A. 
Types of containers to be used.

(1) 
No person shall deposit any garbage, rubbish or other refuse, solid or liquid waste upon public or private property in the Village of Cornwall-on-Hudson unless the same is upon the premises of the owner in an appropriate watertight garbage can provided with a cover and equipped with handles, which container shall not exceed 35 gallons in capacity, with a total weight (container and contents) of not more than 50 pounds.
(2) 
Owners of multiple dwellings with four or more apartments and commercial establishments shall provide an appropriate can or dumpster as determined by the Superintendent of Public Works. Generally, the volume of waste shall dictate the type (can or dumpster) required for a commercial business or multiple dwellings. Containers shall be placed in the rear or side yards of commercial/apartment buildings, enclosed and screened from public view with an appropriate barrier as approved by the Superintendent of Public Works. Access to the container location shall be kept clear of obstruction and free from snow and ice so as to permit the Department of Public Works sanitation vehicles to empty the container. Failure to provide access during the normal sanitation pickup is a violation of this chapter. Failure to provide access during the normal sanitation pickup will result in a repeat trip charge equal to actual costs to the village for a second trip.
(3) 
Property owners may appeal to the Board of Trustees any requirement imposed by the Superintendent of Public Works.
A.1. 
In mixed commercial, multifamily or single-family use neighborhoods, the Superintendent of Public Works may require a property owner to use an appropriate container, enclosure and/or screening device to minimize the impact of such containers on the appearance of the neighborhood. The cost of containers sold by the village to a commercial establishment or multiple dwelling shall be borne by the property owner and paid for within 30 days of presentation of a bill for the cost thereof. If such bill is unpaid, it shall become a lien on the property and may be collected in the same manner as other real property taxes.

B. 
All garbage shall be drained before depositing the same in the container.
C. 
Garbage shall be permitted upon the streets or sidewalks of the Village of Cornwall-on-Hudson only in such containers and on the night before the regularly scheduled day for collection by the garbage collectors.
D. 
Containers shall be placed no earlier than 5:00 p.m. the night before a scheduled pickup day for emptying by the Village Department of Public Works. Containers shall be removed from the street to a location not visible from the street within 12 hours after the same have been emptied. Exceptions to the foregoing would be dumpsters or containers placed inside approved screening barriers, e.g., fencing, as approved by the Superintendent of Public Works.

Rubbish, when too large for inclusion in garbage containers, shall be piled, packed or bunched together and firmly tied so as to be easily handled by one person. All newspapers, wrapping paper and cardboard boxes shall be flattened and magazines shall be firmly tied in bundles.
Containers shall be placed as close to the street as possible. The collector shall not be required to enter the premises, cellars or outhouses for the collection of ashes, garbage or rubbish.
Containers shall be kept in a proper state of repair and, when dangerous to handle, shall be replaced upon notification. The containers shall be kept in sanitary condition, and the contents kept in such condition that they may be readily removed.
