This chapter shall be applicable to any vehicle that is parked in violation of any parking regulation in the Code of the Township of Mahoning and that is determined to be either registered to an owner who has three or more unresolved and delinquent violations of parking regulations of the Township or who is the subject of an outstanding warrant from any other law enforcement agency.
The Township shall have authority to immobilize any vehicle parked illegally under the applicable provisions of the Code of the Township of Mahoning by application or attachment of a vehicle immobilization device, commonly referred to as a "parking boot."
A. 
Upon attachment of the immobilization device, the police officer shall affix to the vehicle a notice directing the owner or operator of the vehicle to contact the Police Department for information on obtaining the release of the vehicle.
B. 
In addition, within 12 hours after the application of the immobilization device, notice of the fact that such vehicle has been immobilized shall be sent by the Chief of Police to the owner of record of such vehicle. Such notice shall designate the place where the vehicle is immobilized, the reason for its immobilization and the procedure for obtaining its release.
A. 
An illegally parked vehicle that has been immobilized as the result of its owner having three or more delinquent parking violations shall be released upon payment in full of any fines and costs relating to such overdue and delinquent violations, plus a processing fee, as established by resolution of the Township Supervisors, for the use of the Township.
B. 
An illegally parked vehicle that is immobilized in response to an outstanding warrant from another law enforcement agency shall not be released until such time as said warrant shall be canceled.
The payment of any applicable fines or costs for delinquent violations as a condition for release of an immobilized vehicle shall not operate to relieve the owner or operator of such vehicle from liability for any fine or penalty for the violation of any parking regulation pursuant to which said vehicle was immobilized.
