The following conduct shall be prohibited within the limits of public parks and recreation facilities of the Township of Jackson, including neighborhood parks, playgrounds, miniparks and other Township recreation facilities:
A. 
Cutting, injuring, defacing, removing, disturbing, marking or writing upon any tree, shrub, building, fence, bench, sign or other structure, apparatus or property and picking, cutting or removing any shrub, bush, plant or flower.
B. 
No animal shall be permitted to run loose, except during pet shows or similar special programs authorized by the Recreation Department of the Township of Jackson. Subject to the conditions established by § 98-10 of this Code, leashed dogs are permitted in any Township park, or hiking trail, as long as such dog is accompanied by a person over the age of 12 years that is of sufficient strength to hold the dog, is controlled by an adequate leash not to exceed six feet in length, and remains on the leash at all times.

C. 
Sales or displays of or offers to sell goods or wares, except by special permission of the Township Committee.
D. 
Distribution or posting of written or printed matter, except this article or summaries hereof, official notices of the Recreation Department or by special permission of the Township Committee.
E. 
Holding, conducting or addressing public assemblages or debates, except such as are organized or sponsored by the Recreation Department, without having first obtained a permit therefor.
F. 
Conducting exhibitions or entertainment, except such as are organized or sponsored by the Recreation Department, without having first obtained permission from the Township Committee.
G. 
Entry or presence upon or within a park during periods when the same is closed to the public. Except for programs specifically scheduled by the Recreation Department at other hours, parks shall be closed to the public between the hours of 9:00 p.m. and 6:00 a.m. Neighborhood parks and neighborhood playgrounds, miniparks and other neighborhood recreation facilities shall be closed to the public from 6:00 p.m. to 9:00 a.m., except that from Memorial Day to Labor Day, such facilities shall have summer hours and shall be closed from 8:00 p.m. to 9:00 a.m.
H. 
Uttering of abusive or profane language.
I. 
Fighting and other conduct disturbing to others or disruptive of the public peace.
J. 
Betting, gambling and gaming.
K. 
Playing of baseball and softball except at diamonds designated for such play.
L. 
Use of golf or archery equipment except by groups supervised by instructors approved by the Recreation Department.
M. 
Possession of guns, knives, slingshots or other dangerous weapons.
N. 
Driving or parking of motor vehicles or motorized vehicles within public parks and recreation facilities, except the parking of duly licensed or registered motor vehicles in designated parking areas while such park or facility is open to the public.
O. 
Littering.
P. 
Making or maintaining fires, except in receptacles designated for such purposes.
Q. 
Possession or consumption of alcoholic beverages except with the permission of the Chief of Police, who shall issue a permit to any qualified applicant applying for such permission, provided that the applicant is 18 years of age or over.
R. 
Smoking.

(1) 
Smoking is prohibited on all Township-owned property at all times, including all park and recreational facilities.
(2) 
Violations and penalties.
(a) 
Any person who violates this subsection shall appear before the Jackson Township Municipal Court and shall be subject to punishment as follows:

First offense: up to 15 hours of community service at a place designated by the Municipal Court.
[2] 
Second offense: up to 30 hours of community service in a place designated by the Municipal Court and/or a fine up to $100.
[3] 
Third and subsequent offense: up to 50 hours of community service in a place designated by the Municipal Court and/or a fine up to $250.
(b) 
Community service may include participation in a nonsmoking educational or support program approved by the Municipal Court.
S. 
Buses, trucks, cargo vans, and shuttle buses in parks.

(1) 
Buses, trucks, cargo vans, and shuttle buses that seat more than 10 people may not park at any Jackson Township-owned park, playground or playing field without having obtained a permit from the Jackson Township Recreation Department unless such bus is related to a scheduled game with a team or organization having a lease or permit from the Township of Jackson. Only persons who have secured advance bus permits may park, load, or unload buses within the Jackson Township-owned park, playground, or playing field parking lot or adjacent areas.
(a) 
Applications must be completed and submitted with the proper fee of $125. Applications for a bus permit must be submitted at least 10 days in advance to allow the Township ample time to process the application. If an application form is not received within 10 days prior to arrival, there will be a late fee of $10.
(b) 
Permits shall be limited so that no more than two buses are scheduled to park at the Township-controlled park, playground, or playing field parking lot on any given day. Permits must be displayed in the windshield of the bus while the bus is within the Jackson Township owned park, playground, or playing field parking lot.
(2) 
Persons who park, load, or unload buses within a Jackson Township-owned park, playground, or playing field parking lot or adjacent areas without first obtaining a permit shall, upon conviction before the Jackson Township Municipal Court duly authorized to entertain and hear such complaints, be subject to the penalties as provided in any provision of this article or any other Township ordinance or rule or regulation.

A. 
Any resident or taxpayer of the Township of Jackson and any other person shall be entitled to use the facilities and fields of any Township park, recreation area or recreation facility, except during those periods when same is closed to the public when programs scheduled by the Recreation Department are being held or for those periods when permits to use the facilities of the recreation area have been issued by the Recreation Department.
B. 
Leashed dogs are permitted in any Township park, or hiking trail, as long as such dog is accompanied by a person over the age of 12 years, is securely confined, is controlled by an adequate leash that is of sufficient strength to hold the dog not to exceed six feet in length, and remains on the leash at all times. No person owning, keeping, or harboring any dog shall suffer or permit such dog to be upon sports fields, playground areas, or buildings.

No organization, organized group or other club, association or corporation organized for the purpose of sports, recreation and entertainment, for the promotion of sports or any other purpose shall be entitled to use the facilities or fields of any Township park, recreation area or facility as an organized group without having first been issued a permit to do so. Such permits, when issued, shall be evidenced by a written instrument issued by the Recreation Department and shall entitle the holder to use to facilities and fields of the recreation area as designated in the permit and to be on and about the facility only on those days and during those time periods for which it is issued.

A permit issued hereunder shall authorize use of the facility only insofar as it may be performed in strict accordance with the rules and regulations for its use set forth herein or as prescribed by the Township Committee. Any violation by the holder of the permit of any such rules and regulations shall constitute grounds for revocation by the agents or representatives of the Township Committee, whose action therein shall be final. In the event of the revocation of any permit issued hereunder, the holder of such permit who violated such terms and conditions shall be liable to the Township for all damages and losses suffered by it, but neither shall forfeiture nor the recovery or collection thereof of such damages, or both, shall in any manner relieve such person or persons from liability to punishment for any violation of any provision of this article or any other Township ordinance or rule or regulation.

The provisions of this article and all rules and regulations enacted and promulgated by the Township Committee as herein provided are hereby declared to be considered as part of the terms and conditions of each permit issued hereunder.

The Township Committee of the Township of Jackson shall administer all Township recreational facilities and shall enact and promulgate reasonable rules and regulations for the conduct and operation of such facilities, except that same shall not be in conflict with this article or any statute of the State of New Jersey. Such rules and regulations shall prescribe safety rules, times of operations, duties of employees working at said facility and age of persons using said facility.

The provisions, prohibitions and requirements of this article shall be enforceable by the Police Department and the Recreation Department of the Township of Jackson.

Any person who shall violate any provision or provisions of this article which does not have a specified fine or penalty shall, upon conviction, be subject to any or all of the following penalties:
A. 
A fine of up to $1,000; and community service at a place and manner as determined by the Municipal Court for up to 15 hours for a first offense; up to 30 hours of community service for a second offense; and up to 50 hours of community service for a third and subsequent offense; and/or
B. 
Imprisonment in the County Jail for a term not to exceed 30 days.
