Peace and good order — See Ch. 400.
The Village hereby adopts, by reference, the provisions of Wis. Stats. § 101.123, Smoking prohibited, pertaining to the statewide smoking ban except that the definition of "enclosed place" shall be as set forth in § 432-2.
For purposes of the smoking ban in the Village of Kronenwetter, the following definition shall apply instead of the definition found in state statutes:
- ENCLOSED PLACE
- All space between a floor and a ceiling that is bounded by walls, doors, or windows, whether open or closed, covering more than 50% of the combined surface area of the vertical planes constituting the perimeter of the area. A wall includes any retractable divider, garage door, or other physical barrier, whether temporary or permanent. A 0.011 gauge screen with an 18 by 16 mesh count is not a wall.
The Village of Kronenwetter Police Department shall have the power to enter any premises subject to the smoking ban under state law to ascertain whether the premises are in compliance with this section and take appropriate enforcement action pursuant to Wis. Stats. § 101.123.

Anyone violating this chapter shall be subject to the penalties as set forth in the state statutes or the Village Bond Schedule, whichever may be applicable.
If any provision of this chapter shall be less restrictive than applicable state statute or in conflict with such statutes, as they exist at passage hereof or as they may hereafter be amended, then, in such case, the state statute shall supersede the provision hereof to the extent applicable.
