A.
Findings.
(1)
The waters of Lake Placid provide numerous sporting and recreational opportunities for residents and visitors and are the sole source of public drinking water for the Village of Lake Placid.
(2)
The existence and growth of an invasive plant species in Lake Placid will have a serious negative impact on the health, safety and welfare of the public as well as the use and enjoyment of Lake Placid.
(3)
The section of Lake Placid known as Paradox Bay is relatively narrow and shallow and an invasive plant species is now growing in Paradox Bay; and
(4)
Many nonmotorized watercraft such as canoes and paddle boats are used and operated in Paradox Bay.
B.
In order to protect and preserve the waters of Lake Placid and the public health, safety and welfare of the residents of the Village of Lake Placid, their guests and visitors to the Village and to preserve the environment of the Village of Lake Placid, including the environmentally sensitive areas within the Village boundaries and the areas adjoining the Village, including the turbidity and quality of the waters of Paradox Bay, and the lake bottom of Paradox Bay, the Board of Trustees does hereby enact this article pursuant to § 46-a of the New York State Navigation Law and § 10 of the New York Municipal Home Rule Law.
