(A)
Any person convicted of a violation of any section of this Code, or of any other ordinance of the Village for which no specific penalty is provided, upon conviction thereof, shall be fined not less than, nor more than, the minimum/maximum general penalty amount set forth in the Annual Fee Resolution.[1]
[1]
Editor's Note: See Ch. A25, Fees.
(B)
Where the penalty for a violation of an offense is contained in such section, the penalty so provided in that specific section shall control. Whenever the violation of a provision of any ordinance of the Village would entitle the Village to recover a fine, it shall not be necessary that said ordinance specifically say that a penalty is recoverable or specify the amount of such penalty; in all such cases, the penalty provision of this section shall be applicable and included automatically in such ordinance.
(C)
In construction and interpretation of this section, the revocation of a license or permit shall not be considered as a recovery or penalty so as to bar any other penalty being enforced.
(D)
A separate offense shall be deemed committed on each day or part thereof on which a violation occurs or continues or is permitted to occur or continue.
In all cases where the same offense is made punishable or is created by different clauses or sections of this Code, the prosecuting officer may elect under which to proceed, but not more than one recovery shall be had against the same person for the same offense.
When the provisions of any section of this Code prohibit the commission of an act, not only the person actually doing the prohibited act or omitting the directed act, but also the employer and all other persons concerned with or aiding or abetting the said person shall be guilty of the offense described and liable to the penalty set forth.
