This chapter is adopted under the authority granted by § 236.45, Wis. Stats.
The purpose of this chapter is to regulate and control the division of land within the Town in order to promote the public health, safety, morals, prosperity, aesthetics and general welfare of the community.
It is the general intent of this chapter to regulate the division of land so as to:
A. 
Lessen congestion in the streets and highways and further the orderly layout and appropriate use of lands and waters.
B. 
Secure safety from fire, panic, flooding and other dangers and provide adequate light and air.
C. 
Prevent the overcrowding of land and avoid undue concentration of population.
D. 
Facilitate adequate provision for transportation, water, sewage, drainage, schools, parks, playgrounds, and other public requirements.
E. 
Prevent scattered development beyond the service areas of community facilities and utilities.
F. 
Conserve the existing and potential value of land, water, air and improvements.
G. 
Provide the best possible environment for human habitation and meet the public demand for aquatic recreation with the least disturbance to shoreland owners.
H. 
Preserve shoreland growth and cover, prevent erosion and sedimentation and protect surface and subsurface water quality.
I. 
Provide for the further division of larger tracts into smaller parcels of land and ensure adequate legal description and proper survey monumentation of divided lands.
J. 
Provide for the administration and enforcement of this chapter and provide penalties for its violation.
K. 
Achieve the realization of those community development standards set forth in those comprehensive Town plans, county plans, regional plans, plan components, Zoning Code, Building Code and Official Map as may be adopted by the Town.
It is not intended by this chapter to repeal, abrogate, annul, impair, or interfere with any existing easements, covenants, agreements, rules, regulation or permits previously adopted or issued pursuant to laws. However, where this chapter imposes greater restrictions, the provisions of this chapter shall govern; and where other rules or chapters may impose greater restrictions, those provisions shall govern.
In their interpretation and application, the provisions of this chapter shall be held to be minimum requirements and shall be liberally construed in favor of the Town and shall not be deemed a limitation or repeal of any other power granted by the Wisconsin Statutes.
This chapter shall be known, referred to, or cited as the "Land Division Ordinance, Town of Oconomowoc, Waukesha County, Wisconsin."
