A. 
Individual sewage disposal systems or other means of private sewage disposal shall not be approved where a sanitary sewer is available within 100 feet of a property line of a commercial property.
B. 
Individual sewage disposal systems or other means of private sewage disposal shall not be approved where a sanitary sewer is available within 50 feet of a property line of a residential property.
Any person violating any of the provisions of or any order promulgated under this article shall, upon conviction thereof, be punishable by one or more of the following: a fine not to exceed $2,000, a term of imprisonment not to exceed 90 days or a period of community service not to exceed 90 days. Each day a particular violation continues shall constitute a separate offense.
