There is hereby created a recreation commission known as the
"Recreation Commission of the Township of Mount Pleasant."
The Commission shall be composed of five members, who shall
be appointees as provided by the Second Class Township Code, particularly
at 53 P.S. § 67204, and other appropriate acts of the General
Assembly. The Commission members shall serve for terms of five years
or until their successors are appointed, except that the members first
appointed shall be so appointed that the term of one member shall
expire annually thereafter. Vacancies shall be filled in the same
manner as the original appointments and for the unexpired term. Members
shall serve without pay.
The Recreation Commission shall appoint from its membership
a Chairman and such other officers as it may deem necessary for the
orderly procedure of its business, and adopt bylaws, rules and regulations
covering its procedure not inconsistent with the provision of the
state laws. The Recreation Commission shall, from time to time, make
rules governing the operation and conduct of the recreation facilities
operated by the Commission. The Commission shall hold meetings at
such times and places as it may designate.
All expenses incurred in the operation of such parks, recreation
areas and facilities established as herein provided shall be payable
from the general Township fund or from the treasury of the Township,
as may be provided for by the agreement of the corporate authorities.
The Supervisors may annually appropriate an amount necessary for carrying
out the provisions of this chapter and may cause to be raised by special
taxation such tax for the purpose of maintaining, equipping and operating
the parks, recreation areas, and facilities and the programs thereon
as provided by the Second Class Township Code, 53 P.S. § 67206.
The Recreation Commission shall maintain, operate and supervise
the public parks, play fields and all other outdoor and indoor recreational
areas and facilities owned or controlled by the Township of Mount
Pleasant.
The Recreation Commission may accept any grant, gift, bequest
or donation or services, equipment, real estate or money from an individual
or group, to be used as specified by the donor or by the terms of
acceptance. The Recreation Commission shall have no authority to enter
into any contract or incur any obligation binding upon the Township
of Mount Pleasant, other than current obligations or contracts to
be fully executed within the then current fiscal year and all within
the budget appropriations made by the governing body of the Township
of Mount Pleasant.
The Recreation Commission shall have the power to appoint an
executive director or superintendent of recreation who possesses the
necessary qualifications and who has demonstrated by actual work his
ability to organize and direct a community recreation system and supervise
the activities of such other personnel as may be deemed necessary
in carrying out the program.
Funds appropriated by the governing body of the Township of
Mount Pleasant and budgeted to the Recreation Commission shall be
disbursed by the fiscal disbursing officer of the Township of Mount
Pleasant, upon vouchers issued by the Recreation Commission and within
the budget appropriations made. Funds received by the Recreation Commission
from sources other than budget appropriations shall be deposited by
the Township of Mount Pleasant to the credit and for the use of the
said Commission and disbursed as the above budget funds are disbursed,
except that funds received by gift, bequest or otherwise shall be
disbursed in accordance with the terms of such gift or bequest or
the terms of the acceptance thereof.
The Recreation Commission shall make full and complete reports
to the governing body at such times as may be designated or requested
by the governing body. The fiscal year of said Recreation Commission
shall conform to that of the Township of Mount Pleasant.
Such powers as are now or may hereafter be provided by statute
of the Commonwealth of Pennsylvania or by ordinances of the Township
of Mount Pleasant relating to the development and operation of a recreation
system, public parks and playgrounds are hereby vested in the Recreation
Commission, to be exercised by it subject to any and all restrictions
contained in such powers and ordinances.
