This article shall be known and may be cited as "Local Law No. 1 of the Year 1980, Pertaining to the Adoption of Ordinances and Local Laws in the Town of Penfield, New York."
It is the purpose of this article to set forth the procedure for the adoption of local laws and ordinances in the Town of Penfield, New York, and to provide for the publishing of an abstract or summary of the same, rather than the full text thereof, in the effort to better inform the public through the use of "ordinary language," and in order to reduce the expenditure of costs to the citizens of the Town of Penfield by reducing the volume of publication required by law. It shall be the responsibility of the Town Attorney to summarize said local laws and ordinances.
This article shall modify and supersede Town Law § 133 (which provides for the publication of the full text of Town ordinances after their adoption), and shall also supersede Town Law §§ 264 and 265 (which requires the full publication of a zoning ordinance or a change in a zoning ordinance after its adoption).
No local law, or ordinance or amendment thereto shall be adopted by the Town Board of the Town of Penfield until a public hearing has been held thereon, not less than five days nor more than 30 days after public notice has been given of the time and place of the holding of such public hearing. Such notice shall be given by the Town Clerk by causing the same to be published once in the official newspaper of the Town of Penfield, as such may be designated by the Penfield Town Board. Such notice shall contain the title of the proposed local law, ordinance or amendment thereto, and a brief explanatory statement thereof.
The Town Clerk shall cause to be printed or otherwise reproduced copies of such proposed local law, ordinance or amendment thereto, and shall, not later than the day such notice is published, post one such copy, together with the notice of hearing, on the official sign board at the office of the Town Clerk, and shall also make copies of such proposed local law, ordinance or amendment thereto available at the office of the Town Clerk for inspection by and distribution to any interested person during business hours.
The Town Clerk shall, forthwith upon the adoption of a local law, ordinance or amendment thereto by the Town Board, post a copy thereof on the official sign board of the Town Clerk and shall, within 10 days after such adoption, cause the local law, ordinance or amendment thereto, or an abstract thereof describing the same in general terms, to be published in the official Town newspaper, as may be designated from time to time by the Penfield Town Board.
