No person shall within the confines of the Borough urinate or
defecate upon any road, street, avenue, beach, private property or
any other area unless the same is an enclosed rest room facility meant
for such purposes.
No person within the limits of the said Borough shall swim,
bathe or be found in a state of nudity while bathing in the waters
of the Atlantic Ocean, Barnegat Bay or waters adjacent thereto, and
no person shall appear in a state of nudity or make any indecent exposure
of his or her person on any boat or other craft within the limits
of the said Borough.
No person shall undress or disrobe, or dress or robe, for the
purpose of uncovering a bathing suit, in any motor vehicle while the
same is parked on any road, street, avenue, beach or other public
place.
No person shall undress or disrobe, or dress or robe, in any
public place, excepting such place as may be provided for such use.
No person shall, within the limits of the said Borough, operate
or use radio, phonograph, television or any other sound-producing
instrument, device or apparatus in such a manner that will disturb
the rest or repose of any person or persons in his, her or their place
of abode.
No person or persons shall make or cause or continue to make
any noise, such as loud talk, singing, laughter or any unnecessary
noise, that will disturb any person or persons in his, her or their
place of abode.
No person shall, within the limits of the said Borough, discard,
deposit, throw or leave any wastepaper, tin cans, bottles, garbage,
waste or refuse of any kind whatsoever upon any parking place, street,
road, avenue, beach, park or other public place, or upon any lot or
other premises, except in receptacles or containers provided for such
purpose.
No person shall, within the limits of the said Borough, engage
or participate in any game practice, sport or exercise having a tendency
to annoy, disturb or frighten any person or persons on any street,
road, avenue, boardwalk, beach, park or other public place, or having
a tendency to annoy or frighten horses or other animals on any street,
road, avenue or other public place.
No person shall, within the limits of the said Borough, loiter
or sleep in any parked automobile while the same is upon any road,
street, avenue or public place.
No person or persons shall, within the limits of the said Borough,
maliciously destroy, damage or injure any property.
No person or persons shall, within the limits of the said Borough,
have any picnic on any public street, beach, road, avenue or any public
property in said Borough.

No person or persons shall, within the limits of the said Borough,
appear in an intoxicated state, or drink any intoxicants on any road,
street, avenue or other public place.
No person shall park a vehicle in any private driveway or on
any private property within the limits of the said Borough without
first having the permission of the owner.
From time to time the Commissioners of the Recreation Commission
will promulgate rules and regulations for the use of the several playgrounds
within the Borough of Seaside Park, and person or persons making use
of the said playgrounds shall conform with the rules and regulations
as promulgated by the Recreation Commission of the said Borough.
No person or persons shall leave any bait or dead fish upon
any beach, road, avenue or public place when such person or persons
are leaving the beach or other place.
No person or persons shall bait, fish or cast from the shores
within any protected bathing beach located in the said Borough.
No person or persons fishing or crabbing in the waters of Barnegat
Bay shall leave any dead fish, crabs or other waste material along
the bay shore of the said Borough.

A. No person
shall operate, drive or park any vehicle upon the boardwalk or any
part thereof in the Borough of Seaside Park.
B. No person, except as provided for in Subsection
C below, shall operate any device by which a person may be propelled, otherwise than by muscular power, upon any boardwalk or pier in the Borough of Seaside Park.
C. This section
shall not apply to any motorized wheelchair, mobility scooter or similar
mobility assisting devices used by an operator with limited or no
ambulatory abilities.
No person shall park any motor vehicle so that the same shall
obstruct any public sidewalk in the said Borough.
No person over 12 years of age shall use the public docks for
fishing, swimming or crabbing at Fifth Avenue or Fourteenth Avenue
unless such person shall have a municipal bathing tag prominently
displayed upon his or her person.

No person or persons shall take any dog or other animal on the
boardwalk of this municipality, which boardwalk lies to the east of
Ocean Avenue and runs parallel thereto, or upon the beach of this
municipality lying to the east of said boardwalk, or upon any bathing
beach or recreation area along Barnegat Bay.
No person or persons shall throw, drop, discard or leave any
wastepaper, garbage or refuse or any food or drink or any waste material
whatever on any bathing beach or other beach in the said Borough.

A. No person shall authorize, create, or cause to create, kindle, or maintain any open burning or fire unless conducted and permitted and/or approved in accordance with this §
338-47.
(1) Permitted outdoor fires are limited to recreational fires entirely
contained within portable fire devices and permanent fire devices
and which may only be lit and maintained with clean firewood, charcoal,
manufactured fire logs, propane, and natural gas as permissible fuels.
All other fuels, including, but not limited to, brush, leaves, trees,
trash, refuse, and treated and wet wood are prohibited.
(2) All permitted outdoor fires shall be maintained in a manner that
ensures any smoke or embers arising therefrom do not interfere with
the air quality, peace and quiet enjoyment of neighboring residents.
(3) With the sole exception of grills and related permitted cooking devices,
all portable fire devices and permanent devices shall possess and
employ an ember suppressing lid (stone/masonry devices must have a
lid or screen).
(4) Residential outdoor fires must be attended at all times by a competent
adult owner or legal resident of the property, age 18 years old or
older, from the time the fire is commenced until said fire is completely
extinguished.
(5) No outdoor fire may be set on residential property with 10 feet of
any property line, or of any primary or accessory structure on the
property, including but not limited to, any dwelling, garage, fence,
hazardous landscape, shed, or deck.
(6) Outdoor fires utilized for any other recreational purposes must be
contained in a manufactured device designed for such purpose and utilized
strictly in accordance with the manufacturer's requirements or, alternatively,
in a proper noncombustible stone, cement, brick, tile or metal firepit
of no more than three feet in diameter and shall not exceed three
feet in height.
(7) Following the passage of this section, no new firepits may be constructed
without the proper permits and inspections. For all existing firepits
within the Borough, should the Fire Chief or his designee determine
that a firepit is unsafe, he/she may order that said firepit not be
used until he/she or his designee deem said firepit safe.
(8) Any open burning or outdoor fires shall be required to be in compliance
with the New Jersey Uniform Fire Code.
(9) A fully functioning fire extinguisher or garden hose that is properly
connected to an unlimited water source must be available for fire
extinguishment purposes whenever any fire is ongoing.
(10)
Flames may not exceed two feet at any time, should the prevailing
winds cause the smoke from said fire to blow into a neighboring dwelling
or any property lot line, said fire must be extinguished immediately.
The Fire Chief or his designee is authorized to require any residential
outdoor fire be immediately extinguished if he/she determines that
said fire constitutes a hazardous condition. In addition, all members
of the Borough Fire Department and Borough Police Department are authorized
to require that any residential outdoor fire be immediately extinguished
if smoke emissions are found to be offensive to occupants of surrounding
properties.
(11)
The Fire Chief and/or his designee may prohibit all outdoor
fires within the Borough when weather conditions or other local circumstances
make such fires hazardous.
(12)
All permanent fire devices shall be constructed at grade level
of the subject property.
(13)
Portable barbecue grills shall be exempt from this section.
(14)
The provisions of this section shall be fully enforceable by
the Fire Chief and/or his designee, the Chief of Police and/or any
member of the Police Department of the Borough of Seaside Park and
the Code Enforcement Officer of the Borough of Seaside Park.

Any person who violates any one or more sections of this article shall be subject to the general penalty in Chapter
1, Article
II, General Penalty, of the Borough Code.
