The Village Board of the Village of Warsaw has, pursuant to
§§ 7-728 and 7-730 of the Village Law of the State
of New York and by resolution, authorized and empowered the Planning
Board to approve plats showing lots, blocks or sites, with or without
streets or highways, within the incorporated limits of the Village
of Warsaw.
This chapter shall be known and may be cited as the "Subdivision
Regulations of the Village of Warsaw."
A.
Whenever any subdivision of land is proposed, before any contract
is made for the sale of or any offer to sell any lots in such subdivision
or any part thereof is made, before any permit for the erection of
a structure in such proposed subdivision shall be granted and before
any subdivision plan may be filed in the Office of the Wyoming County
Clerk, the subdivider or a duly authorized agent shall apply for and
secure approval of such proposed subdivision in accordance with the
following procedures.

The Wyoming County Clerk's Office shall not record a plat of
any subdivision within the village unless the plat has been approved
in accordance with the provisions of this chapter and contains all
of the appropriate signatures.
A.
The subdivision of land shall conform to this chapter as well as
to appropriate laws, rules and regulations established by all governing
bodies having or claiming jurisdiction over various phases of the
proposed development.
B.
It is declared to be the policy of the Planning Board to consider
land subdivision to be part of a planning process that provides for
the orderly, efficient and economical development of the village and
in a manner that is reasonable and in the best interest of the community.
In its consideration of an application for the subdivision of land,
the Planning Board shall be guided by the following general requirements:
(1)
Land must be buildable and free of hazards. The physical characteristics
of the land to be subdivided shall be such that it can be used for
building purposes without danger to health and safety or peril from
fire, flood, erosion or other menace. Proper provision shall be made
for vehicular and pedestrian access, stormwater drainage, water supply
and sewage disposal as well as for other needed improvements.
(2)
Important community resources and natural features should be preserved.
Insofar as possible, all existing features of the landscape, such
as large trees, water- and flood courses, historic sites and other
significant community assets shall be preserved.
(3)
Subdivisions shall be in conformance with all local legislative requirements
and consistent with the Village Comprehensive Plan.
