The position of the Town Justice shall, from the time this article takes effect, within the context of Municipal Home Rule Law § 24, be full-time, and that position shall, from the time this article takes effect, be accorded all of the emoluments which otherwise attach to a full-time position with the Town of Kingsbury.
This article shall take effect in conformance with Municipal Home Rule Law § 24 and, as such, shall not take effect until at least 45 days after its enactment; nor until approved by an affirmative vote of a majority of the qualified electors of the Town of Kingsbury, registered to vote therein, voting on a proposition for its approval if within 45 days after its adoption there be filed with the Clerk a petition protesting against such article, signed and authenticated as provided in the Municipal Home Rule Law by qualified electors of the Town of Kingsbury, registered to vote at the last preceding general election, in a number equal to at least 10% of the total number of votes cast for the Governor at the last gubernatorial election.
