Post-construction sites shall meet the total suspended solids reduction, peak flow control and other requirements in accordance with the provisions of Chapter 325, Erosion Control and Stormwater Management, of this Code. This section shall also apply to the use of lands subject to extraterritorial land division review, provided that such lands drain toward or across lands laying within the City or City Growth Area.
The City Council shall hear and decide where it is alleged that there is error in any order, requirement, decision or determination made by the City Engineer in administering this article. The City Council may authorize upon appeal in specific cases such variance from the terms of this article as will not be contrary to the public interest where, owing to special conditions, a literal enforcement of the provisions of this article would cause an undue hardship. Appeals may be taken by any person aggrieved or by any officer, department or board of the City affected by the order, requirement, decision or determination made by the City Engineer. Such appeals shall be filed with the City Clerk within 30 days after the date of the written notice of the decision or order of the City Engineer.
