Except as otherwise provided herein, the provisions of N.J.S.A.
4:19-15.1 et seq., and acts amendatory thereof, shall govern and be
of the same force and effect as though set forth at length herein.
In supplement and addition to the provisions of the aforesaid
statutes and acts amendatory thereof, the following provisions shall
also apply within the confines of the Township of Eastampton.
Each and every person owning, harboring, keeping or having charge
of any male, female or spayed dog shall prevent such dog from being
on any property other than that in the possession of such person or
on any public street or public property in the Township unless such
dog be securely confined and controlled by an adequate leash, not
more than six feet in length, in the hands of a person able to control
it, or restrained by other adequate means.
A.
In accordance with N.J.S.A. 4:19-15.16, the Animal Control Officer
of the Township or Chief of Police or his designee shall take into
custody and impound any of the following:
(1)
Any dog or other domestic animal off the premises of the owner which
the Animal Control Officer or Chief of Police or his designee has
reason to believe is a stray.
(2)
Any dog or other domestic animal off the premises of the owner without
a current registration tag or other means of identification.
(3)
Any female dog in season off the premises of the owner.
(4)
Any dog or other animal which is suspected of being rabid.
(5)
Any dog or other domestic animal off the premises of the owner observed
by the Animal Control Officer or Chief of Police or his designee to
be ill, injured or creating a threat to public health, safety or welfare,
or otherwise interfering with the enjoyment of property.
B.
The Animal Control Officer or Chief of Police or designee shall follow
the guidelines established in N.J.S.A. 4:19-15.16 regarding noticing,
adoption and destruction of animals.
C.
The owner of the animal shall be responsible for all expenses incurred
by the Township in connection with seizure and impounding of the animal,
including maintenance costs of $4 per day.
D.
No person shall molest, obstruct or interfere with the Chief of Police
or any other member of the Police Department or other authorized person
while engaged in the enforcement of this article or any of the revisions
thereof.
A.
Private property. No person owning, harboring, keeping or in charge
of any pet shall cause, suffer or allow such pet to soil, defile,
defecate on or commit any nuisance on any private property without
the permission of the owner of the property and without immediately
removing all feces deposited by such pet in a sanitary manner.
B.
Public property. No person owning, harboring, keeping or in charge
of any pet shall cause, suffer or allow such pet to soil, defile,
defecate on or commit any nuisance on any public property or place
whatsoever without immediately removing all feces deposited by such
pet in a sanitary manner.
C.
A person who owns, keeps, harbors or has custody of a pet shall maintain
such person's property in a sanitary manner so as to prevent any noxious
odors, attraction of insects, attraction of vermin breeders and any
other public health nuisance.
D.
No person shall keep, harbor or own a dog that barks, howls, cries,
growls or makes other such noises repeatedly, frequently and/or over
a long period of time so as to disturb the peace, quiet, comfort and/or
repose of another person. Such noises are presumed to have occurred
repeatedly, frequently and/or over a long period of time if such noises
persist over a time period of 15 minutes or longer.
E.
Exemption. Any owner or keeper who requires the use of a disability
assistance animal shall be exempt from the provisions of this section
while such animal is being used for that purpose.
F.
Enforcement. This section shall be enforced by the Township Police
Department.
