A.
The provisions of C.G.S. § 8-lc are hereby adopted and
are set forth herein.
B.
The following shall be the purposes for which this article is adopted:
(1)
To establish a schedule of reasonable fees for the processing of
applications by the Town of Old Saybrook Zoning Commission, Planning
Commission, Zoning Board of Appeals and Inland Wetlands Commission
pursuant to C.G.S. § 8-lc.
(2)
To provide for the adequate review of land use applications in accordance
with the size and complexity of the proposed land use development;
and
(3)
To establish an amended schedule of fees for land use applications
in order to fund the approximate actual municipal administrative costs
of reviewing, evaluating and processing land use applications, and
to insure that fees do not cause applicants to subsidize municipal
expenses which are not related to reviewing, evaluating and processing
such applications.
As used in this article, the following terms shall have the
meanings indicated:
Any application to a land use regulatory commission, including
but not limited to any of the following: amendment to the Zoning Map
or Zoning Regulations; amendment to the Subdivision Regulations; amendment
to Inland Wetland Regulations; special exception; site plan approval;
certificate of zoning compliance; subdivision or resubdivision; variance;
permit to conduct regulated activities; application to designate or
redesignate wetlands.
For the purposes of this article, Zoning Commission, Planning
Commission, Zoning Board of Appeals and Inland Wetlands Commission.
Includes all functions performed in connection with or association
with a land use application by the Zoning Commission, Planning Commission,
Zoning Board of Appeals and Inland Wetlands Commission.
A.
The fees set forth herein shall supersede any specific fees set forth
in the Connecticut General Statutes, any special act, municipal ordinance
and any fee set forth in the regulations of the above-referenced board
and commissions.
B.
Fees as set forth in this article are due and payable to the Town
of Old Saybrook upon submission of a land use application.
C.
A commission may require additional technical assistance, which term
shall also include legal assistance in evaluating an application submitted
to the commission in accordance with the regulations if it finds that
the nature and intensity of development may have a significant impact
on the site and its surrounding areas, or that an application to change
the Zoning Map or regulations of any land use commission may substantially
affect the regulated areas.
D.
The expense of the additional technical assistance shall be estimated
by the commission, based on a preliminary estimate prepared by a qualified
party or expert, and the estimated cost of reviewing the application
times 150% shall be paid by the applicant and deposited with the commission
or its designated agent. Such deposit shall be made prior to review
of the application and/or submission.
E.
Upon completion of the technical review and final action by the commission
on the application, the Town shall determine the costs incurred for
the review and refund the excess monies to the applicant. Applicants
shall not be responsible for costs incurred for technical assistance
which exceed 150% of the commission's estimate.

Flood hazard permit:

Not a substantial improvement (A or V Zones): $425.

New residential dwelling or detached structure, voluntary elevation
of an existing residential structure or residential dwelling classified
as a substantial improvement, includes initial plan review, one review
to address comments and two inspections (A Zones): $1,800.

Residential dwelling in the coastal high hazard area (new or substantial),
includes in initial plan review and one inspection (V Zones or A Zones
in LiMWA): $2,200.

Emails, calls, multiple plan revisions, inspections and other services
that exceed the application fee collected: actual cost.

Residential preapplication site visit and plan review.

Residential preconstruction verification elevation prior to framing:
actual cost.
[7]
Commercial, industrial or multifamily: actual cost.
(9)
Zoning Commission.
(a)
Site plan review, special exception, PRD, IHD or modification
(includes soil erosion and sedimentation control plan and coastal
site plan review): $240.
(c)
Certificate of zoning compliance (CZC) business package (combined
fee for new business fit-out CZC and sign CZC when both complete applications
are submitted concurrently: $40.

Plus state land use fee: $60.
(e)
Accessory apartment renewal (every five years): $50.
(f)
Temporary sign permit: no fee.
(g)
Outdoor seating renewal (annual): no fee.
A.
A commission may by resolution determine that an application fee
is not required in particular cases of resubmission of a disapproved
application or an application to revise an approved subdivision. In
cases where the plan changes are minor, insignificant or only technical
in nature, no fee will be charged. In cases where the changes are
major or significant, or require further technical and professional
review of the plan, a fee will be charged. In all cases, a fee will
be charged when a public hearing on the application is held by the
commission as required by law or at the commission's discretion.
B.
Boards, commissions and departments of the Town of Old Saybrook are
exempt from fee requirements.
