GENERAL REFERENCES
Intoxicating liquor and fermented malt beverages — See Ch. 325.

No person may possess or attempt to possess 25 grams or less of marijuana, as defined in Wis. Stats. § 961.01(14), subject to exceptions set forth below:
A. 
The exceptions set forth in § 961.41(3g)(intro), Wis. Stats., shall apply to this section, including possession pursuant to a valid prescription or other authorization in Wis. Stats. Ch. 961 to possess marijuana.
B. 
Any person who is charged with possession of 25 grams of marijuana or who has any conviction for any amount of marijuana in the State of Wisconsin shall not be prosecuted under this section.
No person may engage in any of the conduct described in Wis. Stats., §§ 961.573, 961.574 and 961.575, relating to paraphernalia, as these statutory sections currently exist and may hereafter be amended.
Anyone who violates either § 256-1 or 256-2 shall be subject to the forfeitures set forth in Chapter 1, General Provisions, § 1-2, General penalty, of this Code.

A. 
Synthetic cannabinoid prohibited.
(1) 
Possession, use and sale are illegal. It shall be illegal for any person to use, possess, purchase, attempt to purchase, sell, publicly display for sale or attempt to sell, give or barter any one or more of the following chemicals whether under the common street or trade names of "Spice," "K2," "Genie," "Yucatan Fire," "fake" or "new" marijuana, or by any other name, label or description:
(a) 
Salvia divinorum or salvinorum A; all parts of the plant presently classified botanically as salvia divinorum, whether growing or not, the seeds thereof; any extract from any part of such plant, and every compound, manufacture, salts derivative, mixture or preparation of such plant, its seeds or extracts.
(b) 
(6aR, 10aR)-9-(hydroxymethyl)-6, 6dimethyl-3-(2methyloctan-2-yl)-6a, 7, 10, 10a-tetrahydrobenzo[c]chromen-1-o1; some trade or other names: HU-210.
(c) 
1-Pentyl-3-(1-naphthoyl) indole; some trade or other names: JWH-018\spice.
(d) 
1-Butyl-3-(1naphthoyl) indole; some trade or other names: JWH-073.
(e) 
1-(3{trifluoromethylphenyl}) piperazine; some trade or other names: TFMPP.
(f) 
Or any similar structural analogs.
(2) 
Penalties. Any person violating this Subsection A shall be subject to the following forfeitures:
(a) 
Possession/use. A forfeiture of $200 to $500, exclusive of costs.
(b) 
Sale. A forfeiture of $2,000 to $3,000, exclusive of costs.
B. 
Certain hallucinogenic and stimulant drugs prohibited.
(1) 
Possession, use and sale are illegal. It shall be illegal for any person to use, possess, purchase, attempt to purchase, sell, publicly display for sale or attempt to sell, give or barter any one or more of the following chemicals whether under the common street or trade names of "Bath Salts," "Meow-Meow," "Mef," "M-Cap," or by any other name, label or description:
(a) 
Llysergic acid diethylamide, phencyclidine, methcathinone, methylenedioxypyrovalerone, 4-methylmethcathinone, or a controlled substance analog of lysergic acid diethylamide, phencyclidine, methcathinone, methylenedioxypyrovalerone, 4-methylmethcathinone.
(b) 
Or any similar structural analogs.
(2) 
Medical or dental use allowed. Acts otherwise prohibited under Subsection A(1) shall not be unlawful if done by or under the direction or prescription of a licensed physician, dentist, or other medical health professional authorized to direct or prescribe such acts, provided that such use is permitted under state and federal laws.
(3) 
Penalties. Any person violating this Subsection B shall be subject to the following forfeitures:
(a) 
Possession/use. A forfeiture of $200 to $500, exclusive of costs.
(b) 
Sale. A forfeiture of $2,000 to $3,000, exclusive of costs.
