The sewer system of the sewer districts of the Town of Bath or the Village of Bath, New York, as constructed or as hereafter added to or changed, shall be under the charge and control of the respective sewer commissions under whose supervision the sewer systems shall be used by property owners. No person shall enter into, open or interfere with or use or do any repair or maintenance work with respect to said sewer systems except under the inspection and direction of the Sewer Commission and after a written permit shall have been issued by the Commission of the sewer district in which such entering, opening, use, repair or maintenance is to take place. The Sewer Commission shall adopt rules and regulations to govern the maintenance and use of the sewer systems and shall therein fix the amount of fees that shall be chargeable to persons or property owners who may wish to enter or use the sewer systems, which fee shall be sufficient in amount to pay for the cost of inspection of such entry or entries.
There shall be two classes of building sewer permits; for domestic waste service and for service to commercial and industrial wastes. The owner or his agent shall make application on a form furnished by the respective Sewer Commission. The permit application shall be supplemented by any plans, specifications or other information considered pertinent in the judgment of the Director. A permit fee in an amount fixed in the rules and regulations for the Sewer Commissions shall be paid at the time the application is filed.
Permits granted under this chapter shall be for a specific waste or wastes, and such permits shall be granted only after the submission and approval of plans as set forth hereinafter. Subsequent wastes of different quantity, quality or characteristics shall be covered by separate permits.
All costs and expenses incident to the installation and connection of the building sewer or lateral to the right-of-way line shall be borne by the owner. The owner shall indemnify the Sewer Commission from any loss or damage that may directly or indirectly be occasioned by the installation of the building sewer.
Every existing building which is the source of the heretofore described acceptable waste shall be provided with a separate and independent building sewer.
The size, slope, alignment and materials of construction of a building sewer and the methods to be used in excavating, placing of the pipe, jointing, testing and backfilling the trench shall all conform to the requirements of the Building and Plumbing Codes or other applicable rules and regulations of the Sewer Commission.
Whenever possible, the building sewer shall be brought to the building at an elevation below the basement floor. In all buildings in which any building drain is too low to permit gravity flow to the public sewer, sanitary sewage carried by such building drain shall be lifted by an approved means and discharged to the building sewer.
No person shall make connection of roof downspouts, exterior foundation drains, areaway drains or other sources of surface runoff or groundwater to a building sewer or building drain which in turn is connected directly or indirectly to a public sanitary sewer.
The connection of the building sewer to the public sewer shall conform to the requirements of the Building and Plumbing Codes or other applicable rules and regulations of the Sewer Commission. All such connections shall be made gastight and watertight. Any deviation from the prescribed procedures and materials must be approved by the Sewer Commission before installation.
The applicant for the building sewer permit shall notify the Director when the building sewer is ready for inspection and connection to the public sewer. The connection shall be made under the supervision of the Director or his representative.
All excavations for a building sewer installation shall be adequately guarded with barricades and lights so as to protect the public from hazard. Streets, sidewalks, parkways and other public property disturbed in the course of the work shall be restored in a manner satisfactory to the Village.
