As used in this article, the following terms shall have the
meanings indicated:
Any dog, bitch or spayed bitch.
Any dog which has attained the age of seven months or which
possesses a set of permanent teeth.
Any establishment wherein or whereon the business of boarding
or selling dogs or breeding dogs for sale is carried on, except a
pet shop.
When applied to the proprietorship of a dog, every person
having a right of property in such dog and every person who has such
dog in his keeping.
Any place of business which is not part of a kennel, wherein
animals, including, but not limited to, dogs, cats, birds, fish, reptiles,
rabbits, hamsters or gerbils, are kept or displayed chiefly for the
purpose of sale to individuals for personal appreciation and companionship
rather than for business or research purposes.

An establishment for the confinement of dogs seized either
under the provisions of this article or otherwise.
Any establishment where dogs are received, housed and distributed.

Any person who shall own, keep or harbor a dog of licensing
age shall, in the month of January in each year, apply for and procure
from the duly appointed Township Clerk of the Township a license and
official metal registration tag for each such dog so owned, kept or
harbored and shall place upon such dog a collar or harness with the
registration tag securely fastened thereto.
A.
The person(s) applying for the license and registration tag shall
pay the sum of $10 for each neutered dog and $13 for each nonneutered
dog therefor. For each annual renewal, the fee for the license and
registration tag shall be the same as for the original license and
tag. Said licenses, registration tags and renewals thereof shall expire
on January 31 in each year.

B.
Only one license and registration tag shall be required in any licensing
year for any dog owned in New Jersey, and such license and tag shall
be accepted by this municipality as evidence of compliance with this
section.
C.
Dogs used as guides for blind persons and commonly known as "Seeing
Eye" dogs, dogs used to assist handicapped persons and commonly known
as "service dogs" and dogs used to assist deaf persons and commonly
known as "hearing ear" dogs shall be licensed and registered as other
dogs hereinabove provided for, except that the owner or keeper of
such dog shall not be required to pay any fee therefor.
D.
Any person who shall fail to apply and secure a license for any dog
required to be licensed by statute within the time required shall
pay, in addition to the license fee and the registration tag fee,
a late charge which shall be in the amount of $10 for each such dog
beginning on March 1 of any year.

The owner of any newly acquired dog of licensing age or of any
dog which attains licensing age shall make application for a license
and registration tag for such dog within 10 days after such acquisition
or age attainment.
Any person who shall bring or cause to be brought into the Township of Eastampton any dog licensed in a state other than New Jersey for the current year and bearing a registration tag and who shall keep the same or permit the same to be kept within the Township for a period of more than 90 days shall, at the end of such period, promptly apply for a license and registration tag for each such dog, unless such dog be licensed under § 145-18 of this article.
No person, except an officer in the performance of his duties,
shall remove a registration tag from the collar of any dog without
the consent of the owner, nor shall any person attach a registration
tag to a dog for which it was not issued.
A.
Any person who keeps, operates or proposes to establish a kennel,
pet shop or pound shall apply to the Township Clerk for a license
entitling him to keep or operate such establishment.

B.
The application shall describe the premises where the establishment
is located or is proposed to be located and the purpose or purposes
for which it is to be maintained and shall be accompanied by the written
approval of the local health authorities showing compliance with the
local and state rules and regulations governing location of and sanitation
at such establishments. The Township shall not reissue a dog kennel
license if there are any outstanding violations of local codes, including
zoning, construction, noise and property maintenance codes.

C.
All licenses issued for a kennel, pet shop, shelter or pound shall
state the purpose for which the establishment is maintained. All such
licenses shall expire on the last day of January of each year and
be subject to revocation by the Township on recommendations of the
State Department of Health and Senior Services or the local Board
of Health for failure to comply with the rules and regulations governing
the same, after the owner has been afforded a hearing by either the
State Department or local Board.

D.
Any person holding such license shall not be required to secure individual
licenses for dogs owned by such licensee and kept at such establishments;
such licenses shall not be transferable to another owner or different
premises.
E.
The number of dogs permitted to stay at a kennel shall not exceed
15 per acre.

F.
Kennels in residential zones shall not be open for the pickup or
dropoff of dogs before 7:30 a.m. or after 7:30 p.m., Monday through
Friday, and before 8:30 a.m. or after 7:30 p.m. on weekends and holidays.

G.
All licensed kennels shall be required to comply with the provisions
of state rules and regulations governing the limitation of noise in
accordance with the standards established by the aforementioned rules
and regulations. The level of noise of the dogs at the kennels shall
not exceed those standards.

A.
The annual
license fee for a kennel providing accommodations for 10 dogs or less
shall be $10, and for more than 10 dogs, $25.

B.
The annual
license fee for a pet shop shall be $10.
C.
No fee
shall be charged for a shelter or pound.
No dog kept in a kennel, pet shop, shelter or pound shall be
permitted off such premises, except on a leash or in a crate or other
safe control.

The Township Clerk of the municipality shall forward to the
State Department of Health and Senior Services a list of all kennels,
pet shops, shelters and pounds licensed within 30 days after the licenses
therefor are issued, which list shall include the name and address
of the licensee and the kind of license issued.

Except as provided in N.J.S.A. 4:19-15.19, any person violating or failing to comply with any of the provisions of this article shall, upon conviction thereof, be punishable as provided in Chapter 1, Article II, Penalties for Violations. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
Any penalty recovered in any action brought under the provisions
of this article shall be paid to the plaintiff therein.

The Superior Court and the Municipal Court shall have jurisdiction
to hear and determine in a summary manner proceedings for violations
of any of the provisions of this article. Process shall be either
in the nature of a summons or warrant.
No provision of this article shall be construed to apply to
any establishment wherein or whereon dogs are received or kept for
diagnostic, medical, surgical or other treatments, owned by and operated
under the immediate supervision of a graduate veterinarian licensed
in the State of New Jersey.
