A person is guilty of disorderly conduct if, with intent to
cause public inconvenience, annoyance or alarm, or recklessly creating
a risk thereof, he:
A.
Engages
in fighting or threatening, or in violent or tumultuous behavior.
B.
Makes unreasonable noise. This offense is further defined to include (but is not limited to) noise generated in a residential area after 9:00 p.m. but prior to 7:00 a.m. from construction activities or preparation for construction or cleanup from construction activities, when such noise can be heard within one or more of the surrounding residences. The offense is further defined to include (but is not limited to) noise generated from any social gathering in a residential area after 10:00 p.m. but prior to 7:00 a.m. when such noise can be heard within one or more of the surrounding residences. This Subsection B shall not apply to any public event for which a permit has been issued pursuant to Chapter 315 of the New Britain Borough Code of Ordinances.

C.
Uses obscene
language, or makes an obscene gesture.
D.
Creates
a hazardous or physically offensive condition by any act which serves
no legitimate purpose of the actor.
E.
Creates
a hazardous condition endangering persons (including himself or herself
or others) or property, while using a skateboard on any public street,
public sidewalk, public alley, public park, public parking lot or
other public place or public way within the Borough of New Britain.
As used in this chapter, the word "public" means affecting or
likely to affect persons in a place to which the public or a substantial
group has access; among the places included are highways, transport
facilities, schools, prisons, apartment houses, places of business
or amusement, any neighborhood, or any premises which are open to
the public. In addition, when an actor creates unreasonable noise
out of doors in a neighborhood, which noise can disturb another resident
or other residents within his or their homes, the actor creates public
inconvenience, annoyance or alarm.
Any person convicted of a violation of any provision of this
chapter shall be guilty of a summary offense punishable by a fine
of up to $300 along with costs of prosecution, or in default of such
payment, may be sentenced to a term of imprisonment of up to 30 days.
