the 1972 Code)]
This article shall be known and may be cited as the "Recycling
Ordinance of the Township of Jackson."
The words, terms and phrases used in this article shall have
the following meanings:
All empty all-aluminum beverage and food containers.
The license required by person, persons, partnerships, organizations or corporations to pick up recyclable materials pursuant to § 216-24 of this article.
Those properties used primarily for commercial purposes and
professional offices, which shall include but not be limited to shopping
centers, restaurants, convenience stores, fast-food establishments,
marinas, taverns and other offices.
Empty steel or tin food or beverage containers.
Bottles and jars made of clear, green or brown glass. Expressly
excluded are noncontainer glass, plate glass, blue glass, porcelain
products, ceramic products and light bulbs.

Those facilities that house or serve groups of people, including
but not limited to hospitals, schools, nursing homes, libraries and
governmental offices.
Paper of the type commonly referred to as "newsprint" and
distributed at fixed intervals, having printed thereon news and opinions
and containing advertisements and other matters of public interest.
Expressly excluded, however, are newspapers which have been soiled,
wet or yellowed.
All used motor oils from individuals changing oil from cars,
lawn mowers, motorcycles and other motorized vehicles and machinery.
Expressly excluded are transmission fluids, brake fluids, kerosene,
gasoline and any oil degreasers or solvents.
Every owner, lessee and occupant of a residence, commercial
or institutional establishment within the boundaries of the Township
of Jackson.
Any plastic beverage container which would include PET bottles,
plastic milk containers, cider, soda and water containers and detergent
containers. Expressly excluded are all other forms of plastics.

Those materials which would otherwise become municipal solid
waste and which may be collected, separated or processed and returned
to the economic mainstream in the form of raw materials or products.
Any occupied single-family or multifamily dwelling having
up to four dwelling units per structure from which a municipal or
private hauler collects solid waste.
Garbage, refuse and other discarded solid material normally
collected by a municipal or private hauler.

A.
The Recycling Coordinator shall establish and promulgate reasonable
rules and regulations as to the manner, days and times for curbside
collection, sorting, transportation, sale and/or marketing of said
recyclable material in order to encourage the preservation of material
resources while minimizing the cost of the recycling program to the
Township of Jackson. The rules and regulations provided for hereunder
shall be adopted by resolution of the Township Council and shall be
in accordance with the Ocean County Solid Waste Plan. Copies shall
be maintained in the office of the Township Clerk and be available
for inspection and/or purchase.
B.
Recyclable material shall be the property of the Township of Jackson
once placed at curbside or brought to a dropoff center.
C.
It shall be a violation of this article for any person unauthorized
by the Township of Jackson to pick up or cause to be picked up said
recyclable material. Each such collection in violation hereof shall
constitute a separate distinct offense punishable as hereinafter provided.
D.
The Township may use municipal personnel to collect residential recyclable
material set forth herein at curbside and/or from a dropoff center.
Disposal shall be in accordance with the agreement set forth by the
Ocean County Solid Waste Plan.
E.
The Township may elect to enter into agreements with any private
vendor, person, partnership, corporation or municipality authorizing
him or it to collect said recyclable material at curbside or from
a dropoff center. All recyclable materials shall be disposed in agreement
with Ocean County and in accordance with the Ocean County Solid Waste
plan.
F.
It is mandatory for all residents, homeowners, and renters to recycle,
as mandated by the Ocean County Solid Waste Plan and N.J.A.C. 7:26A,
from all other solid waste produced by such residence for collection
and ultimate recycling of said materials.
G.
It is mandatory for businesses, commercial establishments, institutional
establishments, educational institutions, and civic, religious, and
nonprofit organizations within the boundaries of Jackson Township
to recycle as mandated by Jackson Township, the Ocean County Solid
Waste Plan and N.J.A.C. 7:26A. These entities will be responsible
for removal of their own recycling by having it hauled by a private
vendor or taking it to a registered recycling facility. Jackson Township
will not be responsible for removal or receiving recycling from these
establishments but reserves the right to accept certain recycling
products from these entities. Businesses or institutions hauling their
own recyclables shall provide the Municipal Recycling Coordinator
with yearly reports on the quantity and destination of recyclables. Said
yearly reports shall be provided to the Township's Municipal Recycling
Coordinator on or before March 30 of the calendar year for the preceding
twelve-month calendar year concluding on December 31 of the prior
year. In addition, with respect to any entity to which this subsection
applies, said entity, if it utilizes a private recycling hauler for
its recycling, other than the company that is already contracted with
Jackson Township, shall obtain from its hauler all information regarding
the amount of its recycling hauled and shall forward same to the Township's
Recycling Coordinator and shall be provided as part of its yearly
recycling reports noted above.

H.
All residents shall be responsible for providing their own recycling
containers, not to exceed 45 gallons, which will be placed curbside
on a biweekly basis as scheduled by the Department of Public Works
and the current vendor's contract. For descriptive purposes, "residents"
will be defined as owners or renters of single-family dwellings, duplexes,
mobile homes, condominiums, town homes and private communities. Apartment
dwellers are required to recycle and will use the containers placed
in designated areas by their management office or by the curbside
recycling vendor contracted by Jackson Township.

I.
There are eight designated Public Works districts located in Jackson
Township that are used for scheduling curbside recycling, leaf, brush
and bulky pickup. Residents may locate their individual district by
visiting www.Jacksontwpnj.net, or by calling the Department of Public
Works at 732-928-1200. Maps outlining districts are also available
in the Department of Public Works.
J.
Resident containers, which shall be 45 gallons or less, should bear
a yellow Jackson Township recycling sticker. Recycling stickers are
available in the Department of Public Works and are free of charge
for residents. Residents may also use larger cans, up to 96 gallons,
if they are approved by the contracted curbside recycling vendor and
can be picked up by the vendor's automated system.

K.
There is hereby established a curbside single-stream recycling program
for use by residents in accordance with the Ocean County Solid Waste
Plan. The following recyclable materials shall be collected from residential
curbside recycling containers; all items should be clean and free
of food debris or liquids prior to recycling. The following items
are acceptable for recycling:

Aluminum and tin cans, as well as aluminum foil and aluminum trays
that are washed thoroughly before recycling them.
(2)
Glass jars and bottles.
(3)
No. 1 plastic. Examples are water and soda bottles, condiment bottles,
shampoo bottles, plastic clamshells (strawberry containers, clear
"to-go" containers, etc.), peanut butter jars, etc. Plastic lids can
stay on.
(4)
No. 2 plastic. Examples are milk gallons, laundry detergent containers,
shampoo bottles, cleaning product containers, vitamin bottles, etc.
Plastic lids can stay on.
(5)
No. 5 plastic: examples are butter and yogurt containers, fast-food
beverage cups, microwavable food containers (Tupperware®), plastic lids, toys,
etc. Plastic lids can stay on.
(6)
Newspapers.
(7)
Mixed paper.
(8)
Magazines.
(9)
Junk
mail.
(10)
Paperboard/chipboard. Examples are cereal boxes, food boxes, tissue
boxes, paper towel/toilet paper/gift wrap rolls.

Corrugated cardboard.
L.
All of these items may be mixed together in containers. Up to seven
containers, 45 gallons or less, may be placed curbside for biweekly
pickup.

M.
Items that shall be excluded are:

Used pizza boxes.
(2)
Plastic bags.
(3)
Paper plates and plastic utensils.
(4)
Cans that contained motor oil or any type of hazardous liquid.
(5)
Drinking glasses.
(6)
Glass from window panes, windshields, picture frames, serveware,
etc.
(7)
Light bulbs.
(8)
Regular household trash.
(9)
Styrofoam.
(10)
Toys, lawn furniture, plastic hoses, mop/broom handles, flower
pots, etc.
(11)
Batteries. (Note: Bring to special waste drop-off buildings
at both Ocean County recycling centers.)
(12)
Electronics/aerosols/paint/rigid plastics. (Note: Bring to special
waste drop-off buildings at both Ocean County recycling centers.)
(13)
Metal scrap.
N.
If any of the above is found in the recycling containers, the load
will be left and deemed "contaminated."
O.
All recycling shall be placed curbside before 6:00 a.m. on the day
of the scheduled pickup. It is recommended that the container be placed
curbside the night before.
P.
Residents also have the option of disposing of their recycling at
the transfer station located on Don Connor Boulevard.
Q.
All recycling regulations are to be in compliance with N.J.A.C. 7:26A
et seq. and the Ocean County Solid Waste Plan. Copies of regulations
are on file in the Department of Public Works and the Office of the
Township Clerk and are available to the public during normal business
hours.

A.
The recyclable materials designated in § 216-21 of this article shall be put in a suitable container, separate from other solid waste, and placed at the curb or such other designated area for collection at such times and dates as may be hereinafter established in the municipality's recycling regulations. The container for recyclable materials shall be clearly labeled and placed at the curb or other such designated area for collection and not to exceed 45 gallons' capacity or 50 pounds in weight or as designated in § 216-21J.

B.
It shall be unlawful to dispose of used motor oil in any manner other
than through an authorized used oil collection site. On and after
the adoption of this article and in accordance with existing state
regulations (N.J.A.C. 14A:3-11), any person or property with used
oil holding tanks, as designated by the Recycling Coordinator, shall
accept up to five gallons at a time of used motor oil from individuals
changing oil from cars, lawn mowers, motorcycles and other motorized
vehicles and machinery and shall post a sign informing the public
that they are a used oil collection site. No new persons or sites
will be established except by written authorization of the Recycling
Coordinator and with the approval of the Mayor and Council.

All persons within the municipality shall, from the period at
such times and dates as may be hereinafter established in the municipality's
recycling regulations of each year, separate leaves from other solid
waste generated at their premises and, unless the leaves are stored
or recycled for composting or mulching on the premises, place the
leaves at the curb or other designated area for collection at such
times and dates and in the manner established by the municipality's
recycling regulations.

A.
As an alternative, Jackson Township reserves the right to donate
or sell recyclable materials to an authorized person or persons, partnership,
organization or corporation as established by the guidelines of this
section and in accordance with the Ocean County Solid Waste Plan.
C.
Any partnerships or corporations shall provide to the Township of
Jackson tipping receipts on a monthly basis. Failure to comply with
this provision shall constitute a violation of this article and shall
be subject to penalties provided under this section of this article.
Furthermore, any violations of this section may result in the revocation
of said license hereinafter stated.

It shall be a violation of this article for any unauthorized person, persons, partnerships, organizations or corporations to collect, pick up or cause to be collected or picked up within the boundaries of the municipality any of the recyclables designated in §§ 216-21, 216-22 and 216-23 of this article. Each such collection in violation of this article shall constitute a separate and distinct offense punishable as hereinafter provided.

The municipality, Recycling Coordinator and Director of Public Works are hereby authorized and directed to establish and promulgate reasonable regulations detailing the manner, days and times for the collection of the recyclable materials designated in §§ 216-21, 216-22 and 216-23 of this article and such other matters as are required to implement this article. Such regulations shall take effect only upon the approval of the Township Council by adoption of a resolution implementing the same. The Recycling Coordinator, the Director of Public Works, the Police Department and the Code Enforcement Officer and their duly designated employees or subordinates are hereby authorized and directed to enforce the provisions of this article and any implementing regulations adopted hereunder.

A.
Any person, firm, or corporation violating any provision of this
article or any regulations adopted hereunder shall be subject to a
fine of not less than $250 or more than $2,500 or imprisonment of
up to 30 days for each offense.
C.
Each and every day in which a violation of any of the provisions
of this article exists shall constitute a separate offense.

The Township Council of the municipality may exempt persons occupying commercial and institution establishments from the source-separation requirements of § 216-22 of this article if those persons have otherwise provided for the recycling of recyclable materials designated in § 216-21 of this article. To be eligible for an exemption under this section, the person seeking the same shall, prior to June 1 each year, provide written documentation to the municipality of the total amount of materials recycled during the preceding calendar year.
