No parade, block party, or other public assembly is permitted on any right-of-way, park or other public area of the Village unless a permit allowing such activity has been obtained from the Village Manager pursuant to this Article 6; provided, however, that this Article 6 shall not apply to: (a) funeral processions; (b) students going to and from school classes or participating in educational activities under the immediate direction and supervision of school authorities; (c) a governmental agency acting within the scope of its functions; or (d) any public assembly that will not obstruct safe vehicular and pedestrian passage along and within the affected right-of-way, park, or public area.
Any person seeking to obtain a parade or public assembly permit shall file an application therefor with the Village Manager not less than 60 days prior to the date of the proposed parade or public assembly, which application shall include, without limitation, the following information:
(A) 
The name, address and phone number of the applicant and of the applicant's representative;
(B) 
If the parade or public assembly is proposed to be conducted for, on behalf of, or by an organization, the name, address and phone number of the authorized and responsible leaders of the organization conducting the parade or public assembly, and the name, address and telephone number of the headquarters of the organization;
(C) 
The date and times of the proposed parade or public assembly, including the times during which the participants are expected to assemble for the parade or public assembly;
(D) 
The route to be traveled, including the assembly area, the starting point and the termination point;
(E) 
The approximate numbers of persons, animals and vehicles expected to participate in the parade or public assembly;
(F) 
A statement as to whether the parade or public assembly will occupy all or only a portion of the width of the streets proposed to be traversed;
(G) 
The interval of space to be maintained between units of such parade, public assembly or similar activity;
(H) 
Proof that the applicant has acquired insurance in the form specified in Section 6-6-4 of this Code;
(I) 
If the parade, public assembly or similar activity is designed to be held by and on behalf of or for any person, partnership, voluntary association, corporation or other organization other than the applicant, a written statement from an authorized and responsible leader of such organization authorizing the applicant to apply for the permit on behalf of such person or organization;
(J) 
A statement that the applicant will indemnify and hold harmless the Village and its officers, agents, and employees from all losses, damages, injuries, claims, demands and expenses arising out of the operation of the parade or public assembly or out of the condition, maintenance, and use of the public property involved with the parade or public assembly; and
(K) 
Any additional information as may be required by the Village Manager.
The Village Manager may consider an application filed later than the deadline set forth in Section 6-6-2 of this Code only upon a showing by the applicant of good and compelling cause, as determined by the Village Manager in his or her sole and absolute discretion.
No permit shall be issued to any applicant until such applicant procures public liability insurance in an amount of not less than $1,000,000 and property damage insurance of not less than $1,000,000, which insurance must be procured from a company authorized to do business and write policies of insurance in the State of Illinois. The Village shall be named as an additional insured under the required policies of insurance for the parade or public assembly.
The Village Manager shall issue a parade or public assembly permit upon his or her determination that:
(A) 
The conduct of the parade or public assembly will not substantially interfere with the safe and orderly movement of traffic in the area contiguous to the route;
(B) 
The activity will not create an imminent danger of a substantial breach of the peace, riot, or similar disorder;
(C) 
There are available at the time of the parade or public assembly a sufficient number of peace officers to police and protect lawful participants in the activity and maintain adequate police protection in the rest of the Village.
(D) 
The concentration of persons, animals and vehicles at the assembly points of the parade or public assembly will not unduly interfere with the proper fire and police protection of or ambulance service to areas contiguous to such assembly areas;
(E) 
The conduct of such parade or public assembly will not interfere with the movement of fire-fighting equipment en route to a fire;
(F) 
The parade or public assembly is scheduled to move from its point of origin to its point of termination expeditiously and without unreasonable delays in route;
(G) 
The parade or public assembly is not being conducted for an unlawful purpose or for the sole purpose of advertising any product, goods or event, and is not designed to be held purely for private profit; and
(H) 
The applicant has complied fully with the insurance requirements set out in Section 6-6-4 of this Code.
The Village Manager shall either approve, approve with conditions, or deny the parade or public assembly permit within 30 days after receipt of the application therefor. The failure of the Village Manager to either approve or deny the parade or public assembly permit within 30 days after receipt of the application therefor shall be deemed a denial of the permit.
Immediately upon the issuance of a parade or public assembly permit, the Village Manager shall send a copy thereof to the following:
(A) 
The Police Chief;
(B) 
The Fire Chief;
(C) 
The Village Attorney;
(D) 
The Director of Public Works; and
(E) 
The Director of Parks and Recreation.
Each parade or public assembly permit shall state the following information:
(A) 
Starting time;
(B) 
Minimum speed;
(C) 
Maximum speed;
(D) 
Maximum interval of space to be maintained between the units of the parade or public assembly;
(E) 
The portion of the streets to be traversed that may be occupied by the parade or public assembly;
(F) 
The maximum length of the parade or public assembly in miles or fractions thereof; and
(G) 
Such other information as the Village Manager shall find necessary to ensure the enforcement of this Article 6.
The recipient of a parade or public assembly permit shall comply with all permit directions and conditions and with all applicable laws and ordinances. One of the authorized and responsible leaders of the organization conducting the parade or public assembly shall carry the parade or public assembly permit upon his or her person during the conduct of the parade.
(A) 
Interference. No person shall unreasonably hamper, obstruct, impede or interfere with any parade or public assembly, or with any person, vehicle or animal participating or used in such parade or public assembly;
(B) 
Driving through parades or public assemblies. No driver of any vehicle shall drive between the vehicles or persons comprising a parade or public assembly when such vehicles or persons are in motion and are conspicuously designated as a parade or public assembly; provided, however, that fire and police vehicles and ambulances may interrupt a parade or public assembly in an emergency situation;
(C) 
Parking on parade or public assembly route. The Village Manager shall have the right, but not the obligation, to prohibit or restrict the parking of vehicles along any street constituting a part of the route of a parade or public assembly, and to order the posting of signs necessary to enforce any such prohibitions or restrictions. It shall be unlawful for any person to park or leave unattended any vehicle in violation of any prohibition or restriction imposed pursuant to this Section 6-6-10(C).
The Village Manager shall have the authority to revoke a parade or public assembly permit issued pursuant to this Article 6 if he or she determines that the parade or public assembly does not or will not comply with the standards or conditions for issuance of the permit therefor.[1]
