Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $35. Any person exceeding the maximum speed limit by more than five miles per hour shall pay an additional fine of $2 per mile for each mile in excess of five miles per hour over the maximum speed limit.
A. 
Maximum speed limits are established, as follows, on certain bridges and elevated structures, and it shall be unlawful for any person to drive a vehicle on any such bridge or elevated structure, at a higher speed than the maximum prescribed for that bridge or elevated structure:

A. 
The following are declared to be hazardous grades, and, upon any such hazardous grade, no person shall drive a vehicle, having a gross weight in excess of that referred to for that grade, in the direction stated for that grade, at a speed in excess of that established in this section for that grade, and, if so stated for a particular grade, the driver of every such vehicle shall stop the vehicle before proceeding downhill:

B. 
Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $35. Any person exceeding the maximum speed limit by more than five miles per hour shall pay an additional fine of $2 for each mile in excess of five miles per hour over the maximum speed limit.
A. 
A speed limit of 15 miles per hour is established on all streets and roadways in the public parks maintained and operated by the Townships.
B. 
Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $35. Any person exceeding the maximum speed limit by more than five miles per hour shall pay an additional fine of $2 per mile for each mile in excess of five miles per hour over the maximum speed limit.
A.

The following highways are established as through highways, thus authorizing stop or yield signs to be erected facing traffic approaching every intersection with the through highway except for those intersections with traffic signals, or with exceptions or modifications as indicated below. Every driver of a vehicle approaching a stop or yield sign authorized by this section shall stop the vehicle or yield right-of-way as required by Section 3323(b) or 3323(c) of the Vehicle Code,[1] as the case may be, and shall not proceed into or across the through highway until he has followed all applicable requirements of that section of the law:

The following intersections (in addition to intersections with the through highways established by § 555-21) are established as stop intersections, and official stop signs shall be erected (or are ratified if previously erected) in such a position as to face traffic approaching the second-named street (the intersecting of through street) on the first-named street (the stop street) in the direction or directions indicated for that intersection. Every driver of a vehicle approaching the intersection on the first named or stop street, in the direction indicated in each case, shall stop the vehicle as required by Section 3323(b) of the Vehicle Code,[1] and shall not proceed into or across the second-named or intersecting or through street until he has followed all applicable requirements of that section of the law.

A. 
The following intersections are established as four-way stop intersections and official stop signs shall be erected in such position as to face traffic approaching from each direction created by the intersection of said four-way stop intersections.
B. 
Every driver of a vehicle approaching such intersection on either street in either direction shall stop the vehicle as required by Section 3323(b) of the Vehicle Code[1] and shall not proceed into or across the second or intersecting street until he/she has filed all applicable requirements of such section of the law.

C. 
Four-way stop signs shall be erected in every direction in each travel direction at the intersection of the following streets:

The following intersections (in addition to intersections with the through highways established by § 555-21) are established as yield intersections, and official yield signs shall be erected (or are ratified if previously erected) in such a position as to face traffic approaching the second-named street (the through street) on the first-named street (the yield street) in the direction or directions indicated for that intersection. Every driver of a vehicle approaching the intersection on the first-named or yield street, in the direction indicated in each case, shall slow down or stop the vehicle as required by Section 3323(c) of the Vehicle Code,[1] and then yield the right-of-way as required by that subsection of the Vehicle Code.

B.

A. 
The following areas upon the streets in the Township are established as play highways:

B. 
The Park and Recreation Commissioner is authorized to designate as play highways, whenever he deems that action advisable, and for whatever period of time directed by him, any part of any street in the Township, where sledding and coasting, shall be permitted. That play highway shall be set apart for the purpose under the direction of the Park and Recreation Commissioner.
C. 
No person shall drive any motor vehicle upon any play highway at any time when that street shall be designated as a play highway, except in case of emergency, with special permission of the Park and Recreation Commissioner or of the police officer in charge, who shall first clear that play highway of all persons using it for the purpose for which it was set aside. Any person who violates any provision of this subsection shall, upon conviction, be sentenced to pay a fine of $25 and costs.
A. 
The word "pushcart," as used in this section, shall mean a vehicle, other than a pedalcycle, propelled solely by human power, and used or intended for use for the display, transport, exhibit or sale of goods, wares or merchandise.
B. 
It shall be unlawful for any person to propel a pushcart upon any sidewalk in any business district except as necessary to move the pushcart to a location from which it is to be loaded or unloaded or from which goods, wares or merchandise are to be sold or dispensed under permit from the Board of Commissioners as provided in Subsection C of this section.
C. 
It shall be unlawful for any person to park a pushcart upon any sidewalk except for the purpose of selling or dispensing from that pushcart goods, wares or merchandise to passersby under permit from the Board of Commissioners. Every such permit shall be issued to the person making application for the permit, upon payment of a fee, which shall be for the use of the Township, of $100 for any calendar year, $50 for any six-month period, or $25 for any three-month period. The permit shall be granted to the applicant, upon payment of the fee, and upon his signing an agreement with the Board of Commissioners that he shall be bound by the conditions imposed by the Board of Commissioners and made a part of the permit, dealing with the following matters:
(1) 
Restricting or limiting the parking of the pushcart to one or more stated locations upon the sidewalk and to stated days and hours at each location;
(2) 
Stating requirements to be adhered to in connection with the disposal of garbage and refuse resulting from the operations carried on;
(3) 
Requiring that there be no violation of any law, ordinance or regulation pertaining to health, sanitation and the handling of food or drink.
D. 
Any person who violates any provision of this section, or any condition of any permit granted under this section, shall be guilty of a summary offense, and, upon conviction, shall be sentenced to pay a fine of $25 and costs.
A. 
It shall be unlawful for any person to ride on a sled upon any sidewalk in the Township, or upon any roadway unless that roadway is on a portion of a street blocked off for sledding by authority of § 555-5 of Article I or § 555-26 of this article. Provided: nothing in this subsection shall prevent a pedestrian from pulling a sled, with or without a rider, upon a sidewalk.
B. 
It shall be unlawful for any person to engage in roller-skating or to ride upon or propel any coaster or other toy vehicle upon:
(1) 
Any street except in order to cross the roadway; or
(2) 
Any sidewalk located in a business district, except that nothing in this subsection shall prevent a pedestrian from pulling a coaster or other toy vehicle, with or without a rider, upon a sidewalk.
C. 
Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $5 and costs.

A. 
Short title. This section shall be known and cited as the "Upper Chichester Township All-Terrain Vehicle Safety Ordinance." This section shall supplement Chapter 77 of the Pennsylvania Motor Vehicle Code.
B. 
Definition. As used in this section, the following terms shall have the meanings indicated:
ALL-TERRAIN VEHICLE (ATV)
The same meaning as used in Section 7702 of the Vehicle Code, 75 Pa.C.S.A. § 7702, and shall include any unlicensed motorized two-, three-, four-wheeled or track vehicle and including dirt bikes (licensed or otherwise), minibikes, trail bikes, go-carts, and other vehicles.
C. 
Consent/prohibitions.
(1) 
No person shall, except as provided herein, operate any of the above, as hereinbefore defined, within the Township of Upper Chichester, unless the user thereof has first given his name and address to the owner or the lessee in possession of the premises where he intends to operate and has obtained the written consent of such owner or lessee, as the case maybe, on the form provided by the Township of Upper Chichester. Prior to operating an ATV on such property, duplicate signed copies of said consent shall be filed with the Township Secretary either in person or by mail. No registration with the Township or filing fee shall be required. The consent of the owner or lessee shall continue in effect until the end of the consent year in which the consent is obtained, as will be specified on said written consent, unless prior thereto the owner or lessee in possession of the land shall revoke such consent in writing. In granting such consent, the owner or lessee may stipulate the type of ATV for which consent is granted.
(2) 
No person shall operate, park, stop, stand, place or maintain any all-terrain vehicle on any public sidewalk or any public property, including without limitation any park or recreation facility, except where expressly authorized by law; provided that the owner or a person with lawful permission of the owner may temporarily place an all-terrain vehicle on the sidewalk abutting his or her house or abutting any premises where the vehicle is lawfully stored, for purposes of lawfully transporting the vehicle to a location outside the Township. Nothing in this section prohibits the lawful transport of an all-terrain vehicle on a licensed trailer or other safe carrier, or the manual transport of a vehicle onto or off of such carrier, so long as the motor engine of the all-terrain vehicle remains off at all times.
(3) 
Time limitations. It shall be unlawful for any person to operate an ATV or dirt bike for recreational purposes between the hours of 9:00 p.m. and 7:00 a.m., prevailing time. Operation of ATVs and dirt bikes will be limited to a one-hour session with three-hour rest before the next operation of the vehicle. The rest period must be provided to prohibit disturbance of the peace within the Township. Operation within this prohibited time period shall be considered a disturbance of the peace and/or nuisance with the Township.
(4) 
Noise limitation. No person shall operate an ATV or dirt bike without an effective and suitable muffling device on its engine which efficiently deadens or muffles the noise of the exhaust. Operation of an ATV or dirt bike shall be subject to and compliant with the noise limitations, restrictions and requirements as set forth in the Township and/or state ordinances and statutes.
D. 
Enforcement.
(1) 
Notices of violation shall be issued by Upper Chichester police officers or any other person authorized to enforce ordinances.
(2) 
Enforcement; first offense. The Upper Chichester Township Police Department, the Pennsylvania State Police and such persons as may from time to time be designated by the Township are authorized to make an initial determination of a violation of, and to enforce, the provisions of this section. An initial determination of a violation of this section shall result in a verbal warning to the occupant, or owner and the operator of the ATV or dirt bike.
(3) 
Penalties. A second or subsequent violation of this section shall be subject to summary enforcement proceedings and upon being found guilty thereof shall subject the violator to a fine of $600 for a second offense (following a verbal warning), and $1,000 for a third offense. Upon default in payment of a fine and upon a guilty finding of a third or subsequent offense, the violator may be subject to a term of imprisonment up to the maximum allowed by law for a summary offense. Each day that a violation continues of each subsection of this section that is found to be violated shall be considered a separate violation.
(4) 
All offenders convicted of violating this section shall also pay the costs of prosecution and in default of said payment of fines and costs.
(5) 
Any person guilty of a violation of the within section may also be subject to civil proceedings for damages and/or injunctive relief by the property owner and any entity injured or damaged by such violation.
(6) 
Both criminal and civil proceedings may be commended against a person violating the within section and commencement of any such proceedings shall not constitute an election of remedies preventing the commencement of the other proceedings against such violator.
(7) 
Seizure. In addition to issuance of a notice of violation, whenever a police officer has probable cause to believe a vehicle has been used or is being used in violation of this section, the officer may seize the vehicle. The Police Department shall store the vehicle until a final adjudication of the offense, at which time:
(a) 
If forfeiture is not awarded, the Police Department shall return the vehicle to the owner upon payment of all applicable fines, penalties and fees and compliance with all applicable laws relating to the vehicle.
(b) 
If forfeiture is awarded, the Police Department shall dispose of the vehicle in an appropriate manner, which may include destruction of the vehicle or such other manner of disposition that, in the judgment of the Department, reduces, to the greatest extent practicable, the opportunities for the vehicle to be used in any manner that violates the provisions of this section or the Vehicle Code.[1]
