Pursuant to Subdivision 1 of § 122 of the Agriculture
and Markets Law, the County of Saratoga, by its Board of Supervisors,
does hereby order that henceforth during the period December 1 to
May 1 of the following year, all dogs in the County of Saratoga shall
be securely confined or accompanied by or under the control of each
dog's owner.
The Clerk of this Board of Supervisors shall publish a public
notice of this order adopted for the protection of deer in The Saratogian,
The Schenectady Gazette, The Ballston Journal, The Troy Times Record,
The Glens Falls Post Star and the Times Union.
The Clerk of this Board shall file a copy of this resolution
in the Office of the Clerk of each municipality in the County of Saratoga.

The purpose of this article is to authorize the licensing of
dogs at the Saratoga County Animal Shelter, as authorized by § 109(3)
of the Agriculture and Markets Law of the State of New York.
As used in this article, the following terms shall have the
meanings indicated:
Delivery by the Saratoga County Animal Shelter to any natural
person 18 years of age or older, for the limited purpose of harboring
any dog in the custody of the animal shelter as a result of seizure
or surrender.
A tag issued by Saratoga County which sets forth an identification
number, the name of the municipality in which the dog will be harbored,
the State of New York, contact information, including telephone number
for the municipality in which the dog will be harbored, and such other
information as Saratoga County deems appropriate.
Any county, town, city or village.
Any person who harbors or keeps a dog.
The Saratoga County Board of Supervisors hereby authorizes the
Saratoga County Animal Shelter, acting by its Supervisor, to provide,
accept and grant an application for a dog license at the time of the
adoption of a dog from the Saratoga County Animal Shelter, provided
that such application is made in accordance with this article.
A.
Any person adopting a dog from the Saratoga County Animal Shelter
shall make application for and receive a dog license prior to removing
the dog from the Saratoga County Animal Shelter. The license shall
be issued for a period of one year. Subsequent renewals of the license
shall be done by the municipality within which the dog is harbored.
B.
Application for a dog license shall be made to the Supervisor of
the Saratoga County Animal Shelter.
C.
The application shall be on a form designated for such purpose by
Saratoga County. It shall state the sex, actual or approximate age,
breed, color and an identification number to be assigned by the Saratoga
County Animal Shelter, and any other identification marks, and the
name, address, telephone number, state, county and town, city, or
village of residence of the applicant.
D.
The application shall be accompanied by the license fee prescribed
in this article, as modified as hereinafter provided. In the case
of a dog which has been spayed or neutered, the application shall
also be accompanied by a certificate signed by a licensed veterinarian
or affidavit signed by the owner, showing that the dog has been spayed
or neutered.
E.
Upon validation by the Supervisor of the Saratoga County Animal Shelter,
the application shall become a license for the dog described therein.
F.
The Supervisor shall:
(1)
Provide a copy of the license to the owner;
(2)
Retain a record of the license that shall be made available upon
request to the Commissioner of the New York State Department of Agriculture
and Markets; and
(3)
Send, within five business days of validation, a copy of the license
to the municipality in which the dog will be harbored.
G.
The license shall not be transferable.
H.
If the dog has not been vaccinated for rabies by the Saratoga County
Animal Shelter, the applicant shall present a statement certified
by a licensed veterinarian showing that the dog has been vaccinated
for rabies and the date of said vaccination. The Supervisor shall
send a copy of proof of rabies vaccination with the copy of the license
to the municipality in which the dog will be harbored.
A.
Each dog licensed pursuant to § 143-7 of this article shall be assigned an identification number, which shall be carried by the dog on an identification tag issued by the Saratoga County Animal Shelter which shall be affixed to a collar on the dog at all times.
B.
No tag carrying an identification number shall be affixed to the
collar of any dog other than the one to which that number has been
assigned.
The date upon which the Saratoga County Animal Shelter shall
begin to issue dog licenses pursuant to this article shall be January
1, 2011.
