This chapter is enacted pursuant to the terms and provisions
of § 124 of the General Municipal Law of the State of New
York relating to the inspection of building elevators in Nassau County.
As used in this chapter, the following terms shall have the
meanings indicated:
Any device designed or used for the purpose of moving people
or material from one floor to another in a vertical manner, excluding
the following: dumbwaiters, escalators or similar devices.
A.
It shall be the duty of the owner or agent of a building which has
a passenger or freight elevator therein contained to register and
provide the Department of Buildings of the Town of Hempstead with
an inspection report which shall be obtained from a recognized elevator
repair or installation company or from an insurance company.
B.
The necessary inspection and testing of passenger and freight elevators
shall be made during the months of January and July of each year.
C.
If the owner of a building fails, neglects or refuses to obtain an
inspection of any elevator therein contained, the Commissioner of
the Department of Buildings of the Town of Hempstead shall be authorized
to cause said inspection to be made at the expense of the owner of
the building.
An inspection report relating to passenger or freight elevators
shall indicate that the elevator is in proper working condition and
complies with the regulations and standards applicable to elevators
as prescribed in the New York State Construction Code and generally
accepted trade standards.
A passenger elevator car shall be equipped with a mirror in
the rear of same in order to make the interior thereof visible prior
to a person's entry into the elevator car. Said mirror shall
be convex and no less than eight inches in diameter.
A.
After any elevator has been inspected and is found to conform with
the requirements of this chapter, a record shall be made on a card
provided by the Department of Buildings of the Town of Hempstead and
thereafter posted in the elevator car which has been inspected and
approved. It shall be unlawful to remove or deface said card.
B.
If any elevator fails to meet the specifications for the safe operation
thereof, the inspector shall issue an order that further operation
of said elevator shall be suspended until such time as
the unsafe condition is remedied.
The fee for each elevator inspection made by the Commissioner of the Department of Buildings of the Town of Hempstead or his authorized representative shall be as prescribed in § 86-11DD of the Code of the Town of Hempstead.
Any person who knowingly and willfully violates any provision
of this chapter or who violates or fails to comply with any order
or requirement of an inspector or other officer charged with the duty
of inspecting elevators shall be guilty of an offense punishable by
a fine of not more than $500 or by imprisonment for not more than
15 days.
