No person over five and under 20 years of age, pursuant to the provisions of N.J.S.A. 18A:38-1, and/or any such younger or older students as are or may be entitled by law to a free public education shall attend nor be permitted to attend the Clark Township public schools unless such person is a bona fide resident of the Township of Clark.
As used in this chapter, the following terms shall have the meanings indicated:
BONA FIDE RESIDENT
A person is a bona fide resident of the Township of Clark if he/she meets the age criteria set forth in § 270-1 hereof and resides within the jurisdictional limits of the Township of Clark permanently and on a full-time basis in the care of his/her parents or legal guardian. Any student attending Arthur L. Johnson High School pursuant to a contract between the Township of Clark and any other municipality shall be deemed to be a resident for the purposes of this chapter.
Any person who violates or causes a person to violate the provisions of this chapter shall be subject to a fine not to exceed $1,000 and/or imprisonment not to exceed six months, or both, as the same may be deemed to be appropriate by the Municipal Court Judge of the Township of Clark or such other Municipal Court Judge sitting in his place. Said fine shall be paid to the Township of Clark as a general revenue. Furthermore, the Municipal Court Judge shall have the authority to order restitution to the Clark Township School District in such amount as shall be deemed to be appropriate in order to indemnify the Clark Township School District from and against any actual financial loss associated with the attendance of any such nonresident child. Such restitution shall be payable to the Clark Township School District for its general revenue fund.
