A Traffic Control Commission is hereby established to set rules,
regulations and erect signs and to exercise the powers granted the
Borough of West Mifflin by the Vehicle Code of the Commonwealth of
Pennsylvania, Title 75 of the Pennsylvania Consolidated Statutes.[1]

The membership of the Commission shall be comprised of the Chief
of Police of the Borough of West Mifflin and the Street Commissioner
of the Borough of West Mifflin. Whosoever is elected or appointed
as Chief of Police or the Street Commissioner of the Borough of West
Mifflin shall automatically assume the seat on the Traffic Control
Commission without the necessity of a formal vote by Council of the
Borough of West Mifflin. Council of the Borough of West Mifflin reserves
the right to appoint additional members or to reduce the membership
of the Traffic Control Commission from time to time as determined
by Council by motion. The Traffic Control Commission is hereby authorized
to establish rules and regulations and the exercise of reasonable
police power over the streets and highways located within the boundaries
of the Borough of West Mifflin. The following are presumed to be reasonable
exercises of police powers:
A.
Enumeration of police powers:
(1)
Regulating or prohibiting stopping, standing or parking.
(2)
Regulating traffic by means of police officers or official traffic
control devices.
(3)
Regulating or prohibiting processions or assemblages on highways.
(5)
Establishing speed limits for vehicles in public parks.
(6)
Designating any highway as a through highway or designating any intersection
or junction of roadway as a stop or yield intersection or junction.
(7)
Prohibiting or restricting the use of highways at particular places
or by particular classes of vehicles whenever the highway or portion
of the highway may be seriously damaged by the use or the movement
of the vehicles would constitute a safety hazard.
(8)
Regulating the operation of pedalcycles and requiring their registration
and inspection and the payment of a reasonable registration fee.
(11)
Enforcement of speed limits as authorized in Subchapter F of
Chapter 33 of the Vehicle Code, except that speed restrictions may
be enforced by local police on a limited access or divided highway
only if it is patrolled by the local police force under the terms
of an agreement with the Pennsylvania State Police.
(13)
Prohibiting or regulating the use of designated streets by any
class or kind of traffic.
(15)
Regulating and temporarily prohibiting traffic on streets closed
or restricted for construction, maintenance or special events.
(16)
Prohibiting pedestrians from crossing a roadway in a business
district or any designated highway except in a crosswalk.
(17)
Restricting pedestrian crossings at unmarked crosswalks.
(18)
Regulating persons propelling pushcarts.
(19)
Regulating persons upon skates, coasters, sleds and other toy
vehicles.
(20)
Adopting and enforcing such temporary or experimental regulations
as may be necessary to cover emergencies or special conditions.
(21)
Regulating the operation of streetcars, the passing of streetcars
by other vehicles and the driving upon streetcar tracks by other vehicles.
(22)
Providing for and establishing procedures governing the removal
and impounding of any vehicle parked on the highways or public property
in violation of any local ordinance adopted pursuant to the authority
of this article or of any of the provisions of this article.
(23)
Adopting such other traffic regulations as are specifically
authorized by this article.
B.
When traffic control devices required. No regulation enacted under Subsection A(1), (4), (5), (6), (7), (9), (10), (11), (12), (13), (14), (15), (16) or (21) shall be effective until official traffic control devices giving notice of the traffic regulations are erected upon or at the entrances to the highway or part thereof affected as may be most appropriate.
C.
Engineering and traffic investigation required. Action by the Commission
under this section shall be taken only after completing an engineering
and traffic investigation when and in such manner as required by regulations
promulgated by the Department of Transportation.
The Traffic Control Commission, upon establishing a regulation
controlling the movement or stopping or standing of a motor vehicle,
will immediately erect signs in conformity with the requirements of
the Department of Transportation, giving the public notice of such
regulation.
It shall be the duty of the Traffic Control Commission to follow
the rules and regulations set forth in the Vehicle Code of the Commonwealth
of Pennsylvania and the rules and regulations of the Department of
Transportation of the Commonwealth of Pennsylvania.
The fines and penalties imposed for a violation of the local
regulations set forth by the Traffic Control Commission or any of
the prior ordinances adopted by Council of the Borough of West Mifflin
shall be the same as imposed by the Vehicle Code of the Commonwealth
of Pennsylvania. In the event that no fine or penalty is imposed by
the Vehicle Code of the Commonwealth of Pennsylvania for the violation
of a traffic regulation adopted by the Traffic Control Commission
of the Borough of West Mifflin, then any person violating said regulation
is guilty of a summary offense and shall, upon conviction, be sentenced
to pay a fine of not more than $15, plus allowable costs.
All ordinances heretofore adopted by the Council of West Mifflin
regulating vehicles or traffic of said vehicles shall remain in full
force and effect.
Council of the Borough of West Mifflin reserves the right to
alter, amend or veto any rules and regulations adopted by the Traffic
Control Commission which, in the opinion of the Council of the Borough
of West Mifflin, are not in the best interest, safety, welfare and
health of the Borough of West Mifflin.
