The Township Council hereby finds that indiscriminate and excessive cutting of trees upon tracts of land has resulted in creating increased surface drainage and increased soil erosion, thereby causing increased municipal costs to control drainage within the Township, and impairs the benefits of occupancy of existing residential property and the stability and value of both improved and unimproved real property in such areas with attendant deterioration of conditions affecting the health, safety and general welfare of the inhabitants of the Township.
This article shall apply to all persons applying for building permits for more than one home or a home to be built as a part of an uncompleted development.
No building permit shall be issued unless such person files an appropriate plan showing all trees proposed to be removed in accordance with this article, the species and condition of such trees and the survey stakes marking out a foundation of a building or dwelling, garage, driveway, recreation area or any site that warrants tree removal. If the Division of Shade Trees finds that the plan is correct and complies with this article, it shall so certify to the Construction Code Official.
Any person violating any of the provisions of this article shall, upon conviction thereof, be liable to the penalty stated in Chapter 1, Article III, General Penalty.
