There is hereby created and established the office of the Warminster
Township Fire Marshal. The office shall consist of the Fire Marshal,
his duly appointed Deputies, and any other person who may from time
to time be authorized to act on behalf of the Fire Marshal by the
Fire Marshal or the Board of Supervisors.

1. The Supervisors of Warminster Township shall, by resolution, appoint
a qualified person to be the Fire Marshal of Warminster Township.
2. The Township Fire Marshal shall be a salaried employee. The Fire
Marshal's salary shall be determined by the Board of Supervisors.
He/she shall receive reimbursement for all necessary expenditures
incurred in the operation of the office and in the fulfilling of the
duties as set forth in this Part 1D and in the Township Fire Code.

The Fire Marshal shall have the rights and duties as both Fire
Code Official and Fire Chief, as set forth in the Fire Code enacted contemporaneously herewith. The Fire Marshal shall
have full authority to inspect all premises for the existence of fire
hazards, to order the abatement of the same, and to proceed in accordance
with the Fire Code in order to eliminate such hazardous conditions.
The Fire Marshal shall have authority to inspect all premises on which
fires have occurred and to investigate the same in order to determine
the origin and cause.
A. Establishment of fire zones and fire lanes on private property devoted
to public use.
(1) In addition to the provisions set forth in the Fire Code, the Fire
Marshal shall have the power to restrict and regulate the parking
of motor vehicles on all parking lots and parking areas adjacent to
public buildings for the purpose of providing proper egress of occupants
and ingress of emergency equipment such as fire, ambulance and police
in the event of an emergency.
(2) It shall be unlawful for any person to have standing, stopped or
parked a motor vehicle of any type whatsoever in an area adjacent
to a public building whenever such particular area has been designated
a fire lane or fire zone and official signs that notify the public
have been erected or posted at such area.
B. Establishment of motor vehicle routes for vehicles transporting explosives
and blasting agents. Vehicles transporting explosives shall avoid
congested traffic and densely populated areas. Designated routes may
from time to time be designated by the Fire Marshal for such vehicles.
C. Establishment of motor vehicle routes for vehicles transporting hazardous
chemicals or other dangerous articles.
(1) The transportation of hazardous chemicals and other dangerous articles
by motor vehicles shall comply with PennDOT regulations.
(2) Owners of vehicles involved in interstate shipments shall obtain
a permit to transport hazardous chemicals and other dangerous articles
on designated routes within the Township. Such applications shall
certify that said vehicles meet all applicable PennDOT regulations.
Owners of vehicle(s) involved only in interstate shipments and complying
with PennDOT regulations shall register with the Township and Fire
Marshal for the purpose of assuring due notification and use of officially
designated routes, approved stopping and parking places and the inspection
stop.

Any person, firm or corporation who shall violate any provision
of this Part 1D, upon conviction thereof in an action brought before
a Magisterial District Judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not more than $1,000, plus costs,
and, in default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this Part 1D continues
or each section of this Part 1D which shall be found to have been
violated shall constitute a separate offense.
