It is deemed vital to the health of the Borough of Bloomsbury to regulate the manner of collecting, removing and disposing of solid waste and to comply with the provisions of the County and State Sanitary Codes, the Mandatory Source Separation and Recycling Act (N.J.S.A. 13:1E-99.11 et seq.), recycling rules promulgated by the New Jersey Department of Environmental Protection (N.J.A.C. 7:26A-1.1 et seq.), the Hunterdon County Recycling Plan and this article implementing garbage and solid waste collection procedures and requirements within the Borough of Bloomsbury (hereinafter "Borough"), hereinafter referred to as "this article."
As used in this article, the following terms shall have the meanings indicated:
BULKY WASTE
Includes metal appliances, television sets, mattresses, large furniture, large trash and similar materials that are too large to be placed inside a standard garbage receptacle, not required to be recycled and which are accepted at the Borough's authorized solid waste disposal site. These items are not to be placed for regular solid waste collection.
COMMERCIAL, INDUSTRIAL AND INSTITUTIONAL ESTABLISHMENTS
All entities which operate or conduct any business whatsoever which cannot be included within the definitions of a residential property or multifamily housing complex. This includes mixed-use buildings and residential property which holds a home occupation permit.
DESIGNATED RECYCLABLE MATERIALS
Those materials designated within the Hunterdon County District Solid Waste Management Plan to be source-separated for the purpose of recycling. This list, which is enumerated in Article V, Source Separation and Recycling, of this chapter, may be amended at any time.
GARBAGE RECEPTACLE
Includes any light-gauge steel, plastic or galvanized receptacle, closed at one end and open at the other, furnished with a top or lid. The maximum quantity of receptacles and their maximum capacity and weight when full shall be determined by Council. It shall also include plastic bags or liners, securely tied at the top. The maximum quantity and gross weight of such bags when full shall be determined by Council.
ITEMS ACCEPTED FOR RECYCLING
Those materials designated by the Hunterdon County Utilities Authority, the Council of the Borough of Bloomsbury and/or the solid waste collector. This list may be amended at any time, and the applicable listing for any collection date shall be the most current listing available from the Municipal Clerk.
MULTIFAMILY HOUSING
Any building or structure or complex of buildings in which three or more dwelling units are owner-occupied or rented or leased, or offered for rental or lease, for residential purposes, and shall include hotels, motels, or other guest houses serving transient or seasonal guests as those terms are defined under Subsection (j) of Section 3 of the Hotel and Multiple Dwelling Law, P.L. 1967, c. 76 (N.J.S.A. 55:13A-1 et seq.).
RESIDENTIAL PROPERTY
Any building or structure or complex of buildings in which fewer than three dwelling units are owner-occupied or rented or leased, or offered for rental or lease, for residential purposes (N.J.S.A. 13:1E-99.13a).
SOLID WASTE
Includes all garbage and rubbish normally placed at the curb at residential and nonresidential properties in the Borough for regular collection. "Solid waste" shall not include designated recyclable materials.
SOURCE SEPARATION
The process by which recyclable materials are separated at the point of generation by the generator thereof from solid waste for the purpose of recycling.
Designated recyclable items shall be separated from solid waste in accordance with Article V, Source Separation and Recycling, of this chapter.

A. 
All solid and bulky wastes and recyclable material wastes which are generated by residential property, multifamily housing, commercial, industrial and institutional establishments, stores, shops and other buildings in the Borough shall be collected in the manner set forth in the specifications prepared by the Borough Council and the contract awarded pursuant thereto to the successful bidder according to the Local Public Contracts Law[1] for a period not to exceed five years.

Unless the Borough provides for the collection of solid and/or bulky wastes and recyclable material wastes, every owner and/or occupant of residential or nonresidential premises must contract with a private contractor for the removal and disposition of solid and bulky wastes and recyclable material wastes as set forth in this article. Solid waste collection contracts must comply with the provisions of this article and must further provide for not less than weekly pickup. Recyclable material waste collection contracts must comply with the provisions of this article and Article V, Source Separation and Recycling, of this chapter and must further provide for not less than monthly pickup.
It shall be the duty of such contractor who shall be awarded a contract for the collection of the Borough's solid and/or bulky wastes and recyclable material wastes to furnish a suitable number of scavenger trucks with watertight bodies and so protected on top that no solid waste or other refuse shall be blown or dropped from said vehicles. Each truck shall, at all times, have at least one broom and shovel to clean up solid waste or recyclable material waste that may be spilled or otherwise scattered during the process of collection. It shall be a violation of this article for any such contractor to neglect or refuse to clean up any solid waste, recyclable material waste or other refuse spilled or otherwise scattered during collection.
A. 
It shall be the duty of the contractor as aforesaid to pass through every street in said Borough with one or more scavenger trucks between designated hours on a designated collection day of each week and promptly remove the solid and/or bulky wastes or recyclable material wastes from each place pursuant to the terms of the contract entered into between the Borough and the contractor.
B. 
The designated hours and designated collection day(s) are to be determined by the Borough Council.
The occupant(s) and owner(s) of any residential property or multifamily housing and commercial, industrial and institutional generators of solid waste, bulky waste and recyclable material waste shall be responsible for compliance with this article. Violations and penalty notices will be directed to the occupant. In instances where the violator is not easily identifiable, violations and penalty notices will be directed to the owner/management.

The owners of any premises receiving garbage collection services from the Borough are hereby required to have all solid waste in garbage receptacles to be placed adjacent to the street or traveled way in front of their premises or at such location as designated by the Borough Council for collection by the Borough's contractor. Garbage receptacles shall be placed out for collection no earlier than the day prior to collection and no later than 7:00 a.m. on the day of collection. Garbage and recycling receptacles shall be removed from the street, traveled way or other authorized location by sundown the day following collection. Failure to comply with the requirements of this section shall be deemed a violation of this article. Each day that a garbage receptacle remains at the curb or other authorized location after the time authorized herein shall be deemed a separate offense.

No household garbage or solid waste, bulky waste or recyclable material waste shall be placed in any dumpster or roll-off container earmarked for the pickup of commercial, industrial or institutional solid or bulky waste or recyclable material waste.

Any person or entity who or which violates any of the provisions of this article or any regulation promulgated pursuant thereto shall, upon conviction thereof, be punished as provided in Chapter 1, Article I, General Penalty, of this Code. Each and every day that said violation(s) continues shall be considered a separate offense.
