This article is enacted pursuant to the power of supersession granted to the Town of Ontario by Municipal Home Rule Law § 10.
This article supersedes New York State Town Law § 23(1) and Public Officers Law § 3(1), to the extent they require that the Town Court Clerk be a resident and elector of the Town of Ontario
The Town Court Clerk and the Deputy Court Clerk need not be a resident or elector of the Town of Ontario, provided that she or he resides in Wayne County or an adjoining county in the State of New York.
