The purpose of this article is to permit the Town Clerk to select and the Town Board to hire a nonresident of the Town of Lima as a Deputy Town Clerk.

A.
Section 23(1) of the Town Law provides that every officer of the Town at the time of appointment to office and for the duration of the term of office shall be an elector of the Town.
B.
In accordance with the powers conferred upon the Town pursuant to Municipal Home Rule Law § 10, Town Law § 23(1) is overruled and declared inapplicable to the Town of Lima insofar as it requires or may require that a Deputy Town Clerk hired by the Town of Lima must be an elector or resident of said Town.
C.
The office of Deputy Town Clerk of the Town of Lima may be filled by an eligible candidate residing in Livingston County or in any county immediately adjoining and contiguous to Livingston County, New York.
In all other respects, unless previously modified by local law, the residency requirements of Town officials, elective or appointive, shall be as governed by § 23 of the Town Law.
