The removal of a home heating oil tank is an event which requires
the issuance of a Township permit if that work is done by someone
other than the owner of the property. This is an existing requirement
in the Township.
Hereafter, it will be the obligation of the person or business
permanently removing a home heating oil tank to also remove the filler
pipe or to permanently cap that filler pipe on the outside of the
foundation wall. The term "permanently capped" means to take all necessary
action to make it impossible for the nozzle of a home heating oil
delivery truck hose to enter into the filler pipe.
At the time that a permit application is filed for the purpose
of removing the home heating oil tank, the person or business issued
such a permit will be notified of the requirement to remove or permanently
cap the filler pipe at the time of the removal of the oil tank.
Any person or business issued a permit to remove a home heating
oil tank who shall violate any provision of this article shall, upon
conviction thereof, be sentenced to pay a fine of not more than $1,000,
together with the costs of prosecution, and, in default of payment
of such fine and costs, shall be subject to imprisonment for a term
not to exceed 30 days. Every day that a violation of this article
continues shall constitute a separate offense.
