Certain words and terms used in this chapter are defined for the purposes thereof as follows:
A. 
Terms. The present tense shall include the future; the singular number shall include the plural; and the plural the singular. The word "shall" is always mandatory.
B. 
Definitions. As used in this chapter, the following terms shall have the meanings indicated:
AGRICULTURE
The production of crops or plants or vines and trees.[1]
ALLEY
A public way having a right-of-way width of 20 feet or less.[2]
ANIMAL HUSBANDRY
The keeping, grazing, feeding and care of animals other than household pets, hens and honeybees. The term "animal husbandry" shall not be construed to include breeding, fur farms, pig farms or cage-type poultry houses or the keeping of roosters, which is prohibited in the Village.
APARTMENT
A dwelling unit located on a second or third floor of a commercial or mixed-use building in the GB, NMU or GWB Districts. The dwelling shall provide complete housekeeping facilities for one family, including independent cooking, bathroom and sleeping facilities, and shall have a minimum of 600 square feet of habitable floor area. An apartment may be permitted in the rear portion of the first floor of a building, not to exceed 50% of the gross floor area of the first floor, provided that such apartment is designed to be ADA accessible.

AREA, BUILDING
The total of areas taken on a horizontal plane at the grade level of the principal building and all accessory buildings exclusive of uncovered porches, terraces and steps. All dimensions shall be measured between the exterior faces of walls.
AREA, LAND
When referring to the required area per dwelling unit, shall mean "net land area," the area exclusive of streets and other public open space.[3]
AUTOMOBILE LAUNDRY
An establishment for the washing of motor vehicles as a principal use.
AUTOMOBILE SALES AREA
A premises, including open areas, other than a street or way, and showrooms enclosed within a building used for the display or sale of new or used automobiles, trucks, cargo trailers and boats.
AUTOMOBILE WRECKING and/or AUTOMOBILE GRAVEYARDS
The dismantling, wrecking or burning of used automobiles or the storage, sale or dumping of dismantled, partially dismantled or wrecked vehicles or their parts.
BAR
An establishment licensed under the laws of New York State for the sale of alcoholic beverages and their consumption on the premises.
BASEMENT
A story partly underground by having at least 1/2 of its height above the average outside ground level.
BED-AND-BREAKFAST
Limited to maximum six-room rental, with one parking space per room and one for every two employees and no other meals besides breakfast for guests.
BLOCK
The length of a street between two street intersections. Where street intersections are at intervals greater than 1,200 feet, 1,200 feet shall be considered the length of block for purposes of this chapter.[4]
BOARDINGHOUSE and/or ROOMING HOUSE
A dwelling, other than a hotel or motel, wherein three of more people are sheltered and/or fed for profit.
BUILDING
Any structure constructed or used for residence, business, industry or other public or private purposes or accessory thereto, including tents, lunch wagons, dining cars, mobile homes, billboards, signs and similar structures, whether stationary or movable. Carports, roofed porches, roofed enclosures for animal husbandry or hens, and terraces shall be considered to be buildings.

BUILDING, ACCESSORY
A building, the use of which is customarily incidental to that of a principal building and which is located on the same lot as that occupied by the principal building.
BUILDING, ACCESSORY USE OF
A use customarily incidental to the use of a principal building, not occupying more than 25% of the total aboveground floor area of the principal building thereof and including:
(1) 
The office or studio of a physician or surgeon, dentist, accountant, artist, musician, lawyer, architect, engineer, teacher, insurance agent, realtor or other such professional person residing on the premises, provided that there is no advertising display visible from the street, other than a small professional name plate. The above shall not be interpreted to include the office or place of business of a mortician.
(2) 
Customary home occupations, as defined herein, provided that:
(a) 
There is no display of goods visible from the street;
(b) 
There is no exterior advertising; and
(c) 
Such occupation is conducted in the main building by a person or persons residing therein.
BUILDING, ALTERATION OF
Any addition to a building, a change or rearrangement in the structural parts or exit facilities, or any change in the use from one district classification to another, or removal of a building from one location to another.
BUILDING, HEIGHT OF
The vertical distance measured from the average elevation of the finished lot grade at the front of the building to the roof to the deck line of a mansard roof; and to the mean height level between the eaves and ridge of a gable, hip or gambrel roof.[5]
BUILDING LINE, FRONT
The line of that face of a building nearest the street line. In the case of a corner lot, any building line nearest to a street line shall be considered a front building line.[6]
BUILDING, PRINCIPAL
A building, including covered porches, in which is conducted the principal use of the lot on which it is situated. In any residence district, any dwelling shall be deemed the principal building on the lot on which it is situated.
BUILD-TO LINE
The line at which construction of a building facade is to be placed on a lot. A build-to line runs parallel to, and is measured from, the front property line and is established to create a continuous (or more or less even) building facade on a street.

BUS PASSENGER SHELTER
A one-story structure not more than 50 square feet in area to provide shelter at school bus and other bus stops.
CARNIVAL
An amusement show, usually traveling from place to place having sideshows, Ferris wheels, merry-go-rounds, etc.
CELLAR
A portion of a building having more than 1/2 of its height below the average outside ground level.
CEMETERY
Land used or intended to be used for the burial of dead human beings and dedicated for cemetery purposes, including columbariums, crematories, mausoleums and mortuaries when operated with and within the boundary of such cemetery.
CENTER LINE OF STREET OR ROAD
A line midway between and parallel to two street or road property lines or as otherwise defined by the Planning Board.
CHARACTER (ARCHITECTURAL, LANDSCAPE, ETC.)
Attributes or features that make up and distinguish the neighborhood or zone, as defined and interpreted by the Planning Board.
CHILD-CARE FACILITY
A commercial establishment designed to provide daytime care or instruction for six or more children under the age of 12 and operated on a regular basis.

CHURCH OR OTHER PLACE OF WORSHIP
A building for public worship.
CIRCUS
An exhibition of wild animals, acrobatic feats, together with sideshow and vending concessions.
CIVIC BUILDINGS
Buildings, structures and uses owned and operated by the Village, school district or fire district and regularly used for offices, municipal operations, district operations or public assembly. These buildings shall include, but not be limited to, schools, churches and local government administration buildings.

CLINIC, DENTAL
A structure designed for the practice of dentistry by two more dentists in which nonresident patients are treated.
CLINIC, MEDICAL
A structure designed for the practice of medicine by two or more physicians in which nonresident patients are treated.
CLUB, HEALTH AND FITNESS
A commercial establishment open to the public for a fee that provides services and facilities for physical fitness training, which includes, but is not limited to: swimming, handball and racket sports spas, clubs and other similar facilities featuring exercise or other active physical conditioning. Such uses may include the sale of necessary equipment used in the activities provided.
CLUBHOUSE
A building to house a club or social organization not conducted for profit and which is not an adjunct to or operated by or in connection with a public tavern, cafe or other public place.
COMMERCIAL DAY CARE
A facility operated on a regular basis for a fee for care of children as defined in Social Services Law § 390. Commercial day care shall not provide any facilities for overnight accommodations, and shall be located only in a district where specifically permitted by the Village Zoning Chapter.

CONNECTOR
A minor connecting structure, whose primary facade is set back from the facade of the two buildings to be connected. The connector shall have a height lower than the two buildings to be connected and have a footprint of no more than 500 square feet.

CONSTRUCTION, FIRE RESISTANT
That type of construction in which the walls, partitions, columns, floor and roof are noncombustible, with sufficient fire resistance to withstand the effects of a fire and prevent its spread from story to story.
COURT
An unoccupied open space, other than a yard. An "outer court" is one that extends to the street or to the front or rear yard. An "inner court" is any other court.
COVERAGE
The percentage of the lot covered by the building area, provided that in the NMU District, coverage shall be the percentage of the area of any lot physically covered or occupied by the combined footprint of all structures and impervious surfaces.

CURB LEVEL
The officially established grade of the curb in front of the midpoint of the lot.
DAY-CARE FACILITY
An umbrella term which includes both "child-care facility" and "family day-care home" facilities.

DELICATESSEN
An establishment whose principal business is the preparation and retail sale of prepared foods, such as cooked meets, salads, relishes, preserves, beverages and ready-to-eat items to be consumed on or off premises. Consumption within building is secondary to the primary retail business. A fast-food restaurant shall not be considered a delicatessen.

DORMITORY

DRIVE-THROUGH WINDOW
A facility that permits customers to obtain goods and/or receive services while they remain in their vehicles.

DRIVEWAY
Land situated on a lot used or intended to be used to provide access to it by vehicular traffic.[7]
DUMP
Land used for the disposal by abandonment, dumping, burning or any other means, and for whatever purpose, of garbage, sewage, trash, refuse, junk, discarded machinery, vehicles or parts thereof, or waste material of any kind.
DWELLING
A house or other building designed or used primarily for human habitation. The word "dwelling" shall not include tourist homes, motels, hotels or other structures designed for transient residence. Cellars, basements and buses are not construed to be dwellings.
DWELLING, ACCESSORY
A dwelling unit on a residential property which is subordinate to the principal one-family dwelling in terms of size, location and appearance and provides complete housekeeping facilities for one family, including independent cooking, bathroom and sleeping facilities, with physically separate access from any other dwelling unit or use. Such unit may be located within the single-family home or within a detached structure, subject to the requirements of § 200-19.

DWELLING, MULTIFAMILY
A dwelling or group of dwellings on one lot containing separate dwelling units for three or more families. A multifamily dwelling may have joint services or facilities or both and is subject to the provisions of § 200-31.

DWELLING, ONE-FAMILY
A detached building designed for the use of a single household, including one or more persons living as a family, and wherein not more than two boarders are sheltered and/or fed for profit.
DWELLING, ROW HOUSE or TOWNHOUSE
A dwelling accommodating or designed to accommodate a single family in a single dwelling unit, the walls on two sides of which may be in common with the wall of adjoining dwellings and are party or lot line walls.
DWELLING, TWO-FAMILY
A structure containing two dwelling units, not including a one-family dwelling with an accessory dwelling.

DWELLING UNIT
Any dwelling or portion thereof used or intended to be used by one family and providing complete housekeeping facilities thereof. A cellar may not be occupied as a dwelling unit.
EDUCATIONAL INSTITUTION
A college or university giving general academic instruction. Included within this term are areas or structures used for administration, housing of students and faculty, dining halls and social or athletic activities, when located on the institution's land that is not detached from land where classroom facilities are maintained.
EV CHARGING STATION
A parking space served by equipment which transfers power to the batteries on board an electric vehicle.

FACTORY
A building or group of buildings, usually with equipment, where goods are manufactured.
FAIR
An occasional or periodic competitive exhibition of farm products and livestock, usually accompanied by amusement features, and for which an admission fee is charged.
FAMILY
One or more persons occupying a premises and living as a single nonprofit housekeeping unit, provided that, unless all members are related by blood, marriage or adoption, no single housekeeping unit shall contain more than five members.
FAMILY DAY-CARE HOME
A private residence where a certified resident provides daily care services for up to six children under the age of six.
FARM
Any tract of land comprising three or more acres on which agricultural products, animal products or animal increase with a value of $150 or more are produced annually. It excludes fur farms, pig farms, cage-type poultry houses, public stables and dog kennels.
FARM HOUSE
The principal building used as a dwelling on any tract of land classified as a farm.
FAST-FOOD RESTAURANT
Establishment whose principal business is the sale of pre-prepared or rapidly prepared food in disposable packaging, directly to the patron in a ready to consume state for consumption either on or off premises. A delicatessen or bakery shall not be considered a fast-food restaurant.

FENCE
An architectural and/or garden structure used as a barrier (i.e., to screen parking, refuse containers, etc.), boundary or enclosure.

FLOOR AREA (OF A BUILDING)
The sum of the gross horizontal area of the several floors, including the basement of a building and its accessory buildings on the same lot, and including the area of roofed porches and roofed terraces. All dimensions shall be measured between the exterior faces of walls.
FLOOR AREA RATIO
The floor area of a building divided by the area of the lot which it occupies.[8]
FOOTPRINT
Area of the horizontal plane calculated at a height of one foot above the first floor elevation. The calculation shall use dimensions as measured from the exterior face of the exterior walls. Unenclosed porches and building envelope projections of two feet or less, such as bay/bow windows and cantilevered extensions, shall not be included in the calculation.

GARAGE, PRIVATE
A garage not conducted as a business or used for the storage space for more than one commercial vehicle which shall be owned by a person residing on the premises.
GARAGE, PUBLIC
A garage conducted as a business. The rental of storage space for more than two passenger cars or for one commercial vehicle not owned by a person residing on the premises shall be deemed a business use.
GRADE, ESTABLISHED
The elevation of the center line of the streets as officially established by the municipal, county or state highway authorities.
GRADE, FINISHED
The completed surfaces of lawns, walks and roads brought to grades as shown on official plans or designs relating thereto.
GREEN GROCER
A retail business in which foodstuffs and household supplies are sold, but the primary focus is the sale of fresh produce. The scale of the business is geared to provide service to the neighborhood.

HABITABLE FLOOR AREA
The total of the floor areas of all stories contained within the inside walls of a dwelling unit, excluding any garage, carport, porch, veranda, unfinished attic, unfinished basement and excluding public or common halls or stairways.

HEN
A female domestic chicken (Gallus gallus domesticus). Roosters and other types of domestic fowl are intentionally excluded from this definition.

HOME OCCUPATION
An occupation or a profession which:
(1) 
Is customarily carried on in a dwelling unit or in a building or other structure accessory to a dwelling unit;
(2) 
Is carried on by a member of the family residing in the dwelling unit; and
(3) 
Is clearly incidental and secondary to the use of the dwelling unit for residential purposes.
HOME, TOURIST
A dwelling in which overnight accommodations are provided for not more than 10 transient paying guests.
HONEYBEE
A domesticated winged insect that collects pollen and nectar and produces honey (Apris Melliferra).

HOSPITAL
An establishment for temporary occupation by the sick or injured for the purpose of medical diagnosis and treatment, including sanitaria, and shall be limited to the treatment or other care of humans.
HOSPITAL, ANIMAL OR VETERINARY CLINIC
An establishment for temporary occupation by sick or injured animals for the purpose of medical diagnosis and treatment and shall exclude the treatment or other care of humans.
HOTEL
A building or group of buildings in which there are 12 or more rental sleeping rooms and which may also include dining rooms, kitchens, serving rooms, ballrooms and other facilities and services intended primarily for the accommodation of its patrons.
HOUSEHOLD PETS
Dogs, cats and similar small animals typically kept in a household. The term does not include chickens and other fowl, pigs, goats, sheep, cows, deer, horses, mules, donkeys, Ilamas, alpacas, livestock and other animals typically associated with farming and animal husbandry.

INDUSTRY, MANUFACTURING
Includes those activities described under Code Nos. 4 and 5 in the Comprehensive Plan for the Village.
INDUSTRY, NONMANUFACTURING
Includes those activities described under Code No. 6 in the Comprehensive Plan for the Village (except junkyards and scrap and waste wholesaling).
KENNEL
Any establishment, including cages, dog runs and structures, wherein more than three dogs which are over six months old are harbored.
LAUNDRY, COIN-OPERATED, DRY CLEANER
A business premises equipped with individual clothes washing and drying and/or cleaning machines for the principal use of retail customers.
LIVE-WORK UNIT
A unit containing both residential and working space with a minimum of 750 square feet, as well as a kitchen and sanitary facilities. There shall be an interior connection between the work area and the living area. There shall be no hazardous materials contained in the work space that are not commonly contained in and associated with a residential space. The business/work space shall not be rented separately from the residential/living space. No one other than the business owner or family shall reside in the live-work unit. The live-work unit shall be in full conformance with the applicable codes for the activity conducted in the unit.

LOT
A piece, parcel or plot of land occupied or designed to be occupied by a principal building and its accessory building or buildings and including the yards and other open spaces required by this chapter.
LOT, CORNER
A lot which has an interior angle of less than 135° at the intersection of two street lot lines. A lot abutting upon a curved street or streets shall be considered a corner lot if the tangents to the curve at points beginning within the lot or at the points of intersection of the side lot lines with the street line intersect at an interior angle of less than 135°.
LOT, DEPTH
The horizontal distance from the street line of the lot to its opposite rear line measured along the median between the two side lot lines.
LOT, INTERIOR
A lot other than a corner lot.
LOT LINES
The lines that bound a lot as defined herein.
LOT OF RECORD
Any lot which has been established as such by plot, survey, record or deed prior to the date of this enactment as shown on the records of the Dutchess County Clerk's Office.
LOT, THROUGH
An interior lot having frontage in two parallel or approximately parallel streets.
LOT WIDTH
The distance between the side lot lines measured along the front building line as determined by the front yard requirement prescribed by this chapter.
MAJOR EXCAVATION, GRADING OR FILLING
Any operation (other than in connection with foundations for a structure or highway construction) involving:
(1) 
A volume of earth movement exceeding the average of one cubic foot per square foot of lot area or 1,000 cubic yards, whichever is the lesser; or
(2) 
A change in ground elevation from the previously existing grade exceeding 10 feet.
MEMBERSHIP CLUBS
Premises devoted exclusively to use by an organization's members and their guests, for social, recreational and/or athletic purposes, not conducted primarily for gain, and not including any vending stands, merchandising or commercial activities, except incidentally for the convenience of the membership.

MONUMENT
A municipal memorial stone or structure created in remembrance of a person or event.

MOTEL or MOTOR COURT
A public inn containing not less than eight rental units with provisions for, but not limited to:
(1) 
Automobile parking space to accommodate not less than one car per unit; and
(2) 
Separate toilet facilities and hot and cold running water for each rental unit.
MOTOR FREIGHT TERMINAL
Any premises used by a motor freight company regulated by the Public Service Commission of New York and/or the Interstate Commerce Commission as a carrier of goods, which is the origin and/or destination point of goods being transported for the purpose of storing, transferring, loading and unloading such goods.
MOTOR VEHICLE SERVICE STATION
Any area of land, including structures thereon, that is used for the sale of gasoline or any motor vehicle fuel, oil or any other lubricating substances, sale of motor vehicle accessories, and which may include facilities for lubricating, washing or otherwise servicing motor vehicles, but not including the painting thereof by any means, body and fender work, or the dismantling or replacing of engines, and including associated retail/commercial businesses, whether or whether not located on the same parcel, including structures thereon that are used for the sale of snacks, dairy products, alcoholic and nonalcoholic beverages, prepared foods, produce, groceries, dry goods and clothing.

NEIGHBORHOOD GROCERY
A retail business in which foodstuffs and household supplies are sold. The scale of the business is geared to provide service to the neighborhood.[9]

NURSING OR CONVALESCENT HOME
Any establishment where persons are housed or lodged and furnished with meals and nursing care for hire.
OCCUPANCY
The utilization of a building, structure or land.
OCCUPANCY, SEASONAL
Occupancy for a period not exceeding four months during any one calendar year.
OFFICIAL MAP, VILLAGE
A map adopted by the Board of Trustees pursuant to the provisions of § 7-724 of the Village Law and which may be, or may have been, revised according to the provisions of § 7-724 of the Village Law which shows streets, highways and parks theretofore laid out, adopted and established by law and which may show drainage systems.
OPEN SPACE
An unoccupied space open to the sky required by the terms of this chapter.
PARK
A tract of land, including lawns, woodlands, pastures or an area maintained in its natural state as a public property for use as a preserve or for recreation.

PATTERN BOOK
The Village of Red Hook Pattern Book and Architectural Guidelines, dated May 20, 2013, prepared by the Village of Red Hook Pattern Book and Architectural Guidelines Committee, and any subsequent editions of the same, a copy of which shall be available for purchase or for inspection at the office of the Village Clerk.[10]

PERSONAL SERVICE ESTABLISHMENT
An establishment which provides work done or duties performed of a personal nature, including, but not limited to, barbershops, beauty parlors, tailors, dressmakers and shoe repair.

PET GROOMING
A service business providing grooming and/or maintenance of domestic household animals, where a maximum of three animals may be kept on the premises for a period not to exceed 24 hours.

PORCH, OPEN
A porch open on three sides, except for wire screening. A porch shall not be considered open if enclosed by either a permanent or detachable glass sash. A structure having a driveway running to it, under it or through it shall not be considered to be an open porch.
RESTAURANT
Premises where food and beverages are commercially sold for consumption on premises to patrons seated at tables or counters and where table service is provided. Any facility not providing table service or a parking lot for customers, where the food is to be eaten outside the principal structure, on or off the premises, shall be considered a drive-in or fast-food restaurant.

RIDING ACADEMY
Any establishment where horses are kept for riding, driving or stabling for compensation or incidental to the operation of any club, association, ranch or similar establishment.
ROADSIDE STAND
A stall or booth for business which shall be limited to the sale of farm products produced on the premises.
SALESROOM OR SHOPS OF A BUILDER, CONTRACTOR OR ARTISAN
A place where no more than five artisans, woodworkers, metalsmiths or other craftpersons engage in the manufacture of specialty items, art or goods and which includes a showroom or retail space open to the public.

SANITARIUM or SANITORIUM
A private hospital, whether or not such a facility is operated for profit.
SATELLITE DISH ANTENNA
Any device designed for the reception of electromagnetic energy signals from an orbiting satellite.
SCHOOL, ELEMENTARY
Any school having regular sessions with regularly employed instructors who teach those subjects that are fundamental and essential in general education under the supervision of the State of New York or a lawfully constituted ecclesiastical governing body or a private corporation meeting the requirements of the state.
SCHOOL, SECONDARY
Same meaning as "elementary school," except secondary education is provided.
SCHOOL, VOCATIONAL
Any school having regular sessions with regularly employed instructors who, as a principal activity, provide training in a trade or vocation and teach those subjects that are fundamental and essential in elementary or secondary education, under the supervision of the State of New York or a lawfully constituted ecclesiastical governing body, or a corporation meeting the requirements of the state.
SENIOR HOUSING
A residential building which is occupied by single individuals 55 years of age or older, or married couples, at least one of whom in 55 years of age or older.

SERVICE BUSINESS
A business or nonprofit organization that provides services to the public, either on or off premises, including, but not limited to, building, electrical, plumbing and landscape contracting; business and educational services; catering; computer services; photocopying; repair and restoration services; and tailoring.
SEWER, PUBLIC
A sewer connected to a municipal sanitary sewer system or a sanitary sewer connected to a nonmunicipal sanitary sewer system, the construction plans and plans for the operating of which shall be approved by the Dutchess County Department of Health. Any facility which provides for the disposal of sanitary sewage on a lot occupied by a principal or accessory building or structure other than a sewage disposal plant shall not be deemed a public sanitary sewer system.
SHED
A temporary or permanent structure for accessory storage or animal husbandry, not to exceed 100 square feet of floor space and eight feet in height, and not to be used as a residence. The term "shed" does not include a shipping container or truck body.

SIGN
Any structure or part thereof, attached thereto or painted or represented thereon which shall display or include any letter, word, model, banner, flag, pennant, insignia, color or architectural element meant to signify or represent the corporate or business identity, but not including the flag, pennant or insignia of any nation, state, city or other political unit, of any political, educational, charitable, philanthropic, civic, professional, religious or like organization on the property thereof.
SIGN, BUSINESS
A sign which directs attention to a business, profession or industry located on the premises where the sign is displayed to the type of products sold, manufactured or assembled and/or to service or entertainment offered on said premises.
SIGN, FARM PRODUCTS
A sign advertising the sale of farm products raised on the premises.
SIGN, IDENTIFICATION
A sign used to identify the individual or organization occupying the premises or the name of the building or structure in connection with which the sign is displayed.
SIGN, REAL ESTATE
A sign advertising property on which it is located, or a building thereon, for sale, rent or lease.
SIGN, WINDOW
A sign placed within two feet of glass or other translucent material and clearly meant to communicate with viewers outside the building.

STABLE, PRIVATE
An accessory building in which horses are kept for the private use and not for hire, remuneration or sale.
STABLE, PUBLIC
A building in which horses are kept for remuneration, hire or sale.
STORAGE, OPEN
Land used for the keeping of goods, wares or supplies on land outside of any building or structure. This, however, shall not be construed as including the activities of a junkyard as defined herein.
STORY
That part of a building, other than a cellar floor, included between any floor and the floor or roof next above.
STREET
Any public way dedicated to public travel greater than 20 feet in width.
STREET LINE
The right-of-way line of a street as indicated by dedication or by deed of record.
STRUCTURE
Anything constructed or erected, the use of which requires location on the ground or attachment to something having location on the ground.
STRUCTURE, ALTERATION OF
Any addition to a structure, a change or rearrangement in the structural parts or any change in use from one district classification to another or removal of a structure from one location to another.
STRUCTURE, NONCONFORMING
A structure lawfully existing prior to and at the time of the adoption or amendment of this chapter that does not conform with the permitted bulk coverage and yard provisions of this chapter as they apply to the district in which the structure is located.

SWIMMING POOL
Any body of water (excluding natural bodies of water fed by rivers, streams, brooks or springs) or receptacle for water having a depth at any point greater than two feet and used or intended to be used for swimming or bathing, and constructed, installed or maintained in or on the ground outside any building.
TAVERN
See "bar."
THEATER
A building or part of a building devoted to presenting entertainment on a paid admission basis.
THEATER, DRIVE-IN OUTDOOR
Open land with its appurtenant facilities devoted to the showing of motion pictures to patrons seated in automobiles.
TOURIST HOME
See "home, tourist."
TOWNHOUSE
A one-family dwelling in a row of at least three such units in which each unit has its own front and rear access to the outside, no unit is located over another unit, and each unit is separated from any other unit by one or more common fire-resistant wall(s).

TRAILER, BOAT
A vehicle designed exclusively for the transportation of one boat of less than ten-foot beam and twenty-four-foot length.
TRAILER, CAMP OR TRAVEL
A vehicle or portable structure not over 256 square feet in floor area, equipped but not regularly used for sleeping but which may not have sanitary facilities.
TRAILER, CARGO
A vehicle, not over 70 square feet in floor area, used for the hauling of cargo.
USE
The specific purpose for which land or a building is designed, arranged or intended, or for which it is or may be occupied or maintained. The term "permitted use" shall not be deemed to include any nonconforming use. Except as specifically permitted, only one principal use shall be allowed per lot (see § 200-7E).
USE, ACCESSORY
A use which is customarily incidental to and subordinate to the principal use of a premises, building or structure and located on the same premises as the principal use, building or structure.
USE, NONCONFORMING
An established use of a building or structure or use of land lawfully existing prior to and at the time of the adoption or amendment of this chapter that does not conform with the permitted use provisions of this chapter as they apply to the district in which the building, structure or land is located.
VIDEO RENTALS OR SALES
A retail operation involving video tapes and associated paraphernalia (e.g., carrying cases and players), but not including sales of video cassette recorders, cameras and other basic equipment.
YARD
An unoccupied space open to the sky on the same lot with a building or structure.[11]
YARD, FRONT
An open space extending across the entire width of the lot between the front building line or front main wall of a building and the front property line (street or road right-of-way line).[12]
YARD, REAR
An open space extending across the entire width of the lot between the rear line of the lot and a line parallel to the rear line of the lot at a distance from the rear line of the lot specified for the zoning district in which the lot is situated.[13]
YARD, SIDE
An open unobstructed space on the same lot with a principal building between the principal building and the side line of the lot and extending through from the front yard to the rear yard.[14]
