It shall be unlawful for any person without having obtained a permit and paid the fee therefor as provided in this division to install or cause to be installed a banner across a street in the City.

(a) 
Permits required by this division shall be issued by the director of public works, who shall establish regulations and policies consistent with this article to assure public safety.
(b) 
Permits shall have minimum duration of 14 days and shall be authorized only at such location as have strain poles installed for such purpose.
(c) 
Permits shall be issued on a first-come, first-served basis. Permits may be issued six months in advance of any requested dates. Only one permit may be issued for any event/activity.
(d) 
Permits may be issued only for advertising of public and private events or activities open to the general public. Permits may not be issued for:
(1) 
The advertising of products or services for sale.
(2) 
Retail sales promotions.
(3) 
Political campaign promotions.
(e) 
The permit applicant shall be responsible for and shall bear all costs of the installation, maintenance and removal of the banner. Banners shall be installed only by contractors approved by the director of public works. Any approved contractor shall have appropriate equipment for such installation, maintenance and removal, and shall file with the director an in force certificate of general liability insurance in an amount to be established by the department regulations, but at least $300,000 per occurrence.
(f) 
The permit application shall contain the exact wording as shall appear on the banner. The director of public works may reject wording deemed offensive or inappropriate for display over the public streets. Any applicant rejected for wording deemed offensive or inappropriate for display over the public streets may appeal to the common council in writing within 10 days of such rejection.

The fee for permits issued under this division shall be $30.
