It shall be unlawful to own, harbor or keep in custody any dog
or other animal which disturbs the peace by barking, howling or making
other loud noises to the annoyance and discomfort of any person in
the Borough of Penndel. Continuous barking, howling or the making
of other loud noises by such dog or other animal for more than any
one hour or continuous barking for periods of less than one hour but
more than 1/2 hour, which periods occur on two or more consecutive
days, shall be deemed to disturb the peace to the annoyance and discomfort
of all persons in the Borough of Penndel. Each day that such conduct
of the animal continues shall constitute a separate offense.

It shall be the duty of every citizen or inhabitant of the Borough
of Penndel who is the owner of any dog or at whose house or premises
any dog is harbored or kept to confine and secure such dog. Hereafter,
it shall be unlawful for the owner of any dog or dogs or person at
whose house or premises any dog is harbored or kept, licensed or unlicensed,
to permit such dog to run at large, unaccompanied by the owner or
person keeping said dog in the Borough of Penndel. The owner or person
keeping such dog shall be considered as accompanying the dog only
if such dog is on a leash.

Any person, firm or corporation who shall violate any provision
of this article shall, upon conviction thereof, be subject to a fine
of not more than $1,000 or imprisonment for a term not to exceed 30
days, or both, at the discretion of the court. Each day that a violation
continues after due notice has been served, in accordance with the
terms and provisions hereof, shall be deemed a separate offense.
The Borough Council may appoint a poundkeeper and determine
and regulate the compensation to be paid to him. It shall be the duty
of said poundkeeper to take up and impound any dog which does not
bear a state license tag and a plate showing its owner's name
and address and any other dog running at large without the owner being
present.

For the purpose of this article, the following words shall have
the following meanings:
Any domestic pet, including, but not limited to, dogs and
cats or any domesticated wild animals kept as pets, including, but
not limited to, raccoons, skunks, ferrets and like creatures.
A person having possession, custody or control of any animal
shall not permit such animal to defecate or urinate:

Upon any gutter, street, driveway, alley, curb or sidewalk in the
Borough of Penndel.
B.Â
Upon the floors or stairways of any building or place frequented
by the public or used in common by the tenants.
C.Â
Upon the outside walls, walkways, driveways, alleys, curbs or stairways
of any building abutting on a public street or park.
D.Â
Upon the grounds of any public park or public area.
E.Â
Upon any private property other than the property of the owner of
such animal.
Any person having possession, custody or control of any animal which defecates or urinates in any area other than the private property of the owner of the animal as prohibited in § 118-6 shall be required to immediately remove any feces or waste from such surface and either:
Any person, firm or corporation who shall violate any provision
of this article shall, upon conviction thereof, be sentenced to pay
a fine of not more than $600 or to imprisonment for a term not to
exceed 30 days.
