary action provisions of this Division
A.
Whenever a position is to be abolished, discontinued, or vacated
because of a change in departmental organization, funding, stoppage,
lack of work, or material changes in duties, the Mayor or department
head shall determine who is to be subject to the layoff on the basis
of seniority if more than one position exists within a certain class,
unless a particular position is deemed by the Mayor to be critical
to the continuity of the Town services.
Each employee, regardless of how termination occurs, must ensure
that any Town property is returned, and money owed the Town is paid
or the value of any unreturned property or money owed will be deducted
from the final pay or otherwise recovered. The employee must make
arrangements for the receipt of a final paycheck, and provide the
address to which he or she wishes his or her W-2 form to be mailed.
