Except temporarily for the purpose of and while actually engaged in loading or unloading or in receiving or discharging passengers or property and while the vehicle is attended by a licensed operator so that it may be moved promptly in case of an emergency or to avoid obstruction of traffic, no person shall at any time park or leave standing any vehicle upon any of the highways or parts of highways listed in Schedule E.[1]

A. 
Fine amount. Parking fines may be paid by any method approved in the Parking Enforcement Policy.
B. 
Credit card acceptance by City and authorized agencies. A City department or authorized agency may accept a credit card as payment for payment of fines or other fee(s) as provided for in this section. In addition, the violator may be charged a courtesy fee for such service.
C. 
Parking Deposit Schedule. Every authorized officer issuing a parking citation will indicate on the citation the amount of the deposit that the alleged violator may make in lieu of contesting the citation. The amount of the fine will be determined in by the Parking Enforcement Schedule adopted by resolution of the City Council.
D. 
Contesting: on-line procedure. Violators may contest a parking citation as provided for in the Parking Enforcement Policy.
E. 
Appeal: Municipal Court procedure. After contesting the citation with the Fond du Lac Police Department, an aggrieved violator may appeal the citation to the Municipal Court. The appeal request must be made to the Clerk of the Municipal Court within 28 days of the date issued on the citation. The Clerk will set a hearing date with the Municipal Court Judge. All late fees will be stayed pending a decision of the Municipal Court Judge. The citation will then be governed by the law applicable in Municipal Court cases, and court costs may be assessed.
F. 
Parking registration program for unpaid citations. In addition to all other methods of collecting forfeitures provided for in this section, the proper City officials may use the procedures provided for in § 85.13, Wis. Stats., including additional fees charged by the state for the suspension of the registration of motor vehicles.
No person shall park or leave standing any vehicle upon any of the highways or parts of highways at the time indicated, except temporarily for the purpose of and while actually engaged in receiving or discharging passengers, as listed in Schedule F.[1]

A. 
Except as herein permitted, no person shall park, stop or leave standing any vehicle in the following places, unless authorized by permit issued by the City or by an official traffic control sign:
(1) 
Parking. No person shall park a motor vehicle in any loading zones as listed in Schedule H.[1]

Parking. No person shall park a motor vehicle in any City park, parkway, recreation area or public cemetery.
(3) 
Parking. No person shall park a motor vehicle in any drive through, street, alley (paved or unpaved) in any City park, parkway, recreation area or public cemetery.
(4) 
Parking. No person shall park a motor vehicle in an area marked as a bus or taxi stop or stand as listed in Schedule l.[2]

(5) 
Parking. No person shall park a motor vehicle in unmetered parking stalls in City parking lots or ramps without a permit.
(6) 
Parking. No person shall park a motor vehicle at the curb on the side of any roadway in any block, parking lot or other designated area posted "Parking by Permit Only" or "No parking" or by a sign of a similar type whether permanent or temporary.
(7) 
Parking. No person shall park a motor vehicle in any parking spaces designated as disabled parking zones. Such disabled parking zone(s) shall be reserved for persons authorized under § 343.51, Wis. Stats.

Parking. No person shall park a motor vehicle closer than 15 feet to the near limits of a crosswalk, whether marked or unmarked.
(9) 
Parking on any terrace or sidewalk. No person shall park a motor vehicle, equipment, building materials, dumpsters, PODS®, or any other similar type of materials which blocks or obstructs any sidewalk, street, alley or any portion thereof in the City without obtaining a permit from the Director of Public Works or designee. Obstructions may include any object(s) in the right-of-way which obstructs the free movement of vehicular, pedestrian, or bicycle traffic.
(10) 
Parking. No person shall park a motor vehicle on any bridge,
(11) 
Parking. No person shall park a motor vehicle within 10 feet of a fire hydrant, 15 feet of any fire station or in a fire lane.
(12) 
Parking. No person shall park a motor vehicle on private property that is not otherwise open for use by the public without the consent of such property owner.
(13) 
Parking. No person shall park a motor vehicle within four feet of the entrance of an alley or private driveway.
(14) 
Parking. No person shall park a motor vehicle on any street for more than 48 hours at any time.
(15) 
Parking. No person shall park a motor vehicle blocking traffic or parking too close to another vehicle.
(16) 
Parking. No person shall park a motor vehicle blocking a yellow line.
(17) 
Parking. No person shall park a motor vehicle facing traffic.
(18) 
Parking. No person shall park a motor vehicle too far from a curb.
(19) 
Parking. Where individual parking spaces are marked on the curbing or pavement, every motor vehicle shall be parked entirely within the limits of the space so designated.
(20) 
Parking. Where a parking permit is required, no person shall park a motor vehicle with an expired permit.
(21) 
Parking. No person shall park a vehicle within 50 feet of the nearest railroad crossing.
(22) 
Parking. No person shall park, dump or use any City parking space for anything but a motor vehicle.
(23) 
Parking. No person shall park a motor vehicle in an access controlled ramp without paying required parking fee.
(24) 
Parking. No person shall park a motor vehicle upon any portion of a street, highway, or parking facility reserved for handicapped persons by official traffic signs, distinct markings, or parking meters indicating the restriction, unless such parking is permitted under § 346.05, Wis. Stats.

Parking. No person shall park a motor vehicle for sale on a highway.

A. 
When official traffic control devices or parking meters are erected in any block giving notice thereof, no person shall park, stop or leave standing any vehicle, whether attended or unattended, for more than the indicated time periods on any of the highways or parts thereof listed in Schedule J.[1]

The provisions of this section shall not apply to a vehicle displaying a valid permit and parked, stopped or left standing for more than the indicated time periods on any of the highways or parts thereof listed in Schedule J.

C. 
A resident of each household located on the highways or parts thereof listed in Schedule J may file an application with the City Clerk for a permit to park a vehicle in excess of the indicated time period on the above-described highways or parts thereof listed in Schedule J. If the application meets the requirements of this section, the City Clerk shall issue such permit. The City Clerk shall determine the type of parking permit for the property owner and/or resident.[2]

D. 
Permits issued under Subsection C above shall only be valid in an area located within 200 feet of permittee's residence. Persons parking outside this area shall be subject to all applicable time restrictions.
E. 
No persons shall sell or transfer a permit issued under Subsection C or falsify an application for permit or take any other action that would result in an ineligible person receiving a permit.[3]

F. 
Any person convicted of three violations of Subsections D and E shall have his or her permit suspended for one year. Additional violations may result in a revocation of the permit.
Angle parking shall be permitted on Court Street, south side, from the west curbline of Main Street to the east curbline of Macy Street.
A. 
Night parking.
(1) 
Winter parking.
(a) 
No person shall park on any street during the months of November 15 through March 15, between 8:00 p.m. and 8:00 a.m., except in the following manner:

From 8:00 p.m. of an even calendar date to 8:00 a.m. the following day, parking shall only be permitted on the even-numbered side of the street.
[2] 
From 8:00 p.m. of an odd calendar date to 8:00 a.m. the following day, parking shall only be permitted on the odd-numbered side of the street.
(b) 
The provisions of this subsection shall supersede conflicting parking restrictions during the months and time periods that it is in effect.
(2) 
Metered areas. No person shall park any vehicle for longer than 60 minutes between the hours of 2:00 a.m. and 6:00 a.m. upon any portion of the streets or highways of the City where the parking upon which is regulated by meters.
B. 
Snow emergency traffic regulations.
(1) 
Declaration of snow emergency; plowing of streets. There is hereby declared to exist in the City an emergency by reason of heavy snowfall whenever snow falls during any period of 24 hours or less to a depth of three inches or more in that such snowfall constitutes a serious public hazard impairing transportation, the movement of food and fuel supplies, medical care, fire, health and police protection and other vital facilities of the City. Such emergency is declared to continue for a period of 48 hours from the time it is announced or until such earlier time as snowplowing operations have been declared completed. Whenever such an emergency exists and the proper City officials shall have caused announcement thereof to be made by at least one radio station whose normal operating range covers the City, no operator or owner shall park or suffer or permit a vehicle to be parked so as to interfere with snowplowing operations on the City streets. If the owner or operator of such vehicle shall not attend to its removal, the Police Department is authorized to move such vehicle to some suitable location at the owner's expense so as not to interfere with snowplowing.
(2) 
Parking during snow removal period. After any snowfall which the Director of Public Works and Chief of Police shall deem to be sufficiently heavy to necessitate its removal from the vehicular traveled portion of the streets, the Chief of Police shall immediately establish "no parking" zones on any streets where such snow removal operation will be taking place. Such "no parking" areas shall be marked with appropriate moveable signs not less than four hours prior to the commencement of the snow removal operation and such streets may be shut off and blocked at all times while the crews are operating thereon. The operator of a motor vehicle shall check his vehicle after each snowfall to determine whether it is parked in an area from which snow is to be removed and, if in such area, such vehicle shall be removed immediately. If the owner or operator of such vehicle shall not attend to its removal, the Police Department is authorized to move such vehicle to some suitable location at the owner's expense so as not to interfere with snow removal.
(3) 
Streets narrowed by excessive snow. When after any snowfall and snowplowing operation a street or portion thereof is sufficiently narrowed by excessive snow having been plowed toward the curbing so as to constitute a serious public hazard impairing transportation and the movement of vehicular traffic, the Chief of Police shall immediately place appropriate moveable signs thereon restricting parking on such street until such hazard is eliminated, whereupon no person shall park a vehicle on such street contrary to the restrictions on such signs.
C. 
Purpose. It is the intent to impose the restrictions set forth in this section in order to facilitate snow removal, street cleaning and policing functions of the City government.

A. 
Definitions. Terms used in this section shall have the following meanings:
OPERATOR
Every individual who shall operate a vehicle as the owner thereof or as the agent, employee or permittee of the owner or who is in actual physical control of a vehicle.
PARKING
The stopping or standing of a vehicle, whether occupied or not, upon a street otherwise than in obedience to traffic regulations or official traffic signs or signals.
PARKING METER
Any automatic device or meter not inconsistent with this section placed or erected for the regulation of parking by authority of this section. Each parking meter installed shall indicate by proper legend the legal parking time established by the City and when operated shall at all times indicate the balance of legal parking time and at the expiration of such period shall indicate illegal or overtime parking.
PARKING METER SPACE
Any space within a parking meter zone adjacent to a parking meter and which is designated for the parking of a single vehicle by lines painted or otherwise durably marked on the curb or on the surface of the street adjacent to or adjoining the parking meter.
PARKING METER ZONE
Any restricted street upon which parking meters are installed and in operation.
STREET
Any public street, avenue, road, alley, highway, lane, path or other public place located in the City and established for the use of vehicles.
VEHICLE
Any device in, upon or by which any person or property is or may be transported upon a highway, except a device which is operated upon rails or tracks.
B. 
Parking system utility.[1]
(1) 
The City municipal parking system consists of off-street parking facilities situated throughout the downtown area, as well as on-street parking facilities with meters situated throughout the downtown area, except those no parking zones outlined in Schedule E and limited time parking in Schedule F.[2]

(2) 
The parking system includes separate on-street nonmetered parking zones on Main Street, both sides, between Second Street and Division Street; on Main Street from Division Street to Merrill Avenue; and Main Street from Second Street to Western Avenue, with a two-hour time limit as provided in Schedule J,[3] except those no parking zones outlined in Schedule E. The purpose of these nonmetered parking facilities is specifically to service downtown customers and clients, not downtown employees and business owners.

(3) 
The municipal parking system of the City consisting of the parking facilities described in this Subsection B and together with all property, real and personal, appurtenant thereto and including all other parking facilities hereafter acquired or constructed shall constitute a public utility within the purview of § 66.0805, Wis. Stats.
(4) 
The parking utility shall be under the management of the City Manager.
(5) 
While any bonds payable from the revenues of such parking utility are outstanding, the collection, security and disbursement of parking revenues shall be subject to the provisions and covenants of the ordinance or ordinances authorizing such parking revenue bonds.

C. 
Designation of parking spaces. The Director of Public Works or his/her designee is hereby directed and authorized to mark off individual parking spaces in the parking zones, such parking spaces to be designated by lines painted or durably marked on the curbing or surface of the street. At each space so marked off, no person shall park any vehicle in such a way that such vehicle shall not be entirely within the limits of the space so designated.[4]

D. 
Installation of parking meters. In the parking meter zones the Director of Public Works or his/her designee shall cause parking meters to be installed upon the curb or sidewalk immediately adjacent to the parking spaces, placed not more than two feet from the curb nor more than four feet from the front line of the parking space as indicated. Each device shall be so set as to display a signal showing legal parking upon the deposit of the appropriate coin or coins, lawful money of the United States, for the period of time prescribed by this section. Each device shall be so arranged that, upon the expiration of the lawful time limit, it will indicate by a proper visible signal that the parking period has expired, and in such cases the right of such vehicle to occupy such space shall cease and the operator, owner, possessor or manager thereof shall be subject to the penalties provided in this section.[5]

E. 
Disposition of parking meter revenue. The parking meter and off-street parking trust fund shall be maintained as a separate account from other City accounts. The original cost of the parking meters and costs of replacement, repairs and supervision, which includes the costs of collection and administration, shall be chargeable to the parking meter and off-street parking trust account. Any unexpended balances in the fund are not to become part of the general fund of the City but shall remain in trust for the purchase of such off-street parking facilities as the Council may direct. All earnings upon investment of the funds shall, when received, be and constitute an addition to the fund.
F. 
Operation of parking meters. Except in a period of emergency determined by an officer of the Fire or Police Department or in compliance with the directions of a police officer or traffic control sign or signal, when any vehicle shall be parked in any parking space alongside or next to which a parking meter is located, the operator of such vehicle shall set in operation the timing mechanism on such meter and failure to deposit such proper coin shall constitute a violation of this section. Upon the deposit of such coin, the parking space may be lawfully occupied by such vehicle during the period of time which has been prescribed for the part of the street in which the parking space is located, provided that any person placing a vehicle in a parking meter space adjacent to a meter which indicates that unused time has been left in the meter by the previous occupant of the space shall not be required to deposit a coin so long as his occupancy of such space does not exceed the indicated unused parking time. If the vehicle shall remain parked in any such parking space beyond the parking time limit set for such parking, if the meter shall indicate such time limit set for such parking and if the meter shall indicate such illegal parking, then such vehicle shall be considered as parking overtime and beyond the period of legal parking time and such parking shall be deemed a violation of this section.
G. 
Rental charges.

(1) 
Meter rentals. On- and off-street meter rental charges and permit rental charges shall be set by resolution of the City Council.
(2) 
City-County Government Center parking. Employee parking in lots designated for the City-County Government Center shall be by permit only.
H. 
Parking time limits.
(1) 
Parking or standing a vehicle in a designated space in a parking meter zone shall be lawful for the period of time and upon the deposit of the fee required as shall be clearly indicated on the meter controlling any such designated parking space.
(2) 
Parking meters shall be operated between 8:00 a.m. and 5:00 p.m., Monday through Friday, except the following legal holidays: New Year's Day, Memorial Day, July 4, Labor Day, Christmas Day and Thanksgiving Day.
(3) 
Permit time limits shall be from 7:00 a.m. to 5:00 p.m., Monday through Friday, except the following legal holidays: New Year's Day, Memorial Day, July 4, Labor Day, Christmas Day and Thanksgiving Day.
I. 
Violations.
(1) 
No person shall:
(a) 
Cause, allow, permit or suffer any vehicle to be parked overtime or beyond the period of time established for any parking meter zone as herein described, including, for the purposes of this section, Main Street between Johnson Street and Western Avenue.

(b) 
Extend the parking time that any car shall occupy a parking meter zone by further deposits of coins; parked vehicles shall be removed promptly by the operator on the expiration of the parking period as provided by this section.
(c) 
Permit any vehicle to remain or be placed in any parking space adjacent to any parking meter while such meter is displaying a signal indicating that the vehicle occupying such parking space has already been parked beyond the maximum legal parking time prescribed for such parking space or move a vehicle out of and back into such a zone with the signal so indicated.
(d) 
Park in any one space, or in any combination of spaces, for more than two hours during the times prohibited in Schedule J in the nonmetered on-street parking zone on Main Street, from Second Street to Division Street; or park in any one space, or in any combination of spaces, for more than two hours during the times prohibited in Schedule J in the nonmetered on-street parking zone on Main Street from Division Street to Merrill Avenue; or park in any one space, or in any combination of spaces, for more than two hours during the times prohibited in Schedule J in the nonmetered on-street parking zone on Main Street from Second Street to Western Avenue.
(e) 
Park any vehicle across any line or marking of a parking meter space or in such position that the vehicle shall not be entirely within the area designated by such lines or markings.
(f) 
Deface, injure, tamper with, open or willfully break, destroy or impair the usefulness of any parking meter installed under the provisions of this section.
(g) 
Deposit or cause to be deposited in any parking meter any slugs, device or metal substance or other substitute for lawful coins of the United States.
(h) 
Be in or on the property of any City parking ramp other than as a patron. Those authorized personnel of the City are deemed patrons under this regulation.
(i) 
Drink from or have in his possession any open container of fermented malt beverage, wine or intoxicating liquor within any designated parking lot or ramp.

(j) 
Operate a vehicle in any public parking lot or ramp in an unsafe manner which shall constitute a violation of § 500-1 of this Code.
(k) 
Park any motor vehicle in any public parking lot or ramp for more than 24 hours without payment of the daily parking fee. Any motor vehicle remaining in a public parking lot or ramp over 24 hours without payment of the daily fee may be subject to tow-away under Article III of this chapter.
(l) 
Use any City parking lot or ramp for automotive/vehicle repair, ball playing, jogging, bike riding, jumping rope, roller skating or any other athletic, sporting or playground activity.

(2) 
City/County Government Center or Safety Building
(a) 
Visitors. No visitors to the City/County Government Center or Safety Building shall park in areas designated for employees or officials without possessing a proper permit for that area.
(b) 
Employees or officials. Employees or officials located at the City/County Government Center or Safety Building possessing valid parking permits for designated lots or areas shall not park in any other areas during their hours of employment.[6]

Whenever any police officer finds a vehicle in or upon a street illegally parked in any place where such parked vehicle creates or constitutes a traffic hazard or obstruction, blocks the use of a fire hydrant or loading zone or may obstruct the movement of any emergency vehicle, the officer is hereby authorized to remove or have removed and towed away by commercial towing service such illegally parked vehicle. Any reasonable expense incurred in the removal or in the keeping of such vehicle shall be paid by the operator or owner thereof before such vehicle is released to him.
Notwithstanding any other provisions of this article, no vehicle shall be parked for longer than 24 hours in any one location upon a City street or highway.
A. 
No person shall park a passenger automobile within the City limits that is not equipped with a lock suitable to lock either the starting lever, throttle, steering apparatus, gear shift lever or ignition system. Furthermore, no person shall allow a passenger automobile in his custody or control to stand or remain unattended by a licensed driver on any street, alley, highway or any other public place within the City limits, except an attended parking area, unless all the car doors are locked or the starting lever, throttle, steering apparatus, gear shift or ignition of such vehicle is locked and the key removed from the vehicle.
B. 
Any person violating the provisions of Subsection A shall be issued a nonmoving traffic citation in conformity with § 630-33A of this chapter and § 345.28, Wis. Stats. The penalty shall be the amount set for nonmoving violations in § 630-33C of this chapter.

No person shall park, stop or leave standing any vehicle on any posted special event, march, or public assembly, as defined in Chapter 562 of the Code of the City of Fond du Lac, route.

A. 
A school safety zone shall be an area designated as no parking, stopping or standing of a vehicle adjacent to an elementary school. The area designated as a school safety zone shall be identified with signs and curb markings that indicate that no motor vehicle shall be located in the zone. The zone can be no larger than 150 feet and directly adjacent to the school property. A marked crosswalk for access to or from the school shall be located within the zone. The school safety zone regulations shall only apply during the hours of 7:45 a.m. to 3:45 p.m. on school days. The following areas are designated as school safety zones:

B. 
Each school may mark the school safety zone with portable stop signs at the crosswalk. The administrator of any school that installs portable stop signs shall have the responsibility for the daily installation and removal of said signs. The school system shall be responsible for any liability insurance because of improper placement, installation or removal of said signs and shall hold the City harmless therefor.
C. 
Any person found to be in violation of stopping, standing, or parking in a school safety zone or at a school bus loading zone shall be subject to a penalty as provided in the Parking Deposit Schedule, or, if the Parking Deposit Schedule does not include a penalty for the particular violation, shall be subject to a penalty as provided in § 1-4 of this Code.

A. 
Whenever any police officer, community development inspector or parking enforcement officer finds a vehicle which has in excess of 10 unpaid parking citations in violation of this Code and the requirements of this chapter have been met, the official is authorized to have the vehicle removed to either private or public parking or storage premises.
B. 
Requirement of notice.
(1) 
If any police officer, community development inspector or parking enforcement officer is advised a vehicle has 10 or more unpaid parking citations, the Comptroller's Department shall verify and ensure the following:
(a) 
That registration of the vehicle to be removed has been suspended or that the proper steps are being taken to suspend, pursuant to § 345.28, Wis. Stats.; and
(b) 
That a letter shall be mailed by first-class mail to the last known address of the owner(s) of said vehicle advising the following:
[1] 
A list of current unpaid parking citations owed on the vehicle and where to make payment.
[2] 
The date after which the vehicle may be towed. This date will not be less than five days after the date the notice is mailed.
[3] 
The estimated costs of towing and storage and the procedure for reclaiming the vehicle.
[4] 
The procedure for a Municipal Court review.
(2) 
The vehicle may then be towed any time after the date specified in the notice.
C. 
Redemption of vehicle. The City shall provide for the release of the vehicle to its owner when all charges for removal and storage and the unpaid parking/traffic tickets have been paid in full or otherwise satisfied.
D. 
Municipal Court review. The owner of the vehicle may have his parking citations reviewed by the Lakeside Municipal Court by filing a written request and paying the appropriate filing fee(s) with the Court. If the Court finds the vehicle owner has fewer than 10 valid parking tickets/citations, the Court may release the vehicle without payment of charges for removal and storage. The Court may order the City to refund any payment made to the City for these charges.
E. 
Abandoned or unclaimed vehicles. Article III, Abandoned Vehicles, of this chapter, as well as all pertinent state code sections, shall govern abandoned or unclaimed vehicles.
