Editor's Note: Original Sec. 1-A of Art. VI, which dealt with a portion of the parking area on the north side of the City Hall Auditorium, as amended 11-20-1972, was repealed 11-18-2013 by Ord. No. 1563.

§ 600-23 All-night parking.

Parking ban.

The Mayor, or designee, after consultation with the Police Department and the Department of Public Works, may order a parking ban to be put in place and enforced by the Gardner Police Department.

During the parking ban, no vehicles will be permitted to park on any public way, highway, or parking lot under the control of the City, except those locations listed in the later sections of this ordinance.

Notification to residents about the ban will occur by posting the information through social media, the City's emergency alert system, notification to the local newspaper and/or by any other technology deemed fit for this purpose.

The parking ban shall expire upon notice from the Mayor, or designee, stating the date and time that the ban will expire. The Mayor, or designee, may choose to issue this notice at a separate date and time from when the ban is declared.

Fines issued by the Police Department by those in violation of this section shall be set according to the provisions of Chapter 390 of the Code of the City of Gardner.

There shall be no all-night parking at the following lots during this ban: Uptown Parking Lot.

Chapter 512, Parking, Article I, Interference with Snow and Ice Removal, of this Code shall take effect in the case of a parked motor vehicle or trailer which interferes with removal of snow and ice.

At the prescribed lots, during the parking ban, designated overnight parking areas shall be properly signed and parking shall be allowed until 7:00 a.m., unless otherwise noted. No vehicle may park in a designated overnight parking area, in any municipal lot, during the overnight parking ban, between the hours of 7:00 a.m. and 9:00 a.m., unless otherwise noted. Any vehicle or trailer parking in violation of the above shall be tagged and/or towed by the Police Department. The following are designated areas:

West Street: north side facing Franklin Court.

Knowlton Street: east side facing Pleasant Street (one lane).

Knowlton Street: from 7:00 p.m. to 7:00 a.m., east side from the southerly point of entrance of the City Hall Annex driveway south 75 feet to the overnight parking area.

West Lynde Street Parking North Lot: With the exception of the four parking spaces located outside of the enclosure, all City-designated parking spaces located in the lower level of the lot, except when the lot is posted for maintenance or weather-related cleanup. This lot is exempt from the 7:00 a.m. to 9:00 a.m. restriction on parking due to it being a covered lot.

No person shall park or stop a commercial vehicle of a capacity of over one ton or a tractor in any street or way in the City of Gardner for a period of time longer than one hour in any consecutive four hours, except when a vehicle is actively being used for the purpose of loading or unloading.

No person shall park a trailer or camper, unattached from the towing vehicle, upon any public way in the City of Gardner, and no person shall park any trailer or camper, attached to a towing vehicle, upon any public way in the City of Gardner for a period longer than four hours in any consecutive twenty-four-hour period. Landscaping vehicles/trailers, paving vehicles/trailers and other such contractor vehicles/trailers may park upon a public way while actively engaged in landscaping, paving, and other contractor labor where the parking of said vehicle/trailer does not impede the free flow of traffic and leaves at least 10 feet in the travel lane. No vehicle, trailer, or tractor described above may park at any time upon any sidewalk or crosswalk within the City of Gardner, whether engaged in labor or not.

§ 600-30 Standing vehicles near schools.

No person shall stop or stand any vehicle upon a public way in the City of Gardner within 1,000 feet of any school of said City between the hours of 8:00 a.m. and 3:00 p.m. on days when the public schools are in session for the purpose of selling or offering for sale any food, beverage, goods, wares or merchandise therein or therefrom.

This section, however, shall not prevent stopping of vehicles of hawkers or peddlers at dwelling houses for the purpose of selling goods, wares and merchandise to occupants thereof in accordance with MGL c. 101 and regulations made under authority thereof.

§ 600-31 Fire lanes.

No person shall park or leave a vehicle unattended within the limits of a designated fire lane providing access for apparatus to any building. The City Council, in consultation with the Fire Chief, is hereby authorized to designate such lanes on any private way. The fine for violation of this section shall be $25 for the first and subsequent offenses, and the towing of said vehicle shall be at the owner's expense. Each day that a violation continues shall constitute a separate offense. The Police Department shall have authority to enforce this section.

§ 600-32 Angle parking.

The Chief of Police shall determine upon what streets angle parking shall be permitted and shall mark or sign such street or cause the same to be signed or marked.

Upon the following streets or parts thereof which have been marked or signed for angle parking, vehicles shall be parked with one front wheel within 12 inches of the curb and at the angle to the curb indicated by such marks or official signs. The vehicle shall be parked wholly within the painted lanes provided.

§ 600-33 Safety zones.

When a safety zone is so located in a way that the distance between it and the end of the curb of the roadway is less than 20 feet, no operator shall park a vehicle within 30 feet of any such safety zone.

§ 600-34 Bus stops.

No person shall stop or park a bus upon any street at any place other than a bus stop when a nearby bus stop is available for use.

§ 600-37 Parking vehicles for sale prohibited.

It shall be unlawful for any person to park upon a street or highway any vehicle displayed for sale.

§ 600-38 Repairing of vehicles.

No person shall repair, wash, or clean vehicles or other conveyances or cause them to be repaired, washed, or cleaned or allow any material to be left or cause water, gas, oil, or any other liquid in or upon any public property owned or controlled by the City or any of its departments, boards or agencies as storage room for any vehicles, except in an emergency where temporary repairs may be made. Penalty shall be a fine of $50 for each offense. Each day or part thereof on which such violation exists shall consist of a separate offense.

Subsection A shall not be enforced to prohibit individuals from washing or cleaning their own vehicles on private property from April 1 through October 15; however, this section is not intended and shall not be interpreted as a waiver or in conflict with any applicable state regulations.[1]

§ 600-39 Stopping of buses and parking of taxicabs.

The provisions of this article shall not prevent the stopping of buses at approved bus stop locations nor the parking of taxicabs at designated taxicab stands.[1]
