This chapter shall be known and may be cited as the "Village of Bath Manufactured Home Park Law."
Because of the special problems related to manufactured homes that are not necessarily associated with other housing types, it is necessary to provide for a separate standard for manufactured homes so as to promote the safety and health of the residents of manufactured homes and nearby residents, to encourage economical and orderly development of the Village, to promote the health, safety and general welfare and to eliminate and prevent health and safety hazards by providing standards and regulations necessary to accomplish these purposes as authorized under Article 7 of the Village Law of the State of New York.
A. 
Any person committing an offense against any provision of this chapter, shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
B. 
In addition, or as an alternative to the above provided penalties, the Board of Trustees may also maintain an action or proceeding in the name of the Village in a court of competent jurisdiction to compel compliance with or to restrain by injunction the violation of this chapter.
Should any provision of this chapter be in conflict with existing regulations applicable to the Village of Bath, the more restrictive shall apply.
As used in this chapter, the following terms shall have the meanings indicated:
AWNING
A shade structure supported by posts or columns and partially supported by a manufactured home installed, erected or used on a manufactured home lot.
CARPORT
An awning or shade structure for a vehicle or vehicles, which may be freestanding or partially supported by a manufactured home.
GARAGE
A one-story accessory building on the same lot as a manufactured home, of sufficient size to provide indoor parking for no more than two motor vehicles.
HEALTH AUTHORITY
A legally designated health authority or its authorized representative of the Village of Bath.
INTERNAL STREET
A private way which affords the principal means of access to abutting individual manufactured home lots and community service buildings.
LICENSEE
Any person licensed to operate and maintain a manufactured home park under the terms of this chapter.
MANUFACTURED HOME
A structure transportable in one or more sections that, in the traveling mode, is eight feet or more in width or 40 feet or more in length or, when erected on site, is 320 square feet minimum, and that was built on or after June 15, 1976, on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities and includes the plumbing, heating, air conditioning and electrical systems contained therein. The term "manufactured home" shall also include any structure that meets all the requirements of this definition except the size requirements and with respect to which the manufacturer voluntarily files a certification required by the federal department of housing and urban development and complies with the standards established under the national manufactured housing construction and safety act of 1974, as amended. The term "manufactured home" shall not include any self-propelled recreational vehicle.
MANUFACTURED HOME LOT
A designated portion of a manufactured home park designed for the accommodation of one manufactured home and its accessory buildings or structures for the exclusive use of the occupants.
MANUFACTURED HOME PARK
A plot of ground upon which two or more manufactured homes occupied for dwelling or sleeping purposes are located, regardless of whether or not a rental charge is made for the use of same.
MANUFACTURED HOME STAND
That part of an individual lot which has been reserved for the placement of the manufactured home, appurtenant structures or additions.
OCCUPIED LOT
A manufactured home lot with a manufactured home in place on the stand thereon.
PARK
A manufactured home park.
PERMIT
A written document issued by the enforcing agency permitting the construction, alteration or expansion of a manufactured home park.
PERMITTEE
Any person to whom a temporary permit is issued to maintain or operate a manufactured home park under the provisions of this chapter.
PERSON
Any natural individual, firm, trust, partnership, association or corporation.
