The purpose of this chapter is to regulate the use of the playgrounds and Town shelter of the Town of Owasco.
The following terms shall have the meanings indicated in this section:
PERSON
Any individual, firm, partnership, corporation or association of persons; the singular number shall include the plural.
PLAYGROUNDS and TOWN SHELTER
The grounds, buildings therein, water therein and any other property necessary for the operation thereof, and constituting a part thereof, which is now or may hereafter be maintained, operated and controlled by the Town of Owasco for public use.
TOWN
The Town of Owasco.
A. 
The following activities are prohibited:
(1) 
Parking a motor vehicle in other than designated locations. No blocking of any driveway.
(2) 
Operating a motor vehicle in excess of five miles per hour or in any manner contrary to posted regulations.
(3) 
Operating any motorized vehicles.
(4) 
Use of bikes and skateboards.
(5) 
Allowing dogs in the playground at any time.
(6) 
Allowing dogs to run unleashed.
(7) 
Entering or using the playgrounds at times other than the hours set forth in § 109-4 of this chapter.
(8) 
Overnight parking of motor vehicles.
(9) 
Use of profane or abusive language while in the playground.
(10) 
Injuring, defacing, destroying, disturbing, or removing any part of the playground.
(11) 
Littering or leaving behind refuse and garbage except in receptacles provided for such purpose.
B. 
Miscellaneous.
(1) 
All children must be supervised by an adult at all times.
(2) 
The Town is not responsible for any injuries resulting in the use of equipment provided at the playgrounds.
The playgrounds are open from sunrise to sunset.
A. 
A violation of this chapter shall constitute an offense punishable by a fine not to exceed $50 for each and every such offense.
B. 
Any state police officer or police officer of Cayuga County or any of its municipal subdivisions may, without a warrant, arrest any offender who he or she may detect in the violation of any of the provisions of the above sections, and take the persons so arrested forthwith before a magistrate having competent jurisdiction, and he shall have at all times a right to enter the premises of any building, structure or enclosure in any playground, including such grounds, buildings, structures or enclosures in any Town playground for the purpose of arresting violators hereof, and may use all necessary means to attain that end.

There is hereby established a Town Recreation Board to oversee the Town of Owasco playgrounds and to provide recreation programs in the Town of Owasco.
A. 
The members of the Board shall be appointed by the Town Board of the Town of Owasco, and said Board shall consist of five members.
B. 
The Town Board shall designate from the appointed members one member to serve as Chairperson of said Board for a term of one year.
Upon the initial appointment of the members of the Board, two members shall be appointed for a term of two years, two members for a term of three years and one member for a term of four years. Thereafter, upon the expiration of their initial terms, all members of the Board shall be appointed for a term of two years.
Each member appointed shall be a resident of the Town of Owasco.
The purpose of the Board is to oversee the playgrounds and to provide recreation programs in the Town of Owasco.
The Board shall:
A. 
Meet at least bimonthly.
B. 
Have minutes taken of such meeting of the Board and make them available to the public.
C. 
Interview and recommend to the Town Board the hiring of recreation employees.
D. 
Make and monitor an approximate eight-week schedule for the summer program.
E. 
Make recommendations to the Town Board for repairing or replacing of equipment at the playgrounds and the purchase and location of any new equipment for the playgrounds.
F. 
Make recommendations to the Town Board regarding the Town shelter.
G. 
Make recommendations to the Town Board and monitor recreation programs for the Town of Owasco.
H. 
Meet with the recreation employees and monitor activities at the playgrounds.
I. 
Consult from time to time with the Town Supervisor and Town Board.
J. 
Annually prepare a proposed budget for the Town Board for the playgrounds.
K. 
Annually, by December 31 of each year, submit to the Town Board a written report concerning the work and activities of the Board during the year.
