A. 
The Township Council finds it necessary for the convenience of residents to provide a bulky waste and brush curbside collection program for all residents. The Department of Public Works shall establish a bulky waste collection program and a separate scheduled time for a brush curbside collection program which shall provide each resident with the opportunity to have their brush and bulky waste items collected once annually. Pickup will be scheduled by individual Public Works Zones 1 through 8. The following communities will not be listed by zone, but by community name as follows:

Residents may visit www.jacksontwpnj.net or call 732-928-1311 to determine in which zone they reside. The annual curbside pickup schedule for bulky waste and brush shall be determined by the Director of Public Works and shall be advertised on the Jackson Township website, local cable access channel and advertised in local publications. Residents will be notified accordingly each year through various means of communication and direct mail.
As used in this article, the following terms shall have the meanings indicated:
BRUSH
Trimmings and clippings resulting from the ordinary and regular pruning and trimming of residential ornamental trees and shrubbery.
COMMERCIAL BULKY WASTE
Any type of bulky waste materials generated by commercial enterprises or business operations of any sort, including but not limited to retail stores, professional offices, real estate agencies, commercial landlords, contractors and agricultural business enterprises.
CONSTRUCTION/DEMOLITION DEBRIS
Any and all nonhazardous building materials, such as plywood, lumber, sheetrock, paneling, moldings, insulation material, plumbing fixtures, roofing and siding materials, that are generated by the construction, demolition, alteration or remodeling of any residential dwelling or residential accessory structures.
CONTAINERIZED
The placement of yard waste in a trash can, bucket, recycle-type paper bag or other vessel, such as to prevent the yard waste from spilling or blowing out into the street and coming into contact with stormwater.
HAZARDOUS WASTE
Dangerous materials or substances, such as poisons, acids, caustics, pesticides, paints, chemicals, explosives and any other materials likely to cause an injury to any person or damage to equipment used in making collections, such as pool chemicals, automotive maintenance chemicals, barbecue grill propane tanks that have not been completely emptied and any other such waste items that may be defined as "hazardous" and/or "toxic" under state and federal law.
PERSON
Any individual, corporation, company, partnership, firm, association, or political subdivision of this state subject to municipal jurisdiction.
RESIDENTIAL BULKY WASTE
Any type of bulky items that are not appropriate for disposal in regular household trash due to their size and nature, including but not limited to appliances, furniture, bedding, rugs, pool covers, and any similar types of bulky nonhazardous household waste items that are generated by a resident maintaining and residing in a residential property in Jackson Township. Landlords will be considered commercial vendors and total house cleanouts will not be acceptable for curbside pickup.
STREET
Any street, avenue, boulevard, road, parkway, viaduct, drive, or other way, which is an existing state, county, or municipal roadway, and includes the land between the street lines, whether improved or unimproved, and may comprise pavement, shoulders, gutters, curbs, sidewalks, parking areas, and other areas within the street lines.
YARD WASTE
Leaves and brush.
No tires will be collected in the Township's bulky waste collection program. Residents should contact the Ocean County Department of Solid Waste for instructions as to how to dispose of tires.

All residents placing bulky waste items for curbside collection shall separate the same into metal and nonmetal piles. Small broken items, such as toy pieces, broken glass and shoes should be placed in regular trash, as these are not considered bulky items. Electronic waste, e.g., televisions, computers, monitors, etc. are not considered bulky waste and will not be picked up curbside. These items may be disposed of at the bulky waste convenience center located on Don Connor Boulevard, Jackson Township, during regular operating hours.
Brush placed for collection must be no larger than four inches in diameter and six feet in length and placed with butt end facing the street. In addition, all small brush must be secured in bundles weighing less than 50 pounds each. No logs, stumps, grass clippings, evergreens with roots or debris from land clearing will be collected. Christmas trees are not considered brush and may not be placed curbside. Trees may be disposed of from January 2 through February 1 at the following dropoff locations and each park will have a specific area designated for Christmas tree dropoff.

All recyclable and bulky waste materials placed at curbside for collection shall immediately become the property of the Township and shall be disposed of in a manner prescribed by law. Persons convicted of scavenging shall be subject to the penalties provided for in Articles I through VI of this chapter.

No person shall place for collection, brush and/or bulky waste items that, in the aggregate, amount to more than five cubic yards for any one pickup. Piles of bulky waste items shall be neatly placed, separated and organized according to composition in accordance with § 216-39 in a pile not to exceed approximately four feet wide by four feet high by eight feet long.

No person shall place bulky waste, brush or yard waste at curbside for collection more than 48 hours prior to the first day of collection scheduled for his/her zone. No person shall place bulky waste, brush or yard waste closer than 10 feet to any storm drain inlet. Placement of any such waste at the curb or along the street at any other time or in any other manner is a violation of this article.
No commercial bulky waste will be collected by the Jackson Township Department of Public Works from any property.
A. 
Any resident violating the provisions of this article shall be issued a warning notice by the Department of Public Works and/or Code Enforcement upon the first offense. Upon a second violation, the resident shall be issued a fine of up to $500 by the Division of Code Enforcement.
B. 
A third offense under this article shall be punishable, upon the conviction in Municipal Court, by a fine of not less than $1,000 or by imprisonment for not exceeding 90 days, or both.
